RESOLUfICN ro. 103-87 A RESOLUfICN GRANTING A CXN:>ITICNAL USE PERVIIT '10 'lHE NmV AI03'lOLIC QlUR(]I OF ~ AMEIUCA WHEREAS, the New Apostolic Church of North America (the Applicant) is the owner of real property located at 5765 Smithtown Circle in the City of Shorewood, legally described as follows: Lot 5, Block 2, Smithtown Circle and WHEREAS, the Applicant has appl ied to the City for a Condit ional Use Pe~it to construct a 27' x 62' church building; and WHEREAS, the appl icat ion was reviewed by the Shorewood Planning Commission at a public hearing held on 4 August 1987; and WHEREAS, the subject property is located in an R-1C single family residential zoning district; and WHEREAS, the Applicant's application to construct a church building within a residential district requires the granting of a Conditional Use Pe~it. NlV, 'lHEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood as follows: FINDINGS OF FACT 1. That the proposed building meets all setback requirements and no variances are required. 2. That land use and zoning surrounding the subject site are as follows: vacant, zoned R-1C single family residential, zoned R-1C - vacant, zoned R-lA north and west - south east 3. That the proposed use will be compatible with present and future land uses of the area and is consistent with the official City Comprehensive Plan. 4. That the proposed use will not adversely affect the general welfare, public health and safety of the community. . . . aNCLUSICNS That the application of the New Apostolic Church of North America for a Conditional Use Pe~it as set forth hereinabove be and hereby is granted, subject to the following conditions: 1. That the Applicant shall su1:xnit a proposed plan for landscaping the area together with a bid from a certified nurseryman for accomplishing the proposed plan. 2. That a letter of credit in the amount of 150% of the bid amount will be posted by the Applicant to insure that the landscaping plan is properly completed. 3. That the proposed parking lot will be the exclusive area for parking cars of those attending church activities and no on-street parking will be pe~itted at any time. 4. That the capacity of the building will be limited to 50 persons. 5. That all deliveries to the church will be limited to small trucks or vans. 6. That the Applicant will su1:xnit plans and specifications for all required improvements for the plat of Smithtown Circle, including the street, utilities, and drainage, for review and approval by the City Engineer. 7. That the Applicant will post a letter of credit in the amount of 150% of the cost of the improvements, as estimated by the City Engineer, to ensure completion. 8. That the Appl icant shall su1:xni t plans for grading, and drainage facilities for review and approval by the City Engineer.
