I / ;Z; - g 7 A RESOLUTION DENYING A REQUEST FOR THE PREPARATION OF AN ENVIRONMENTAL ASSESSMENT WORKSHEET FOR BRENTRIDGE WHEREAS, Shorewood Oaks Development, Inc., (the Developer) has an interest in certain lands legally described as: Outlot A, Registered Land Survey Number One, except the North 218.9 feet thereof, Hennepin County, Minnesota; and WHEREAS, the Developer has submitted the final plat for the development of such lands, said plat to be known as Brentridge (the project); and WHEREAS, pursuant to the rules contained in the Minnesota Code of Agency Rules Environmental Quality Board, Environmental Review Program (6MCAR 3. 026), twenty-five (25) persons (the petitioners) have signed a petition addressed to the Environmental Quality Board requesting that an Environmental Assessment Worksheet be prepared for the project; and . WHEREAS, The Environmental Quality Board has determined that the Shorewood City Council is the responsible governmental unit to review and act on the said petition. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood as follows: FINDINGS OF FACT 1. That the petition submitted by the petitioners concerns itself with the effects the project may have on wildlife living in the area, damage which might occur to the wetland itself, an increase in volume of traffic in the vicinity, an increase in the noise level, and possible run-off and drainage problems resulting from the proposed street. 2. That Chapter 1102 of the Shorewood City Code provides protection of the wetlands by prohibiting filling, grading, dredging, excavations or construction in the wetland areas. In addition to prohibiting building in the area, the code further provides that land within the wetland area cannot be credited as part of the area required by the Zoning standard for development of land outside the wetland area. The Code also provides that easements shall be given to protect area from drainage; and that streets, driveways and culverts shall not be constructed so as to restrict flow of water. . 3. That based upon the lot sizes proposed, the vehicular traffic generated within the project area will be no greated per acre than the traffic presently generated for the existing houses located on Howard's Point Road outside of the project area. Furthermore, the project is only 250 feet from Smithtown Road, a collector street. " . . . 4. That the concerns of the petitioners regarding the potential environmental effects of the project can be adequately addressed and controlled through the application of the provisions contained in the Shorewood City Code Chapter 1102. CONCLUSIONS That based on the foregoing, the City Council of the City of Shorewood concludes that: 1. The evidence presented by petitioners fails to demonstrate the project may have the potential for significant environmental effects not controlled by the City Code. 2. The petition of petitioners requesting the preparation of an Environmental Assessment Worksheet is hereby denied.
