RESOLUTION NO. 28-86
WHEREAS, InterStudy, Inc., a Minnesota nonprofit
corporation, and Robert W. Fayfield have applied for a
Conditional Use Permit for the development of certain real
property in the City of Shorewood, Hennepin, County, Minnesota,
described as follows:
(See Exhibit A attached hereto and made a part hereof)
WHEREAS, said property is located in an area zoned as
R-IA and is of insufficient size for development under the
Shorewood Zoning Ordinance; and
WHEREAS, the applicants have agreed to donate this
property to the City for purposes of a public park to provide a
public access to Christmas Lake; and
WHEREAS, the applicants have agreed to provide the City
with a roadway easement and right-of-way for ingress and egress
to said public access site; and
WHEREAS, a public hearing was held by the Planning
Commission on April 1, 1986, for which notice was duly published
and adjacent property owners were notified; and
WHEREAS, the Council has determined that it is in the
public interest that such use be made of the subject property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Shorewood as follows:
1. That a Conditional Use Permit be issued for the
development of the property described hereinabove as a public
park to provide a public access to Christmas Lake.
2. That all buildings presently located on the
property described hereinbelow that do not conform to the
Shorewood Zoning Ordinance for the R-1A district shall be
removed by January 31, 1987.
