RESOLUTION NO.

WHEREAS, the City for a number of years had certain
policies that are used in determining certain zoning subdivision and
municipal utility decisions, and
WHEREAS, the City Council has reviewed the existing
policies.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Shorewood as follows:
1. That the following are statements of policy to be used
by the City Council in making determinations and decisions on request
in regard to the matters to which the policies refer.
A. Land Locked Lots.
Subdivision of properties which create a lot not abutting
upon a public road and access for which lot is proposed by means of an
easement will not be permitted.
B. Private Roads.
A subdivision of three or fewer properties may be served by
a private road with a right-of-way of at least 50 feet and a surface
of at least 20 feet, provided the City is given an easement for access
for utilities and for emergency vehicles; the maintenance and care of
such private road to be the obligation of a person or party other than
the City.
C. Public Roads.
Roads that serve four or more lots or parcels shall be
public roads and shall conform with the ordinances of the City for
construction and design of such roads.
D. Storm Water Drainage.
No subdivision shall be approved, regardless of the size of
the subdivision, until drainage problems which may result from such
subdivision have been solved. It shall be the obligation of the land
subdivider to propose and implement a method of solving such drainage
problem.

E. Existing Drainage Problems.
The employees or agents of the City shall not enter upon
private property for the purpose of assisting in solving existing
drainage problems until and unless the owners of the private property
give to the City an easement for storm drain over their property and
relieve the City from an responsibility by virtue of construction,
maintenance or repair of such storm drain.
F. Water Installation.
When feasible, the City Council will consider extending
trunk and lateral municipal water lines in areas where it is
determined that the water revenues generated will exceed additional
fixed and variable water costs associated with the improvement.
G. Connections to Adjacent Cities.
Any property wishing to connect to a water system of an
adjacent city must sign a statement that commits the property to
connect to Shorewood's water system, when available, and pay necessary
charges and assessments.
BE IT RESOLVED FURTHER, that any previously existing
policies inconsistent herewith are hereby revoked and repealed.

8:00 PUBLIC HEARING - VARIANCE REQUEST ON A NON-CONFORMING STRUCTURE
Mr. Donald Koch-25835 Wildrose Lane
RESOLUTION NO. 53-83
Mr. Koch's garage will be too close to the East property line. His
outside wall on his garage needs repair, he would like to enlarge
his garage while making repairs. Public portion closed at 8:10 PM.
Tad Shaw, liaison to the Planning Commission, reported that originally
Mr. Koch's neighbor built on Mr. Koch's property. Mr. Koch sold his
neighbor l3 feet on the East line so he would not have to tear down
his house; if it wasn't for this transaction, his property would
have conformed.
Shaw moved, seconded by Stover, to draw a Resolution granting the
variance to expand a non-conforming structure. Roll Call vote -
unanimous.
REQUEST FOR A.VARIANCE - TO EXPAND A NON-CONFORMING STRUCTURE:

RESOLUTION NO. 54-83
Administrator Uhrhammer read the Planner's Report: Planner Nielsen
suggested that if Council allows construction of the house where
requested, if the City tries to bring Radisson Inn Road up to any sort
of standard, the house would be in the way.
Mr. Arsts presented a letter of approval from 3 immediate neighbors.
Mr. Arsts felt that as long as other homes were that close, he should
be allowed to do so. Council pointed out that there were no.easements
on the South side of Radisson Inn Road so any road expansion would
have to take place in a Northerly direction.
Rascop moved, seconded by Shaw, to approve the variance on a non-
conforming structure if the structure is at least 35 feet from the
front property line if the architect can redesign with this setback,
if he cannot, Mr. Arsts can return to Council and the fee will be
waived. 5 ayes - unanimous.
WATER DRAINAGE PROBLEMS:
l. Mr. Dan Austin-4860 Rustic Way
2. Mr. Gary Dachis-20940Ivy Lane
Attorney Larson made a presentation mentioning the above two water
problems.
He said Mr. Austin-Rustic Way- feels that water is running off the
road and across his property, damaging it. Mr. Austin feels we should
do something to correct the problem and is ready to push the issue at
this time.

CALL TO ORDER:
The regular meeting of the Shorewood City Council was called to order
by Mayor Rascop at 7:30 PM, Monday, August 8, 1983, in the Council
Chambers.
PLEDGE OF ALLEGIANCE AND PRAYER:
The meeting opened with the Pledge of Allegiance and a prayer.
ROLL CALL:
Present: Mayor Rascop, Councilmembers Haugen, Shaw, Stover and
Gagne.
Staff: Attorney Larson, Engineer Mittelsteadt, and Clerk
Kennelly
APPROVAL OF MINUTES:
Gagne moved, seconded by Haugen, to approve the minutes of July 25,
1983, as corrected in the official minute book. Motion carried
unanimously.
CITIZEN'S FORUM:
Mr. and Mrs Roger Lindholm of 22020 Vine Street were present to
question why they would have to go through a variance request to add
to their existing home. Haugen reviewed the Ordinance in reference
to changes to nonconforming structure and confirmed the Building
Inspector's reason for requiring the variance procedure.
GYPSY MOTH PRESENTATION:
Meg Hanish from the Department of Agriculture addressed the Council
with a slide presentation and an explanation of what can happen if
the Gypsy Moth infects an area. Council thanked her for her time.
8:00 PUBLIC HEARING: Variance Request

RESOLUTION NO. 55-83
Mr. Verdorn was present to request the right to add a deck and garage
to an existing nonconforming structure. This addition would not add
to the nonconformity. Public portion of the hearing was closed at
8:10 PM.
Haugen moved, seconded by Gagne, to approve by Resolution the variance
as requested. Motion carried unanimously by roll call.
