RESOLUTION NO. 7 -93

A RESOLUTION GRANTING A CONDITIONAL USE PERMIT
FOR THE MINNEWASHTA CHURCH
WHEREAS, the Minnewashta Church (Applicant) is the owner of real property
located at 26710 West 62nd Street in the City of Shorewood, County of Hennepin, State of
Minnesota, legally described on Exhibit A, attached; and
WHEREAS, the Applicant proposes to demolish its existing building and replace it
with a new building; and
WHEREAS, the Applicant has applied for a conditional use permit to build a new
building and to deposit fill on the site to create a surcharge to compact the soil in the
building pad; -and
WHEREAS, the Applicant's request was reviewed by the City Planner, and his
recommendations were duly set forth in memoranda to the Planning Commission dated
12 November 1992 and 30 November 1992, which memoranda are on file at City Hall; and

WHEREAS, after required notice, a public hearing was held and the application was
reviewed by the Planning Commission at their regular meetings on 17 November 1992 and
1 December 1992, the minutes of which meetings are on file at City Hall; and
WHEREAS, the Applicant's request for a conditional use permit was considered by
the City Council at their regular meeting on 14 December 1992, at which time the Planner's
memoranda and the minutes of the Planning Commission were reviewed and comments were
heard by the Council from the City staff.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood as
follows:
FINDINGS OF FACT
1. That the Subject Property is located in an R-ID Single-Family Residential
zoning district.
2. That the subject property contains 99,745 square feet of area.
3. That the existing church building contains 4338 square feet of area and is
located only 18 feet from the front property line.
4. That the new church building will contain 9191 square feet of area and
. complies with the setback requirements of the R -ID zoning district.

5. That the surcharge method of soil correction will consist of ~tockpiling dirt, 10
feet high, in an area measuring 100' x 170' where the new church will be built. The pile
will remain on the site for eight to twelve months.
6. That the drainage plan proposed by the Applicant mitigates existing drainage
problems in the vicinity of the church property.
CONCLUSIONS
1. That the Applicant's plans satisfy the conditions imposed by Section 1201.11
Subd. 4.b. of the City Code.
2. That based on the foregoing, the City Council hereby grants the Applicant's
request for a conditional use permit subject to the following:
a. That the site shall be landscaped according to the approved landscape plan
shown on Exhibit B, attached.
b. Prior to issuance of a building permit, the Applicant must provide a cost
estimate for the required landscaping improvements, and provide a 150 percent
letter of credit for two full growing seasons. Also, before any site work
begins, construction limits and erosion control barriers shall be erected to
preserve existing trees.
c.
All required improvements must be completed prior to occupancy of the new
building.
d.
The Applicant's grading, drainage and erosion control plan must be approved
by the Minnehaha Creek Watershed District and the Hennepin County
Regional Railroad Authority.
e. .
Material excavated from the proposed pond shall be used in the surcharge
process.
f.
The Applicant shall direct his grading contrator to limit hauling to Church
Road from State Highway 7.
g.
Hours of hauling shall be limited to between the hours of 8:00 A.M. to 4:00
P.M. Mondays through Saturdays.
h.
The duration of hauling shall be limited to three weeks.

The Applicant is responsible for cleaning the street during construction.

The Applicant must provide a 150 percent letter of credit to guarantee that the
surcharge material is removed and the site restored (or construction started)
within one year. During the surcharge process, the dirt stockpile shall be
seeded to control dust and erosion.
k. All signage shall comply with Section 1201.03 Subd. 11 of the City Code.
3. That the City Clerk is hereby authorized and directed to provide a certified
copy of this Resolution for filing with the Hennepin County Recorder or Registrar of Titles.
