87-161 RESOLUTION NO. 16~-87 . WHEREAS, The City of Shorewood (the city) has entered into a Development Agreement dated August 24, 1987 with William B. Ecoff (the developer) for the develop- ment of The Towne Addition; and WHEREAS, Paragraph 18 of such Agreement provides for a per- formance guaranty in the form of an irrevocable letter of credit approved by the City in an amount equal to 150% of the total cost of the improvements; and WHEREAS, Developer had obtained such a letter of credit from the Ridgedale State Bank in the sum of $108,000.00, which letter is dated August 26, 1987, and entitled Irrevocable Letter of Credit No. 182; and WHEREAS, The City has accepted certain site work completed by the developer. WHEREAS, The developer has requested that the Letter of Credit be reduced to 150% of the total improve- ments yet to be completed. . NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Shorewood, Minnesota, that: 1. The original Letter of Credit required by Paragraph 18 of the Development Agreement may be reduced to the sum of 150% of the total improvements yet to be completed. 2. The City Administrator is hereby instructed to inform the Ridgedale St~te Bank that Irrevocable Letter of Credit No. 182 may be reduced to the sum of $30,000.00 as requested by the developer. Walz and Florence Ellen Walz (Applicants) are the owners of certain real property in the City of Shorewood, County of Hennepin, State of Minnesota, legally described in Exhibit A, attached hereto and made a part hereof; and WHEREAS, Applicants have applied to the City for a subdivision of said real property into two parcels legally described in Exhibit B, attached hereto and made a part hereof; and WHEREAS, Applicants and all other parties holding an interest in the said real property have agreed to grant to the City certain drainage and utility easements legally described in Exhibit C, attached hereto and made a part hereof; and WHEREAS, a public hearing was held by the Shorewood Planning Cammission on 1 December 1987, for which notice was duly published and all adjacent property owners were duly notified. N:lV, 1HEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood as follows: 1. That the real property legally described in Exhibit A be divided into two parcels, legally described in Exhibit B. 2. That the City Clerk furnish Applicants with a certified copy of this resolution for recording purposes. 3. That Applicants record this resolution, together with the drainage and utility easements legally described in Exhibit C with the Hennepin County Recorder or Registrar of Titles within thirty (30) days of the date of the certification.
