AGAINST MUNICIPAL WATER amECI'ICN OIARGES FOR 1HE
<XNSTRUCl'ICN OF OVERSIZED WATERVIAINS WIlliIN 1HE PIAT OF
BRENIRIDGE
WHEREAS, Shorewood City Code Section 903.03, Subd. 4, provides for
the City to charge a property owner who wishes to connect with the municipal
water system "a connection charge as determined by resolution of the City
Counc i 1"; and
WHEREAS, by its Resolution No. 80-87, adopted June 22, 1987, the
City Council prescribed certain factors for determining such connection
charges; and
WHEREAS, the Developer and owners of the plat of Brentridge are
subject to the water connection charges as set forth in said resolution; and
WHEREAS, the City has requested the Developer of the plat of
Brentridge to construct oversized watermains within the plat so as to provide
additional capacity in order to serve other developments outside the plat of
Brentridge; and
WHEREAS, the Developer has agreed to construct such oversized
watermains with the understanding that it will receive a special credit to be
applied against the normal water connection charges prescribed by Resolution
No. 80-87.
IDV, 1HEREFORE, BE IT RESOLVIID by the City Council of the Ci ty of
Shorewood as follows:
1. That the municipal water connection charges for lots within the
plat of Brentridge shall be computed in the manner prescribed by Resolution
No. 80-87.
2. That a special credit shall be applied against these charges,
which credit shall be an amount equivalent to the difference between the
Developer's cost for construction of 6-inch watermains within the plat of
Brentridge and the Developer's cost for the construction of 12-inch
watermains within the plat, as requested by the City.
3. That such credit may be apportioned and applied to each lot
within the plat or, upon the Developer's request, paid out in total to the
Developer at the time of completion and acceptance by the City of the said
12-inch watermain system within the plat.
