1960 MiscRESOLUTION
WHEREAS on July 25, 1956 the Village Council of the Village of
Shorewood enacted Ordinance #11 setting forth certain minimum area and
dimensions for the development of properties for residential use as fully
set forth therein, and
WHEREAS G. Albert Klaffky and Kate P. Klaffky are owners in ,point
tenancy of a part of Lot fifteen (15) and all of Lot sixteen (16), and
WHEREAS One of the above, Kate P. Klaffky, is the owner of all of
Lot seventeen (17), , Sirch Bluff, Upper Minnetonka, Hennepin County,
Minnesota,.and
WHEREAS the owners of said property are desirous of selling all
of their interests in Lots fifteen (15), sixteen (16) and a part of
Lot seventeen (17), and
WHEREAS there has heretofore been granted to the said owners a permit
to erect a residence on portions of Lots fifteen (15) and sixteen (16) and
a residence has been erected thereon pursuant to said permit therefor, and
WHEREAS there is no present nor contemplated intent on the part of
the owner of the remainder of Lot seventeen (17), Birch Bluff, Upper Minne-
tonka, Minnesota to sell or otherwise dispose of the same as an individual
parcel, and
WHEREAS any subject sale could be made only in compliance with the
ordinance as hereinbefore set forth, and
WHEREAS the sale of the property hereinafter specifically described
as one single tract is deemed to be in the best interest of said Village,
NOW THEIMFORE, be it resolved that the Village Council of the Village
of Shorewood does hereby waive the requirements set forth in said ordinance
passed July 25, 1956 insofar as they affect the sale by the said G. Albert
Klaffky and Kate P. Klaffky, his wife, and the division made thereby of
Lot seventeen (17) of the following described real property, to -wit:

Lot 15 except that part thereof described as follows:
Beginning at the Southeast corner of Lot 15; thence
along the Southerly line of said Lot 15 to a point,
which point is distant 22 feet at right angles Westerly
from the Easterly line of Lot 15 extended; thence
Northerly along a line parallel to the Easterly line
of said Lot 15 to its intersection with the shore line
of Lake Minnetonka, which intersection is at right
angles, a distance of 22 feet from the Easterly line of
said Lot 15; thence Easterly along said share line to
its intersection with the Easterly line of said Lot 15;
thence Southerly 'along the Easterly line of,said Lot,15
to a point of beginning; all of Lot 16 and that part
of Lot 17 described as follows: Beginning at the South-
east corner of said Lot 17; thence along the Southerly
line of said Lot 17 to a point which point is distant
32 feet at right angles westerly from the Easterly line
of Lot.17 extended; thence Northerly along a line parallel
to the Easterly line of said Lot 17 to its intersection
with the shore line of Lake Minnetonka which intersection
is, at right angles, a distance of 32 fleet from the
Easterly line of said Lot 17; thence Easterly along said
shore line to its intersection with the Easterly line of
said Lot 17; thence Southerly along the Easterly line of
said Lot 17 to the point of beginning, Birch Bluff, Upper
Minnetonka, Hennepin County, Minnesota.
I do hereby certify that I am the duly elected, qualified and acting
Village Clerk in and for the Village of Shorewood, Hennepin County, Minnesoi
and that the foregoing is a true and correct transcript of a portion of the
minutes of a regular sleeting of the Village Council held on August 8, 1960;
further that a motion for said Resolution was adopted unanimously with the
Mayor and each and every councilman present at said meeting and voting
affirmatively therefor.
