82-092-093op C RESOLUTION NO. 93 -82 WHEREAS, the final plat of Marilynwood has been submitted in the manner required for platting of the land under Shorewood City ordinances and under Chapter 462 of Minnesota Statutes and all proceedings have been duly had thereunder; and WHEREAS, said plat is consistent with the City Plan and the regulations and requirements of the laws of the State of Minnesota and ordinances of the City of Shorewood. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Shorewood: 1. That the plat of Marilynwood is hereby approved. 2. That the approval is specifically conditioned upon the terms and conditions as contained in the Developer's Agreement attached hereto as Exhibit "A ". 3. That the Mayor and City Clerk are hereby authorized to execute Certificate of Approval on behalf of the City Council. 4. That this final plat shall be filed and recorded within sixty (60) days of the date of signing of the plat by the Mayor and City Clerk. BE IT FURTHER RESOLVED, that such execution of the Certificate upon said plat by the Mayor and City Clerk shall be conclusive showing a proper compliance therewith by the subdivider, City officials and shall entitle such plat to be placed of record forthwith without further formality all in compliance with Minnesota Statutues and ordinances of the City. This sign would be temporary for the purpose of advertising the sale of their lots. Gagne moved, seconded by Rascop, to approve this location for a temporary sign. Motion carried - 4 ayes - 1 abstain (Shaw) MARILYNWOOD - DEVELOPMENTAL CONTRACT REVIEW Tabled for further�Council review. MARI LYNWOOD FINAL PLAT REVIEW ' RESOL#TI N M , Council reviewed the Marilynwood Plat. Rascop moved, seconded by Leonardo, to approve the Marilynwood Plat. Council felt more conditions should be placed on the approval of the plat. Rascop moved, seconded by Leonardo, to withdraw his motion. Rascop further moved, seconded by Leonardo, to approve the plat subject to the approval of the developmental contract and the title search. Motion carried - unanimously by roll call vote. REVIEW OF MINNETONKA STATE BANK PLANS Bob McDougall, representing Minnetonka State Bank, presented the building plans for the new bank facility. Council reviewed a list of comments submitted by City Building Inspector. These comments were addressed by Mr. McDougall. Public comment from Mr. Reutiman referring to necessary easements, use of frontage road and the lack of adequate lot size for proposed building were heard.
