Agenda Item #3C: The Excelsior Firefighters Relief Association (EFRA) has submitted
applications for its 22nd annual fundraising event at the West Fire Station located at
24100 Smithtown Road on July 21,2006. The event will take place between the hours of
5:00 P.M. and Midnight. It is the EFRA's only fundraising event, and has historically
been profitable. The EFRA is requesting:
1. A temporary license to sell 3.2 Percent Malt Liquor; and
2. A Special Event Permit, as required in the CUP for the South Lake
Minnetonka Public Safety Facility-West
Staff recommends approval of the requested permits, contingent upon receipt of the
appropriate Certificate of Liability Insurance documents, which the EFRA is in the process
of securing, and approvals from the SLMPD and EFD.
Agenda Item #3D: As part of the federal Clean Water Act, the City of Shorewood is required
to obtain a National Pollutant Discharge Elimination System (NPDES) permit. The City
first received this permit in 2003, at which time the City completed a Storm Water
Pollution Prevention Program (SWPPP). Newly approved MPCA rules require a new
permit application to be prepared and submitted to MPCA by June 1,2006. As part of
the application process, the City was required to revise its SWPPP to comply with the
new rules. Staff recommends that the City Council approve the new Storm Water
Pollution Prevention Program (SWPPP), and direct staff to submit the application before
June 1,2006 as required by MPCA.
Agenda Item #3E: Staff is recommending approval of the expenditure of funds from the
equipment replacement fund for an amount not to exceed $9,350.00 for a replacement
diesel pump engine and portable pump.

report on Minnetonka Community Education activities.
Agenda Item #7 A: A representative from the Park Commission will report on the May 9 Park
Commission meeting.
Agenda Item #7B: The Park Commission recommended approval of a motion to accept a
donation of four spruce trees for Manor Park by Mr. and Mrs. Babcock.
Agenda Item #10A: Bids were opened on May 5 for the Southeast Area Well / Amesbury Well
IntercOlmection Project. The bid tabulation is included with the staff memorandum. As
previously discussed with Council, this project will be funded with Water Revenue
Bonds. It is anticipated that the bonds will be issued sometime in July. Staff
recommends that the City Council approve the resolution that accepts the bids and
awards the contract to Minger Construction, Inc., in the amount of $669,956.20.

on service availability, use of service, and property value based on the estimated market value of the
property and the structure; and a formula that was manageable with a minimum number of variables. The
Commission also considered emergency call trends (both National and Minnesota), MFD emergency call
trends, and a comparison of emergency response firefighter hours versus number of calls for service. In
addition the Commission considered how to weigh the selected factors of a new formula, how to justify
and substantiate a new formula, and the date for implementing a new formula (the goal was January 1,
2007).

Administrator Dawson stated as Staff was preparing to move forward with the Wedgewood Road,
Mallard Lane, and Teal Circle road reclamation project, Council had expressed a desire for Staff to
conduct a feasibility study for installing watermains as part of the project. He then stated Acting City
Engineer Gurney would review the feasibility report, including the timeline and projected costs, prior to
the Council's regular meeting. He also stated Staff had updated a communication to the property owners

that would more clearly explain the project and the City's water policy. He noted there had been
favorable response to installing City water along the project route, and Staff had prepared three options
for extending City water along the project route. He also noted a valid 67% petition had been submitted
for a segment of the proposed installation.

Administrator Dawson explained it was common to have either a final assessment hearing before the
contract or to have the final assessment at the completion of the proj ect. Although the more conservative
approach would be to have the final assessment before awarding the contract, in order to try and
complete the construction this year it would be beneficial to have the final assessment after the
completion of the project. He stated that with a special assessment project, was beneficial to consider a
larger scope that could be downsized rather than increase a project would require starting
the special assessment process over. He then stated one of the contingency costs

4. DISCUSSION ON THE ROLE OF THE PARK COMMISSION

project was feasible. He then stated the report identified three options that were feasible, and once

Administrator Dawson explained that in a special assessment process the option to reduce the scope of
the project was always available, but if there was a desire to increase the scope of the project the entire
assessment process would have to be re-done. Therefore, Staff recommended selecting Option 1 which
reflected the broader scope of the effort. He then stated the notification to the property owners would be
modified to include all three options in the event Council would decide to implement Option 2 or 3

1) Temporary 3.2 Percent Malt Liquor License This is a temporary license to serve 3.2
percent malt liquor on the day of the dance, July 21, 2006, between the hours of 5 :00
P.M. and Midnight. Prior to the event, the individuals serving alcohol will be attending
an alcohol training session provided by the South Lake Minnetonka Police Department.
Approval of the license is contingent upon receipt of appropriate Certificate of Liquor
Liability Insurance, which the Excelsior Firefighters Relief Association is in the process
of securing. The Excelsior Firefighters Relief Association is requesting the $25 license
fee be waived. A resolution is attached for Council consideration.
2) Special Event Permit. The applicant has submitted a Special Event Permit. The applicant
proposes to provide shuttle service to the site from Minnewashta School, Middle School
West and the East and West lots in Excelsior. On-street parking will not be allowed on
Echo Road, Shorewood Lane and Minnetonka Drive. Parking is not allowed at the Tonka
Village Shopping Center. The Special Event permit has been approved by the Zoning
Administrator, and is currently under review by the SLMPD and EFD. The SLMPD

typically coordinates with the EFRA on additional law enforcement needs. Approval of
the permit is contingent upon receipt of appropriate Certificate of Liability Insurance,

A RESOLUTION APPROVING A TEMPORARY 3.2 PERCENT "ON-SALE"
MALT LIQUOR LICENSE
WHEREAS, the Shorewood City Code, Section 402 provides for the licensing of the sale
of 3.2 percent malt liquor in the City; and
WHEREAS, said Code provides that an applicant shall complete an application, and
shall fulfill certain requirements concerning insurance coverage, and;
WHEREAS, the applicant has satisfactorily completed an application, and has fulfilled
the requirements for the issuance of a temporary license for the "on-sale" of 3.2 percent malt
liquor:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Shorewood as follows:
That a temporary license for the "on-sale" of3.2 percent malt liquor be issued to the
Excelsior Fire Fighters Relief Association, for its fundraising event on July 21,2006 from
5:00 P.M. to Midnight, at 24100 Smithtown Road.
BE IT FURTHER RESOLVED by the City Council of the City of Shorewood that the
temporary 3.2 Percent malt liquor license fee be waived.

Storm Water Pollution Prevention Program (SWPPP)
As part of the federal Clean Water Act, the City of Shorewood is required to obtain a National
Pollutant Discharge Elimination System (NPDES) permit. The City first received this permit in 2003,
at which time the City completed a Storm Water Pollution Prevention Program (SWPPP). Due to a
legal challenge, the Minnesota Pollution Control Agency (MPCA) has been required to make changes
to the 2003 permit.
At its February 28,2006 meeting, the MPCA Citizens' Board approved new rules that will change the
General NPDES Pennit for future years. The newly approved MPCA rules require a new permit
application to be prepared and submitted to MPCA by June 1,2006. As part of the application
process, the City has revised its SWPPP to comply with the new rules. The MPCA will then review
the application, notice each individual plan for public review and comment, and then issue the new
permit. Until this process is completed and a new permit is issued, the current permit will remain in
effect.
Attachment 1 is the permit application for "General Stormwater Permit Number MN R 040000 for
Small Municipal Separate Storm Sewer Systems (MS4s)" as required by the MPCA. It should be
noted that the use of these standard forms is mandatory, which results in a document that is not
necessarily user- friendly.
An annual report for 2005 mustbe submitted to MPCA as a requirement of the old SWPPP. The
deadline for this submittal is June 30, 2006. It is anticipated that this will be presented to Council at
the June 26,2006 meeting, and then submitted to MPCA under separate cover.
Recommendation
Staff is recommending that the City Council approve the new application for the Storm Water
Pollution Prevention Program, and direct staff to submit the application before June 1,2006 as
required by MPCA. n

Engine for Water Pump and Pump Equipment
The City currently owns a 4- inch discharge pump that is trailer mounted. An old car engine that was
manufactured in 1959 powers this unit. Unfortunately, the last time the pump was used, the engine
malfunctioned and threw a piston rod through the side of the engine.
The Capital Improvement Program (CIP) actually scheduled this unit for replacement in 2005. Due to
lack of available stafftime, many of the equipment purchases for 2005 did not occur. Based on current
need, and available staff time, this unit has moved up in the priority ranking.
In the 2005 CIP, $ 24,336.00 was budgeted for this item. Staff did obtain quotes for a trailer mounted
pump, engine and control panel. Quotes received for a 6-inch pump were in the range of$ 31,000.
Staff returned to the original pump and has determined that despite its age, the existing pump is still in
excellent condition. Therefore, staff is proposing that a replacement engine be purchased, and a
smaller 3-inch portable pump for versatility, versus what had originally been scheduled. This will
result in savings of approximately $15,000 to the fund. In addition, ability to utilize two pumps, albeit
smaller, is more versatile.
Staff researched quotes for replacement engines. Based on the quotes received, with consideration of
warranties offered, the preferred quote was received for furnishing a Kubota diesel engine, by Northern
Power Products. Inc., for an amount of $ 7,611.00, with a 3 year warranty.
In addition, staff is requesting authorization for purchase of an additional portable 3-inch pump, (with
much smaller discharge capacity), discharge hoses, and hardware not to exceed $ 1,200. With taxes
and shipping, the total request equals $ 9,305.72.

1. CONVENE PARK COMMISSION MEETING
The Park Commission met at City Hall at 5:45 p.m. to depart for their Park Tour.
A. Roll Call
Present:
Chair Davis, Commissioner Young, and City Engineer Brown, later met
by Commissioners Westerlund, Moonen, Hensley, and Norman.
PARK TOUR
1. CATHCART PARK
Commissioners Moonen and Hensley joined the Commission at Cathcart.
Brown encouraged the Commissioners to discuss what some of the parks could be.
Though Cathcart Park is located in Chanhassen, Brown indicated that it is owned by
Shorewood. He pointed out that two issues in this and other parks include lighting, as the
rink is heavily used in the winter, and tennis courts, which are in need of grave repair. He
mentioned that the preliminary quote for resurfacing Manor Park and Badger tennis
courts was approximately $35,000 for the band-aid approach and that he would price out
reconstruction of those courts.
Brown continued pointing out that routine maintenance, such as filling under the swing
set with sand, would occur when things dried out a bit.
Chair Davis suggested that an additional garbage can be placed at the park.
2. FREEMAN PARK
Once again, Brown encouraged the Commissioners to consider what demographics are
being, or not being, served in the parks. He asked if they felt anything was lacking or
what type of vision they saw for each park.
Starting at the Southern end of the park, Brown pointed out that the Little League had
recently laid ag lime and planned to resurface the batting cages with Astroturf in the
future. He asked the Commission to consider if there was adequate bleacher seating, or
whether additional seating was necessary at Freeman and possibly Cathcart.
As they continued Brown acknowledged the drainage problem between fields 1 and 2,
and the City's numerous attempts to seed. In addition, he mentioned that Little League
has expressed their desire to enlarge their equipment sheds at both fields 1 and 3.
Commissioners Westerlund and Norman joined the tour at Freeman at 6:37 p.m.
The Commission used the trail to maneuver their way to the other end of Freeman taking
note of the buckthorn and proposed Wetland Restoration proj ect as they went. The
Commission discussed restoration of the wetlands in order to make the area an amenity to
the park with appropriate drainage, kiosks, etc. They agreed that the City has a

responsibility to determine the highest and best use ofthe area, especially near the
engineered dam at the north end of the trail.
Westerlund questioned whether the Commission could review old photos of the area to
determine what was there in earlier years and how to go about restoring the ecosystems.
Brown acknowledged that he answers many phone calls about the enormous amount of
buckthorn along the trail.
CRR, Community Rec Resources, representative Anderson accompanied the Commission
at Freeman Park and explained that due to issues created by two sports organizations
vying for the same field use, Lacrosse has been moved to Manor Park for the season. In
an effort to allow Badger rest this year and to work with the sports organizations,
Anderson explained that Soccer would continue to use all the soccer fields at Freeman
while intense monitoring of activity and parking would ensue at Manor. She pointed out
that the obvious solution would be to improve the field conditions at Badge Park in order
to avoid such complications in the future. As increase in demand will only continue :from
year to year, Anderson noted that the City cannot afford to allow a perfectly wonderful
facility such as Badger to go unutilized.
As the Commission moved towards Eddy Station, Brown pointed out that many residents
enjoy the plaza area, though it needs some plantings. He indicated that the challenge is to
find hardy plants that would take little maintenance from public works staff, or find a
group of volunteers to tend the garden.
Young suggested the City approach the seniors and solicit their interest in maintaining
plantings.
Brown suggested that, if the Park Commission could determine a budget to offer the
volunteers for plantings, this might be the incentive needed to create a group of
volunteers.
Westerlund stated that if a budget is what is needed to help get a team of volunteers to
tend the plaza, the Commission should move forward.
3. CRESCENT BEACH
Brown explained that public works staff comes out to Crescent Beach daily during the
spring and summer in order to clear out the ditch. He noted that the beach might be in
need of a new sand blanket.
The meeting continued at City Hall at approximately 7:32 p.m. with Commissioners
Young, Westerlund, Norman, and Chair Davis. Moonen and Hensley arrived at City Hall
at 7:45 p.m.
B. Review Agenda
Item 5A, Manor Park Tree Donation, was moved to the front ofthe agenda and Item 4C, a
report on Manor Park Plantings was added to the agenda.

2. APPROVAL OF MINUTES

the meetings.
Norman moved, Westerlund seconded, approving the Minutes of the April 11, 2006,
Park Commission Meeting as submitted.
B. Joint Park Commission Meeting Minutes of April 18, 2006
Young moved, Norman seconded, approving the Minutes of the April 11, 2006, Joint
Commission Work Session as presented. Motion passed 4/0.
5. MANOR PARK TREE DONATION
A. Neighborhood Feedback
Mr. Babcock thanked the Commission for their efforts in overseeing the parks and
inviting him to talk about his proposal to plant trees along Manor Road. He explained that
he had lived on Manor Road for 35 years and would like to donate trees to plant along the
edge of the park in an effort to replace those lost due to development and for the
betterment of the community.
Mr. Babcock proposed that 4 additional black spruce, 15-20' tall, be planted near the one
he planted last fall. They would not be infringing on the fields but would deter people
from parking on the grass near the north side along Manor Road where it is void of trees.
Chair Davis commented that this would be a very nice donation to the park. Young
concurred, stating that it was a very generous donation.
Mr. Babcock stated that he could wait until fall, as it would be the best planting time, and
in the meantime position stakes for the proposed locations so that the Commission could
review them during their upcoming park tour. He commented that the trees would be
staggered along the lot line and perhaps someday a nice trail could meander through
them.
Commissioners Hensley and Moonen arrived.
Babcock added that his wife was partial to planting some low maintenance perennials
around the bottoms of the trees.
Brown informed the commission that if they were comfortable with the donation, they
could move to recommend the City Council accept it, subject to the tree locations.

Moonon moved, Young seconded, recommending approval for the acceptance of the
tree donation proposed by the Babcock's for Manor Park, subject to approval of
planting sites. Motion passed 6/0.
3. MATTERS FROM THE FLOOR

4. REPORTS
A. Report on City Council Meetings of April 24, 2006 and May 8, 2006
Brown reported that the City Council continues to discuss watermain and roadway
projects, as well as, police and fire issues.
B. Update on Music in the Park
Brown pointed out that the Music in the Park series has a great schedule this year. He
noted that funds have been donated by the Park Foundation, as well as, Howard's Point
Marina for the event.
C. Manor Park Plantings
Brown reported that he had not found time to assemble an RFP for the project, and would
be trying to focus his efforts on doing so soon.
6. DISCUSS PARK TOURS
Brown asked the Commission if it had found any surprises, had any ideas for
improvements or enhancements upon completing this leg of the Park tours.
Chair Davis stated that she was unaware that the lighting was an issue.
Brown stated that Badger parks lighting has been an ongoing issue with numerous
attempts over the years made to fix rehabilitated lights over and over, which often go out
during football games. He explained that the current lights were salvaged lights to begin
with and that he would like to look at the cost of new single pole light systems.
Chair Davis suggested that staff put together a grocery list of needed repairs and field or
park improvements deemed necessary for the Commission to consider, such as lighting,
beach blanket, seeding or field improvements at Badger, picnic area at Cathcart, etc.
Young stated that time after time users come in and provide the City with proposals for
improvements. He asked whether the City should approach the organizations and ask
them to do the footwork by creating a list of improvements and cost estimates.
Brown stated that Steve Gurney, interim City Engineer, was brought on board to free up
Brown's time and shift his attention to buildings and facilities.
Young noted that we, as a Commission, must move forward on these issues rather than
just continue to talk about them. He noted that a needs and cost analysis would be helpful

to provide to the sports organizations to see if they'd like to contribute. Young asked
where Shorewood stands in relation to other communities.
Brown reported that the City needs to educate the public and the sports organizations that
the user fee of $1 0 per play per season has been in effect for years and that if the sports
organizations wish to place blame for their increases in fees they cannot look to the city.
Hensley commented that if the public knew the City merely charges $10 per person, for
field space, they would believe it to be a bargain and ask the sports organizations where
the rest of the registration fee goes.
With regard to the tour, Hensley asked how many pavilions are being used and how much
they are being used. If the sports organizations were peeled away, he questioned what
other activities are being served. He maintained that it would have been his goal to widen
Smithtown Road in order to allow kids to bike to and from Freeman Park safely.
Chair Davis felt that establishing a little budget for the Freeman Park plaza garden was an
excellent idea in order to entice volunteers to maintain the garden.
Hensley stated that he felt there was a tremendous opportunity to move on the wetland
project at Freeman Park.
Brown pointed out that the MCWD would be allocating $60,000 to the project which
could kick-off some aspect of the feasibility study.
Hensley asked to be provided with a copy of the study at an upcoming meeting.
Westerlund stated that she would like to see more proactive community involvement in
the Freeman project and suggested the City host a meeting for users and interested
neighbors to voice their opinions and gauge their support.
Hensley suggested the funds be used to cut down the buckthorn on an annual basis for
several years, at which time the buckthorn finally dies off.
Brown mentioned that a sentenced to serve crew could also provide additional labor. In
addition, Brown suggested that the Commission consider whether its goals are in line
with those of the City Council and lead into this project at the upcoming joint dinner.
Norman suggested that the Commission consider addressing the infrastructure of the
parks and how the existing elements need to be brought up to snuff before broadening the
reach with the wetland project.
Brown pointed out that 10 years ago many park improvements were made, such as Eddy
Station, etc. He noted that the Commission may be moving back into the improvements
stage and suggested the Commission bring this up to the City Council that the parks are in
need of maintenance and improvements.
Chair Davis encouraged the Commissioners to study the Master Plan, schedule a brief
meeting to discuss it during a work session before the joint meeting in June.

Brown stated that he would have copies of the Master Plans sent out to Commissioners to
review, but noted that they must be returned.
The next Park Tour would be held June 13,2006, followed by a work session to get the
Commissions thoughts together prior to the City Council meeting.
Brown stated that he would be collecting quotes on tennis courts and lights and bring
them back to the Commission for a recommendation.
Young reiterated that he did not want to see these critical infrastructure items, tennis
courts, fields, lights, to be lost in the shuffle.
Westerlund stated that she believed Brown was aware what infrastructure items need to
be done. She asked Brown to put together a list of priorities for the Commission to
present to the City Council at their joint meeting. In addition, she urged the Commission
to define and articulate a vision of where the parks are now and in the future.
Brown commented that he had heard the City Council talk about open space falling under
the responsibility of the LCEC.
Westerlund suggested that the Commission define whether they wished to take on open
space or whether the LCEC should be reconstituted. She asked that the definition of open
space be provided to the Commission based on LCEC and City Council discussions.
Hensley stated that, in his opinion, once an open space has been given a public use, it
should be designated as a park; therefore, the Park Commission should oversee it.
7. REVIEW DONATION POLICY
Brown presented the donation policy for questions or clarification. He pointed out that the
policy addresses perpetuity and substantial gifts, rather than simple issues such as tree
donations that can be handled at the staff level.
8. LIAISON FOR MAY 22 CITY COUNCIL MEETING - Hensley
Chair Davis indicated that she would request that staff send out the minutes from the
Joint Commission Meeting to the Cities of Excelsior, Deephaven, and Tonka Bay to
begin a dialogue for the winter activity.
9. ADJOURN

Accept Donation of Trees - Manor Park
Mr. and Mrs. Babcock, property owners of 20465 Manor Road, have offered a donation of four mature
Blue Spruce trees, with a request that the City allow their contractor to spade the trees in along the
boulevard area of Manor Road. Attachment 1 depicts the location for Manor Park, and the Babcock
property.
The Babcock's have previous history for donating trees to the City of Shorewood. Many years ago,
the City Hall was located at Manor Park site. The Babcock's helped clear trees for the site and has
donated trees to that City Hall site previously.
Mr. Charles Babcock appeared before the Park Commission on May 9th, 2006, to present the proposal.
When asked what the motivation was for such a generous donation of mature trees, Mr. Babcock
indicated his desire is to have a number of beautiful trees within the city parks.
While the exact location ofthe trees is to be formalized at the next park tour that includes Manor Park,
(to be conducted on June 13th, 2006), the Park Commission agreed that the northerly portion of the
boulevard area along Manor Road was appropriate for such plantings. The trees would be located
outside of the overhead power lines within this same route. Attachment 2 indicates the alignment of
the proposed planting area.
It was also noted that the best time for spading in such large trees in is late fall. Coupled with the fact
that it is anticipated that there will be substantial road and utility construction this summer, the Park
Commission agreed that installation should hold off until road construction has been completed.
Recommendation
The Park Commission recommended approval of the motion to accept the donation of four spruce trees
for Manor Park.

A Resolution Accepting Low Bid and Awarding
Contract to Successful Low Bidder
Attachment 1 is the Bid Tabulation for the Southeast Area Well / Amesbury Well
Interconnection Project and Appurtenant Project. Bids were opened and tabulated on
May 5, 2006.
The low bidder is Minger Construction, Inc. in the amount of $669,956.20, compared to
the engineer's estimate of$815,853.00.
As previously discussed with Council, this project will be funded with Water Revenue
Bonds. It is anticipated that the bonds will be issued sometime in July.
Recommendation
Staff is recommending that the City Council approve the attached resolution that accepts
the bids and awards the contract to Minger Construction, Inc. in the amount of
$669,956.20. A resolution is attached for your consideration.

A RESOLUTION ACCEPTING BID AND AWARDING CONTRACT FOR
Southeast Area Well / Amesbury Well Interconnection Project and Appurtenant Project
WHEREAS, pursuant to an adveltisement for bids for local improvements designated as
Southeast Area Well / Amesbury Well Interconnection Project and Appurtenant Project, City Project No.
05-05, bids were received, opened on May 17,2006 and tabulated according to law, and such tabulation is
attached hereto and made a part hereof as Exhibit A; and
WHEREAS, the City Council has determined that Minger Construction, Inc. is the lowest bidder
in compliance with the specifications.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Shore wood as
follows:
1. That the Mayor and City Administrator/Clerk are hereby authorized and directed to enter
into a contract with Minger Construction, Inc., in the name of the City of Shorewood, Project No. 05-05,
according to the plans and specifications therefore approved by the City Council on file in the office of the
City Administrator/Clerk.
2. That the City Administrator/Clerk is hereby authorized and directed to retum forthwith to
all bidders the deposits made with their bids, except for the deposits of the successful bidder and the next
two lowest bidders, which shall be retained until a contract has been signed.
ADOPTED BY THE CITY COUNCIL OF THE CITY OF SHOREWOOD this nnd day of
May, 2006.
