WHEREAS, on ~ /1 , 1987, the Ci ty entered into an Agreement
with Lundgren Bros. Const uction, Inc., for the development of the plat known
as McKinley Place at Near lYbuntain 1bird Addi tion; and
WHEREAS, said Agreement included by reference all the tenns and
conditions of a certain ~velopnent Agreement previously entered into between
the parties on July 28, 1986, for tIle development known as Near lYbuntain; and
WHEREAS, Paragraph 3 of said Near lYbuntain ~velopment Agreement
provided for the ~veloper to construct and install certain enumerated
inprovements, which inprovanents included sani tary sewer, watennain and stonn
sewer; and
WlnmrnAS, Paragraph 13 of said development agreement provided for
such inprovements to be subject to a final inspection by the City Engineer;
and
WHEREAS, Paragraph 24 of said development agreement provided for the
conveyance of said inprovements to the City by the Developer and for the
acceptance by the City of such inprovements; and
WHEREAS, the ~veloper has conpleted construction and installation
of the sanitary sewer, watermain, and stolm sewer inprovements in the plat of
McKinley Place at Near Mbuntain Third Addition, and all such inprovements
have been inspected by the City Engineer and found to be in conpliance with
the applicable plans and specifications; and
WlIEREAS, the ~veloper is desirous of conveying said inprovements to
the City and the City is desirous of accepting said inprovements from the
~veloper.
NJAI, 1HEREFORE, BE IT RESOLVED by the City Council of the Ci ty of
Shorewood as follows:
That the City hereby accepts from the ~veloper the following
improvements in the plat of ~~Kinley Place at Near Mbuntain Third Addition:
Sanitary Sewer
Watennain
Stonn Sewer.

with Lundgren Bros. Construction, Inc., for the development of the plat known
as McKinley Place at Near lYbuntain Third Addition; and

WHEREAS, Paragraph 3 of said Near Mbuntain Development Agreement
provided for the Developer to construct and install certain enumerated
irrprovements, which irrprovanents included sanitary sewer, watermain and stonn
sewer; and
WHEREAS, Paragraph 13 of said development agreement provided for
such improvements to be subject to a final inspection by the City Engineer;
and
WHEREAS, Paragraph 24 of said development agreement provided for the
conveyance of said improvements to the City by the Developer and for the
acceptance by the City of such improvements; and
WHEREAS, the Developer has completed construction and installation
of the sanitary sewer, watermain, and stonn sewer improvements in the plat of
McKinley Place at Near Mbuntain 11lird Addition, and all such improvements
have been inspected by the City Engineer and found to be in compliance with
the applicable plans and specifications; and
WHEREAS, the Developer is desirous of conveying said irrprovements to
the City and the City is desirous of accepting said improvements from the
Developer.
NJAI, 'IHEREFORE, BE IT RESOLVED by the City Council of the City of
Shorewood as follows:
That the City hereby accepts from the Developer the following
improvements in the plat of McKinley Place at Near lYbuntain Third Addi tion:
Sanitary Sewer
Watermain
Stonn Sewer.
