" RESOLUI'IGI ID. 73-87 A RESOLUI'Ia~ GRANrll~ A VARIANCE 10 JERRY ELZEA WHEREAS, Jerry Elzea (Applicant) is the owner of real property located at 5705 Eureka Road in the City of Shorewood, legally described as follows: Corrmencing at the northwest corner of Lot 4, Eureka, Hennepin Collllty, Minnesota; thence south along the west line of said Lot 4 a distance of 158.00 feet; thence east 110 feet to-the east bOlllldary of said Lot 4; thence north along the east bOlllldary of Lot 4 a distance of 136 feet more or less to the north bolllldary of said Lot 4; thence northwesterly along the north bOlllldary of said Lot 4 to the point of beginning. and WHEREAS, the Applicant has an existing single-family dwelling and one car garage located on the property, the garage being located 2.0 feet from the south lot line and 1.2 feet from the east lot line of the property; and WHEREAS, the property contains 10,512 square feet of area and is located in a R-lA Zoning District requiring 40,000 square feet; and WHEREAS, the Applicant has made application for a variance for the construction of a new two car garage on the property; and WHEREAS, The application was reviewed by the Shorewood Planning Commission at a public hearing held on 2 Jlllle 1987. NlV, 'lHEREFORE, BE IT RESOLVED by the City Collllcil of the Ci ty of Shorewood as follows: FINDIIDS OF FAC!' 1. That the dimensions of the property make it impossible to construct any type of building on the site wi thout the granting of a variance. 2. That the existing garage located on the property is a non-confonning structure with accesses to both Eureka Road and Smithtown Road. 3. That the proposed garage would have a ten foot setback from the south lot line and a ten foot setback from the east lot line, thereby decreasing the non-confonnity. 4. That the new garage would require a forty-foot variance for the south lot line, and a forty foot variance for the east lot line. . . . . ,. cno.USIrns 1. That the Collllcil has detennined that the Minnesota climate makes it necessary that each residential llllit be allowed at least a two car garage. 2. That Appl icant has establ ished lllldue hardship as defined by Minnesota Statutes. 3. That based upon the foregoing, the City Collllcil hereby grants the Applicant's request for a variance as setforth above, upon the following tenns and condit ions: a.
