RESOLUI'ICN ID. 102-87
WHEREAS, Carol Regan is the owner of real property in the Ci ty of
Shorewood, Hennepin County, Minnesota, described as follows:
See Exhibit A attached hereto and made a part
hereo f.
and
WHEREAS, Regan has an existing residence on the property which is
located five feet from the westerly property line and fourteen feet from the
easterly property line; and
WHEREAS, Regan has made application for a variance and a
Conditional Use Pennit to add additional living space to the existing
dwellir~ unit which would encroach 8 feet into the 20 foot side yard
setbacks; and
NIERFAS, Shorewood Zoning Ordinance requires side yards which
total 30 feet with no one side being less than 10 feet; and
WHEREAS, Shorewood Zoning Ordinance requires a Condi tional Use
Permi t for the expansion of any non-conforming structure; and
WHEREAS, a public hearing was held and the application reviewed
by the City Planning Coomission on August 4, 1987.
IDV, IHEHEFORE, BE IT RESOLVED by the Ci ty Council of the City of
Shorewood as follows:
FINDINJS OF FACf
1. That due to the design and location on the lot, the dwelling
could not be expanded in a reasonable manner without the requested variance
and aJP.
2. That the size of the dwelling unit and the necessity to
expand in order to provide additional living space makes an increase in the
non-conformity justified.
3. That there is a 21 foot wide access easement to Lake
Minnetonka located on the west side of the property providing additional open
space on that side of the dwelling unit.
OCNCLUSICNS
1. That Appl icant has establ ished undue hardship as defined by
Minnesota Statutes.

2. That based upon the foregoing, the City Council hereby grants
the Applicant's request for a variance and Conditional Use Permit as set
forth hereinabove.
3. That the City Clerk is hereby authorized and directed to
provide a certified copy of this resolution for filing with the Hennepin
County Recorder or with the Registrar of Titles.
