86-099BRESOLUTION NO. 9913 -8 6 RESOLUTION AUTHORIZING THE ACQUISITION BY EMINENT DOMAIN OF CERTAIN LAND FOR AN ELEVATED WATER TOWER SITE FOR THE SOUTHEAST AREA TRUNK WATER SUPPLY AND STORAGE FACILITY WHEREAS, it is necessary, advisable, and in the public interest that the City of Shorewood, Hennepin County, Minnesota, obtain a site for an elevated writer tower for the Southeast Area Water project within the City Limits of the City of Shorewood, Minnesota; and WHEREAS, in order to accomplish such purpose, it is necessary to acquire land shown in the attached Exhibit "A ", said Exhibit "A" being made a part hereof by reference; and WHEREAS, the City of Shorewood has been advised and believes that the most feasible location for such elevated water tower is as shown on Exhibit " A " , arid in order to accomplish the same, it is necessary to obtain the land described therein in fee simple absolute. NOW, 'T'HEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood, Minnesota, that the City of Shorewood, Minnesota, proceed to acquire and procure fee title to the land • shown on Exhibit "A ", attached Hereto acid made a part hereof, under its rights of eminent domain and that the City Attorneys, Froberg and Penberthy, P.A., Minnetonka, Minnesota, be and hereby are authorized, instructed, aril directed to file the necessary petition or petitions therefore, to serve the necessary notices therefore, and to prosecute such actions or proceedings to a successful conclusion or until it is abandoned, dismissed or terminated by the City or by the Court; and that the City Attorneys, Mayor, and Clerk of the City do all things necessary to be done in connection with the prosecution and successful conclusion and /or termination of such eminent domain proceedings.
