" RESOLUTION NO. ..3..3.=..89 A RESOLUTION GRANTING A SETBACK TO ERNEST PA VLISICH WHEREAS, Ernest Pavlishich (Applicant) is the owner of real property located at 27470 Pine Bend, in the City of Shorewood, County of Hennepin, State of Minnesota, legally described as follows: "Lot 6, Block 2, Tonka View Addition; and WHEREAS, the property is substandard in the R-1A zoning district, with respect to lot width; and WHEREAS, the applicant has applied for a nineteen-foot setback variance on the north side of the property to build a garage and room addition on the east end of the existing house; and WHEREAS, the Applicant's request was reviewed by the City Planner, and his recommendations were duly set forth in a memorandum to the Planning Commission, dated 2 September 1993, which memorandum is on file at City Hall; and WHEREAS, after required notice, a public hearing was held and the application was reviewed by the Planning Commission at their regular meeting on 7 September 1993, the minutes of which meeting are on file at City Hall; and WHEREAS, the Applicant's request for a variance was considered by the City Council at their regular meeting on 27 September 1993 and comments were heard by the Council from the City staff. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood as follows: FINDINGS OF FACT 1. That the Subject Property is located in an R -1A single-family residential zoning district and is also subject to the requirements of the "S" Shoreland District. 2. That the R-1A zoning district requires a minimum lot width of 120 feet and the subject property is only 90 feet wide. 3. That the R-1A zoning district requires a 50-foot side yard setback abutting a street and the existing house is only 31 feet from Pine Bend. 4. That the proposed addition maintains the existing building line of the house and lines c up with the house on the property to the east. .. . 5. That building further south on the lot would have a detrimental effect on the existing . home on the property to the south. 6. That the proposed structure is a reasonable use of the subject property and does not have an adverse affect on neighboring properties. 7. That the Applicant does not own property adjoining the subject property. CONCLUSIONS 1. That the Applicant has satisfied the criteria for the grant of a variance under Section 1201.05 of the Shorewood City Code and has established an undue hardship as defined by Minnesota Statues Section 462.375, Subd. 6(2). 2 That based upon the foregoing, the City Council hereby grants Applicant's request for a variance as set forth above. 3. That the City Clerk is hereby authorized and directed to provide a certified copy of this Resolution for filing with the Hennepin County Recorder or Registrar of Titles. .
