RESOLUTION AUTHORIZING THE ACQUISITION BY EMINENT DOMAIN OF
CERTAIN WATER DRAINAGE EASEMENTS FOR MAINTAINING
THE EUREKA ROAD DRAINAGE SYSTEM

WHEREAS, it is necessary and advisable in the public interest
that the City of Shorewood, Hennepin County, Minnesota maintain a
water drainage system in the area of Eureka Road within the City
Limits of the City of Shorewood, Minnesota; and
WHEREAS, in order to accomplish such purpose, it is necessary
to acquire land shown in the attached Exhibit "A ", said Exhibit "A"
being made a part hereof by reference; and
WHEREAS, the City of Shorewood has been advised and believes
that the most feasible location for such water drainage system is as
shown on Exhibit "A" and in order to accomplish the same, it is
necessary to obtain temporary and permanent easements as shown on
said attached Exhibit "A ".
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Shorewood, Minnesota that the City of Shorewood proceed to acquire'
and procure title interests, be they temporary or permanent easements
to the land shown on Exhibit "A ", attached hereto and made a part
hereof, under its rights of eminent domain and that the City
attorneys Froberg & Penberthy, P.A., Minnetonka, Minnesota, be and
hereby are authorized, instructed and directed to file the necessary
petition or petitions therefore, to serve the necessary notices
therefore and to prosecute such actions or proceedings to successful
conclusion or until it is abandoned, dismissed or terminated by the
City of by the Court;, and that the City attorneys and Mayor and the
Clerk of the City do 611 things necessary to be done in connection
with the prosecution and 'successful conclusion and or termination of
such eminent domain proceedings.
ADOPTED BY THE CITY COUNCIL of the City of Shorewood, Minnesota this
25th day of August, 1986.

CERTAIN LAND FOR AN ELEVATED WATER TOWER SITE FOR THE
SOUTHEAST AREA TRUNK WATER SUPPLY AND STORAGE FACILITY
WHEREAS, it is necessary, advisable, and in the public
interest that the City of Shorewood, Hennepin County, Minnesota,
obtain a site for an elevated water tower for the Southeast Area
Water project within the City Limits of the City of Shorewood,
Minnesota; and
WHEREAS, in order to accomplish such purpose, it is
necessary to acquire land shown in the attached Exhibit "A ",
said Exhibit "A" being made a part hereof by reference; and
WHEREAS, the City of Shorewood has been advised and
believes that the most feasible location for such elevated water
tower is as shown on Exhibit "A ", and in order to accomplish the
same, it is necessary to obtain the land described therein in
fee simple absolute.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Shorewood, Minnesota, that the City of Shorewood,
Minnesota, proceed to acquire and procure fee title to the land
shown on Exhibit "A ", attached hereto and made a part hereof,
under its rights of eminent domain and that the City Attorneys,
Froberg and Penberthy, P.A., Minnetonka, Minnesota, be and
hereby are authorized, instructed, and directed to file the
necessary petition or petitions therefore, to serve the
necessary notices therefore, and to prosecute such actions or
proceedings to a successful conclusion or until it is abandoned,
dismissed or terminated by the City or by the Court; and that
the City Attorneys, Mayor, and Clerk of the City do all things
necessary to be done in connection with the prosecution and
successful conclusion and /or termination of such eminent domain
proceedings.
