RESOLurIOO" 00. 100-87 WHEREAS, Eric Danser has applied for a variance for the construction of a screened porch on an existing deck at the front of his home located at 21640 Lilac Lane in the City of Shorewood, on property legally described as follows: Lot 133, Auditor's Subdivision No. 120, Hennepin County, Minnesota WHEREAS, the screened porch proposed to be constructed does not meet the front yard setback requirements for the subject property and therefore requires a variance to the Shorewood Zoning Ordinance; and WHEREAS, a Public Hearing was held and the application reviewed by the Planning Coomission on June 16, 1987; and WHEREAS, a further review of the application was had before the City Council at their regular meeting held on June 22, 1987; and WHEREAS, a motion to adopt a resolution approving the requested variance failed to obtain a 4/5 majority vote, Stover and Brancel voting nay, and the Council subsequently adopted findings and conclusions denying applicant's request for a variance; and . WHEREAS, at a regular meeting of the City Council held on August 10, 1987, Stover moved to reconsider the original motion to approve the variance, and such motion passed on a unanimous vote; and WHEREAS, upon reconsideration, a motion to adopt the following resolution approving the requested variance was made by Haugen, seconded by Stover. 1'0\1, 'lHEREFORE, BE IT RESOLVED by the Ci ty Council of the Ci ty of Shorewood as follows: FINDIm8 OF FACr 1. That the subject property is located in an R-lA zoning district which requires a 50-foot front yard setback. 2. That applicant proposes to construct a screened porch within the front yard of the subject property at a distance of 36.6 feet from the front yard lot line. 3. That applicant's requested construction requires a front yard setback variance of 13.4 feet. 4. That although applicant has sufficient area at the rear of his house to construct the proposed screened porch, such construction could not be accomplished without destroying the historical value and architectural integrity of the building. . . . . . ~ CDCLUSIOO"S 1. That due to the architectural design and historical value of the building, the proposed porch could not be constructed without the requested variance. 2. That Applicant has established undue hardship as defined by Minnesota Statutes. 3. That based upon the foregoing, the City Council hereby grants the Applicant's request for a variance as set forth hereinabove. 4. That the City Clerk is hereby authorized and directed to provide a certified copy of this resolution for filing with the Hennepin County Recorder or with the Registrar of Titles.
