CITY OF RESOLUTION SHOREWOOD NO. 94-78 A RESOLUTION RELATING TO A FINDING OF FOR THE ACQUISITION OF EASEMENT FOR STORAGE PUBLIC PUBLIC PURPOSE WATER WHEREAS, the City did authorize the construction of certain stormwater improvements, including those to Outlot A, Block 2 Waterford Addition; and WHEREAS, property owners Ronald R. and Dee L. Johnson argued to the District Court that in conjunction with creating the stormwater pond the City constructed a control structure to maintain a minimum level of water resulting in inundation two to three times per year to the 914' elevation; and . WHEREAS, Hennepin County District Court Judge Ann D. Montgomery did, on August 17, 1993, enter a judgment finding that there has been a physical taking of the Johnson's property to an elevation of 914' since December 31, 1984; and WHEREAS, Judge Montgomery further found that although 'the pond control structure is "removable" it was constructed as a permanent fixture and constitutes an irreversible taking which requires compensation; and WHEREAS, Judge Montgomery further ordered that the Johnsons have successfully brought an action compelling the initiation of inverse condemnation proceedings and are, therefore, entitled to an award of compensation pursuant to Minnesota Statutes 117 et sex; and WHEREAS, pursuant to the findings and order of District Court, the City Council of the City of Shorewood does determine ~ that the acquisition of the easement is in the public interest. . RESOLUTION NO. 94-78 Page 2 of 2 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood that the City acquire the right and interest in the property in attached Exhibit A, as, and to the extent necessary, pursuant to Minnesota Statutes Section 117 et. seq., for the public purpose to secure an easement for the storage of water.
