84-054 . . . RESOLUTION NO. 54-84 BE IT RESOLVED, that the Council of the City of Shorewood, Hennepin County, State of Minnesota, has approved the request of Tina and E. Clifford Brandhorst of 27225 Smithtown Road to dividec their property identified for tax purposes as PID# 31-117-23-44-0001 into 3 parcels newly described as Tracts A, B, and C, Registered Land Survey No. FURTHER BE IT RESOLVED, that Tina and E. Clifford Brandhorst have agreed and must comply with the attached signed Development Contract. FURTHER BE IT RESOLVED, that any and all Park Fund fees and any additional assessments that may be required because of this division be accepted and paid. FURTHER BE IT RESOLVED, that Tina and E. Clifford Brandhorst are to grant an easement along all lot lines for utilities and drainage. DEVELOPMENT CONTRACT This agreement made and entered into this-?7~~day of August, 1984, by and between the City of Shorewood, Minnesota, a municipal corporation, hereinafter referred to as "City", and E. Clifford Brandhorst and Tena Brandhorst, husband and wife, as joint tenants, hereinafter referred to as "Brandhorst". WHEREAS, Brandhorst is the owner of certain property described as: See Exhibit A attached. WHEREAS, the City has agreed to the metes and bounds subdivision of said property into three lots, based upon certain assurances made by Brandhorst. NOW THEREFORE, in consideration of the foregoing premises and acceptance by the City of said metes and bounds subdivision, the City and Brandhorst agree as follows: 1. That the City agrees to the division of the property described in the attached Exhibit A into three lots as described in Exhibit B attached hereto. 2. That Brandhorst has submitted to the City, and attached hereto as Exhibit C, a resubdivision sketch of said subdivided property to be used to guide the City for any future subdivision of the property. It is however understood by the parties that the resubdivision sketch is not a preliminary plat, and is considered by the parties as a future guideline only. 3. That the Brandhorsts agree for themselves, their heirs, successors and assigns, that when parcel #3, described in Exhibit B, is subdivided, that the entire parcel will be subdivided by platting in accordance with requirements of any existing subdivision ordinances at the time of subdivision.
