RESOLUTION NO. 72-80
WHEREAS, the owner of that property included within and
platted as "Boulder Bridge Farmll has previously petitioned
the City for the improvement of said property by the con-
struction of a deep well, pump house and appurtenances and
consented to assessment of the benefited property for all of
the cost of the improvement, pursuant to Minnesota Statutes,
Chapter 429, and
WHEREAS, said owner has now petitioned the City for
additional improvements on said property by the construction
of sanitary sewer and water laterals, storm sewer, and street
improvement, and has consented to assessment of the benefited
property for all of the costs of such improvements, and waiver
of any hearings thereon, pursuant to Minnesota Statutes, Chap-
ter 429, and
WHEREAS, in connection with the City's consideration of
the plat of "Boulder Bridge Farm", the owner has previously
filed with the City and the city engineer, for review and
approval, plans and specifications for the construction of
the improvements for which the owner now petitions as a special
improvement project, and
WHEREAS, such plans and specifications have been reviewed
and approved in connection with the approval of said plat,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Shorewood, Minnesota:
1. The plans and specifications, on file and previously
approved by the City, for the construction of sanitary sewer
and water laterals, storm sewer, and street improvements to
serve the property platted as "Boulder Bridge Farm", are hereby
approved for the proposed improvement.
2. The City Clerk/Administrator shall prepare and cause
to be inserted in the official newspaper and in the Construc-
tion Bulletin separate advertisements for bids for the making
of each of the following portions of the improvement under
such approved plans and specifications as separate parts
thereof:

Storm sewer
Street improvement
Each advertisement shall be published for three weeks, shall

specify the work to be done, shall state that bids will be
received by the Clerk/Administrator until 10:30 a.m.
on December 29 , 1980, at which time they will be publicly
opened in the council cham~ers of the city hall by the Clerk/
Administrator and engineer, will then be tabulated and con-
sidered by the council at 7:30 p.m. on December 29
19 80 in the council chambers and that no bids will be con-
sidered unless sealed and filed with the Clerk/Administrator
and accompanied by cash deposit, cashier's check, bid bond or
certified check payable to the city for 5% of the amount of
such bid.
3. The City's fiscal agent, Juran and Moody, is hereby
requested, preparatory to requesting any bids for the issuance
of bonds to finance the cost of the foregoing improvements, to
aid, assist and advise the Council concerning the advisability
of issuing temporary improvement bonds therefor, to finance
said improvements, and the deep well, pump and appurtenances
thereto previously petitioned for by the owner.
4. The city attorney is directed to modify the Develop-
ment Agreement between the City and the owner to reflect the
fact that the improvements to be installed will now be public
in nature. The Mayor and Clerk/Administrator shall be author-
ized to execute such modified agreement.
5. Upon the acceptance of bids for issuance of bonds to
finance the aforesaid improvements, the Mayor and Clerk shall
be authorized to execute the final plat of "Boulder Bridge
Farm. "
