WHEREAS, Denni s Wo lter is the owner of real property in the Ci ty
of Shorewood, Hennepin County, Minnesota, described as follows:
Lot 2, Block 5, Minnetonka Manor.
and
WHEREAS, Wolter has an existing two-story dwelling on the
property which is located eleven feet from the right-of-way of Suburban
Drive; and
WHEREAS, Wolter has made application for a variance and a
Conditional Use Penmit to construct a 12' x 15' dining roam addition to the
dwell ing; and
WHEREAS, a public hearing was h,~ld and the application reviewed by
the City Planning Commission on August 4, 1987.
~, 1HEREFORE, BE IT RESOLVED that the Ci ty Council of the Ci ty
of Shorewood finds as follows:
FINDIOOS OF FACr
1. That the subject property is a corner lot being 53 feet wide
containing 13.886 square feet and located in an R-lD zoning district which
requires a 30-foot front yard setback.
2. That the existing dwelling on the property is a
non-confonming structure.
3. That applicant proposes to construct an addition to the
dwelling within the front yard of the subject property at a distance of 22
feet fram the front yard line.
4. That applicant's requested construct ion requires a front yard
setback variance of 8 feet.
5. That applicant's requested expansion of a non-confonming
structure requires a Conditional Use Penmit.
6. That due to the configuration of the property, the dwelling
could not be expanded without the requested variance and aJP.

CLNCLUS ICNS
1. That applicant's proposed expansion of the non-confonming
structure does not act to increase the non-confonnity.
2. That Applicant has established undue hardship as defined by
Minnesota Statutes.
3. That based upon the foregoing, the City Council hereby grants
the Applicant's request for a variance and Conditional Use Penmit as set
forth hereinabove.
4. That the City Clerk is hereby authorized and directed to
provide a certified copy of this resolution for filing with the Hennepin
County Recorder or with the Registrar of Titles.
