RESOLUTION NO. 76-86
WHEREAS, James Westby has applied for a conditional use
permit and a variance for the construction of an accessory
building on property located at 27020 West 62d Street in the
City of Shorewood, legally described as:
The east 163 feet of Lot 3, Minnewashta Acres
and
WHEREAS, the proposed accessory building results in the
total amount of accessory building area on the property
exceeding 1,000 square feet; and
WHEREAS, Shorewood Ordinance requires a conditional use
permit for any accessory building exceeding 1,000 square feet;
and
WHEREAS, the proposed accessory building will increase
the total area of accessory space on the site to an area
exceeding the square footage of the first floor area
("footprint") of the principal structure located on the
property; and
WHEREAS, Shorewood Ordinance requires a variance for
the construction of any accessory building on property wherein
the total area of the accessory space is greater than the first
floor area of the principal structure of the property; and
WHEREAS, the City Council, on motion of Stover, and
seconded by Gagne, directed the City Attorney to prepare a
resolution granting applicant's request for the conditional use
permit and variance.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Shorewood as follows:
FINDINGS OF FACT
1. That the subject property is zoned R-IA, single
family residential, and contains approximately 2.4 acres.
2. That the footprint of the existing principal
structure on the property is a private two-story residence with
a "footprint" containing approximately 1,050 square feet of
area.

3. That with the proposed accessory building, the
accessory building area on the property will contain
approximately 1,526 square feet.
4. That the request of the applicant meets all of the
requirements of the City Ordinances with the exception of the
limitation on total square footage in area of accessory space
and the restriction requiring accessory building area be limited
in area to the footprint of the existing principal residence.
5. That if the conditional use permit and variance is
not granted, the applicant will suffer undue hardship, that the
property in question consisting of 2.4 acres will not be put to
a reasonable use, and that the plight of the applicant is due to
circumstances unique to the subject property and not created by
himself.
CONCLUSIONS
That based on the foregoing the City Council of the
City of Shorewood concludes:
That the application of James Westby for a conditional
use permit and variance as set out hereinabove be and hereby is
granted, subject to the following conditions:
1. That in the event the owner shall apply for a
subdivision of the subject property, all non-conforming
structures will be removed from the property and all buildings
on the property brought into compliance with the then City
zoning Ordinance.
BE IT FURTHER RESOLVED, that the City Clerk furnish
applicants with a certified copy of this Resolution for filing
with the Hennepin County Recorder or Registrar of Titles.
