83-063 e e e RESOLUTION NO. 6c2-R3 WHEREAS, Tex-sota Construction has applied for a Conditional Use Permit for the construction of mini-storage facilities on property described as: Lot 26, and that part of Lot 23, Auditor's Subdivision No. 141, Hennepin County, Minnesota lying West of the East line of said Lot 26 extended northerly~ except the South 910.00 feet of said Lot 26. WHEREAS, the property is zoned C-1, which provides for conditional use permits for self-storage facilities~ and WHEREAS, applicant has requested a variance to the fifty-foot setback adjoining residential district~ and WHEREAS, the City Planning Commission and the City Planner have recommended approval of the Conditional Use Permit and Variance~ and WHEREAS, the City Council, on the motion of Haugen, and seconded by Stover, moved to direct the City Attorney to draw a resolution setting forthfindings and conclusions and granting applicant's request for the Conditional Use Permit and Variance. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood that finds the following facts: 1. That the subject property is zoned C-1. 2. That the request of the applicant meets all requirements of the City ordinances, with the exception of the setback on the east and south boundaries o~ the property. 3. That the proposal as made by the applicant has a forty-foot setback on the east property line and a thirty-five foot setback on the south property line and that applicant could meet the setbacks by moving the project closer to the north and west property lines. However, moving the project in that direction would destroy a significant number of mature trees and screening for the project. CONCLUSIONS That based on the foregoing the City .Council of the City of Shorewood concludes: . e . That the application of Tex-Sota for a Conditional Use Permit and Variance as set out hereinabove be and hereby is granted, subject to the following conditions: 1. That the property is screened and landscaped in accordance with the landscape plan approved by the City Council and attached as an exhibit. 2. That the entire facility is enclosed by means of a peripheral building except that along the east side of the property a seven-foot chain-link fence will be constructed. 3. That access to the facility shall be by security gate. 4. That the hours of operation shall be limited to 7 a.m. to 10 p.m., Sunday through Thursday~ 7 a.m. to 12 midnight, Friday and Saturday. 5. That any lighting on the premises shall be hooded and so directed so that it is not visible from the public right-of-way and any abutting residential district. 6. That the structure shall conform to the height restriction of the C-1 district and additionally, all structures within fifty feet of any property line shall be limited to one story or fifteen feet, whichever is less. 7. That all storage shall be confined to enclosed permanent structures. 8. storage only. allowed. That the use of the structure shall be limited to No retail service business or workshop shall be 9. That the facility shall have one residential dwelling unit to be used by a resident caretaker or manager. 10. That the entire area, other than occupied by buildings and plantings, shall be surfaced with material which will control dust and drainage and is subject to the approval of the City Engineer. 11. That the facility shall provide off-street parking spaces for no less than six cars. No on-street parking shall be allowed by the facility. 12. The loading area shall be located entirely within the site which will be designed so as not to require backing in from a public street. -2- . ~ 13. That prior to the issuance of a building permit, applicant shall provide a letter of credit or bond for the installation and guarantee for at least two growing seasons, landscaping required herein. 14. That final drainage plans must be approved by the City Engineer prior to issuance of a building permit. 15. That the property shall be legally combined into one parcel prior to issuance of a building permit. 16. That the construction area of the property shall be staked and clearly marked prior to construction in order to facilitate the preservation of the agreed-upon trees and landscaping. Clerk - -- f e ce . \e REGULAR COUNCIL MEETING MONDAY, AUGUST 22, 1983 page three ENGINEER'S REPORT: Waterline Extension RESOLUTION NO. 63-83 Engineer Norton submitted a bid list for the water extension to 23625 Smithtown. This project will qualify to be paid for principally by CDBG Fund with a transfer of $5,000. from Yr. VII Housing Rehab Fund. Gagne moved, seconded by Haugen, to approve the transfer of funds and to approve the bid of $11,090. from Metro Contracting. Motion carried unanimously by Roll Call vote. 5 ayes. Drainage Problem - Ivy Lane and Rustic Way Engineer Norton discussed drainage problems in the area of Ivy Lane and Rustic Way. He presented ways and costs of correcting these problems. He indicated the cost of these corrections, according to the Comprehensive Storm Water Report, could be $118,500. Council discussed need and how the revenue to pay for this project may be obtained. Haugen motioned to table until added information can be obtained. Motion carried unanimously. ADMINISTRATIVE REPORT: RESOLUTION NO. 64-83 Water Request - 21780 Lilac Lane A signed water agreement was received from Edward Hartman of 21780 Lilac Lane requesting the Council to allow him to connect to the Chanhassen water system in their area. Shorewood has no water system currently available in that area. Shaw moved, seconded by Stover, to approve by Resolution the water connection for 21780 Lilac Lane to the Chanhassen system. Motion carried unanimously by roll call vote. Meeting Dates Joint Finance Meeting to be set for September 20, 1983, at 7:30 PM. October Council Meeting will be set for October 4, 1983, at 7:30 PM because of the October 10, 1983 Holiday. Rascop moved, seconded by Haugen, to accept October 4, 1983, as the first Council meeting of the month.
