" RESOLUl'ICN ID. 103-86 WHEREAS, Robert Bergstrand is the owner of real property in the City of Shorewood, Hennepin County, Minnesota, described as follows: That part of Block 3, Sampsons upper Lake Park lying westerly of the East line of said Block 3 and its northerly extension (said east line being assumed to be a 1 ine drawn north perpendicular to the south line of said Block 3 from a point thereon distant 323.00 feet east, as measured along said south line, from the southwest corner of said Block 3) and easterly of a line described as follows: Commencing at the southeast corner of said Block 3; thence on an assumed bearing of West along the south line of said Block 3 a distance of 47.00 feet to the point of beginning of the line to be described; thence North 3 degrees 4 minutes 30 seconds East to the shore of Lake Minnetonka and said line there ending; and WHEREAS, Bergstrand has an existing single bedroom residence on the property which is located five feet from the easterly property line and within one foot of the westerly property line; and WHEREAS, Bergstrand has made application for a variance and a Conditional Use Pennit to construct a second story and add additional bedrooms to the existing dwell ing unit; and WHEREAS, Shorewood Zoning Ordinance requires a 20 foot side yard setback on each side of the property unless a variance is obtained; and WHEREAS, Shorewood Zoning Ordinance requires a Condi tional Use Penni t for the expansion of any non-confonning structure; and WHEREAS, a public hearing was held and the application reviewed by the Plarming Cmmission on September 8, 1986. . . . ... KlV, 'lliEREFURE, BE IT RESOLVED that the Ci ty Council of the City of Shorewood finds as follows: 1. That due to the configuration of the property, the dwelling unit could not be expanded without the requested variance and QJP. 2. That the small size of the dwelling unit and the necessity to expand upwards in order to provide addi t ional bedrooms makes an increase in the non-confonnity justified. 3. That there is a vacant 21-foot strip of land located on the east side of the property providing additional open space on that side of the dwe 11 ing uni t. 4. That Applicant has established undue hardship as defined by Minnesota Statutes. 4. That based upon the foregoing, the City Council hereby grants the Applicant's request for a variance and CUP as set forth hereinabove. 5. That the City Clerk is hereby authorized and directed to provide a certified copy of this resolution for filing with the Hennepin County Recorder or with the Registrar of Titles.
