WHEREAS, the final plat of Ferncroft has been submitted in the
manner required for platting of the land llllder Shorewood City Ordinances and
llllder Chapter 462 of Minnesota Statutes and all proceedings have been duly
had therellllder; and
WHEREAS, said plat is consistent with the Shorewood Comprehensive
Plan and the regulations and requirements of the laws of the State of
Minnesota and Ordinances of the City of Shorewood.
N3V, 1HEREFOOE, BE IT RESOLVED, by the Ci ty Collllcil of the City
of Shorewood:
1. That the plat of Ferncroft is hereby approved.
2. That the approval is specifically conditioned upon the terms
and conditions as contained in that certain Development Agreement attached
hereto as Exhibit A.
3. That the Mayor and Ci ty Clerk are hereby authori zed to
execute Certificate of Approval on behalf of the City Collllcil.
3. That this final plat shall be filed and recorded within 30
days of the Developer's receipt of this resolution.
BE IT FlJRIHER RESOLVED, that such execution of the Certificate
upon said plat by the Mayor and Ci ty Clerk shall be conclusive showing a
proper compliance therewith by the subdivider and City officials and shall
entitle such plat to be placed on record forthwith without further fonnality,
all in compliance with Minnesota Statutes and Ordinances of the City.

RESOLUTION BY THE CITY COUNCIL OF THE
CITY OF SHOREWOOD
TO VACATE A PORTION OF FERNCROFT DRIVE
WHEREAS, Notice of Public Hearing on the proposed vacation of a
portion of Ferncroft Drive, City of Shorewood, Hennepin County, Minnesota,
was published in the WEEKLY NEWS, INC., on the 21st and 28th day of May,
1987, and in the MINNESOTA SAILOR NEWSPAPERS, INC., on the 18th and 26th day
of May, 1987; and
WHEREAS, said Notice of Public Hearing was posted in three (3)
locations in the City of Shorewood; and
WHEREAS, the Council of the City of Shorewood has heard all
interested parties on the question of vacation at a Public Hearing on the 8th
day of June, 1987, in the Council Chambers at the City Hall.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Shorewood, Minnesota, that a portion of Ferncroft Drive, hereinafter
described, is hereby vacated:

That portion of Ferncroft Drive, also known as
Sunrise Lane, as platted in Minnetonka Manor, which
lies easterly of the northerly extension of the
westerly line of Block 8 of said Minnetonka Manor
BE IT FURTHER RESOLVED that the City Clerk is directed to notify
the County offices in accordance with Minnesota Statutes.

hereinafter referred to as the "Ci ty", and ECXLUND AND SWEDLUND HlVJES, INC.,

WHEREAS, the Developer is the contract purchaser of certain
lands described in Exhibit A attached hereto and made a part hereof, which
lands are hereinafter referred to as the "Subject Property"; and
WHEREAS, the Deve loper has made app Ii ca ti on nnder the Ci ty
Subdivision Ordinance for City Conncil approval of a single-family
residential development preliminary plat of said land, said plat to to be
known as Ferncroft; and
WHEREAS, the City Conncil by its resolution passed on Jnne 8,
1987, has approved the preliminary plat of the subject property; and
NlV, 'IHEREFORE, in consideration of the foregoing premises and
acceptance by the City of the final plat of Ferncroft, the City and the
Developer agree as follows:
1. CUWEYANCE OF oorwr A. Upon fi I ing of the plat herein wi th the
Registrar of Ti tles and with the Connty Recorder, Developer shall convey
title to Outlot A to the City by Warranty Deed, free and clear of all
encunbrances.
2. TITLE INSURANCE POLICY. In order to ensure good ti tle, Developer agrees
to provide City with an owner's Title Insurance Policy for Outlot A, said
policy to be issued in name of City by a licensed, reputable title insurance
coopany.
3. 1987 TAXES. Developer agrees to pay all taxes due and payable for the
year 1987 on said Outlot A.

4. Sucx:;ESSORS AND ASSIGNS. It is agreed by and between the parties hereto
that the Agreement herein contained shall be binding upon and inure to the
benefit of their respective legal representatives, successors, and assigns.
