Adams (Applicants) are the owners of certain real property in the City of Shorewood, County of Hennepin, State of Minnesota, legally described in Exhibit A, attached hereto and made a part hereof; and WHERFAS, Applicants have applied to the City for a subdivision of said real property into two parcels legally described in Exhibit B, attached hereto and made a part hereof; and WHERFAS, Applicants and all other parties holding an interest in the said real property have agreed to grant to the City certain drainage and utility easements legally described in Exhibit C and an easement for roadway purposes, legally described in Exhibit D, both of which exhibits are attached hereto and made a part hereof; and WHEREAS, a public hearing was held by the Shorewood Planning Coornission on 30 September 1987, for which notice was duly published and all adjacent property owners were duly notified. toY, 'lliEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood as follows: 1. That the real property legally described in Exhibit A be divided into two parcels, legally described in Exhibit B. 2. That the City Clerk furnish Applicants wi th a cert ified copy of this resolution for recording purposes. 3. That Applicants record this resolution, together with the drainage and utility easements legally described in Exhibit C and the roadway easement described in Exhibit D with the Hennepin County Recorder or Registrar of Titles within thirty (30) days of the date of the certification. The Grantor shall have the right to use the Property in any way which does not interfere with the Grantee's use of this easement. The Grantor shall not be liable for any costs of maintenance of the utility equipment and drainage facili ties. The Grantor makes no warranties as to the Grantor's right, title or interest in the Property or any part thereof, to any restrictions or encumbrances thereon, or to the Grantor's right to execute and deliver this instrument.
