91-102 . .~- .-- RESOLUTION NO.102-91 A RESOLUTION APPROVING THE REVISED CONCEPT PLAN FOR GIDEON'S COVE P.U.D. WHEREAS, Boyer Building Corporation (Applicant) is the owner of real property located in the City of Shorewood, County of Hennepin, legally described as: Lots 1, 2, 3, 4, 5, and 7, Block 1, and Outlots A, B, and C, Lawtonka; and WHEREAS, the Applicant has applied to the City for approval of a Concept Plan for the construction of a residential planned unit development known as Gideon's Cove (Gideon's Cove P.U.D.) containing fourteen (14) multi-family units on approximately 4.5 acres of land; and WHEREAS, the Applicant's request was reviewed by the City Planner, and his recommendations were duly set forth in a memorandum to the Planning Commission dated June 27, 1991, which memorandum is on file at City Hall, and WHEREAS, the Planning Commission at its regular meeting of July 2, 1991, recommended denial of a Concept Plan for the 14- unit Gideon's Cove P.U.D.; and WHEREAS, the Applicant submitted, by letter dated August 7, 1991, a revised plan for the Gideon Cove P.U.D. containing twelve (12) units (the "Revised Concept Plan"); and WHEREAS, the Applicant's request was considered by the City Council at its regular meeting of September 9, 1991, at which time the City Planner's memorandum and the minutes of the Planning Commission, as well as the revised plans were reviewed and comments were heard by the City Council from the Applicant, City staff, and interested citizens. NOW, THEREFORE, be it resolved by the City Council of the City of Shorewood as follows: 1. The Applicant's request for approval of a Revised Concept Plan for Gideon's Cove P.U.D. is subject to the following conditions of approval as set out in the Planning Staff Report dated June 27, 1991: (a) The Developer should pursue the acquisition of Lot 6 and incorporate it into the project. Failing this, the City should proceed with the rezoning of , 11 . .~ e-- Lot 6 at such time final plans for the P.D.D. have been recorded. (b) The Development Stage Plan should include a detailed tree inventory, showing any trees larger than five inches in diameter. The site plan should be adjusted to preserve the better stock, particularly those trees which break up the building massing. (c) The Development Stage Plan should provide a minimum front yard setback of 20 feet. (d) The City should determine if City water will be required for the project. 2. City Council approval of the Revised Concept Plan is subject to all applicable standards, regulations, and requirements of the Shorewood City Code, including, but not limited to the following: (a) Section 1201.04, subd. 1 regarding the procedures for review and approval of conditional use permits; (b) Section 1201.06, subd. 3 regarding special procedures for the establishment of a P.D.D. by conditional use permit; (c) Section 1201.25, subd. 6(b) (1) regarding the purpose of concept plan approval. 3. Approval of the Revised Concept Plan is not intended, nor does it act to grant approval of a Development Stage Plan or a Final Stage Plan which are required pursuant to Section 1201.25, subd. 6(c) and (d). 4. Approval of the Revised Concept Plan is not intended to, nor does it act to approve specific use of Outlot A, Outlot B, or Outlot C, Lawtonka, which legally describes the peninsula extending into Gideon's Bay immediately north of the developable lots of the Gideon's Cove P.D.D. Specifically, approval of the Revised Concept Plan is not intended to approve use of the docks currently located on the peninsula described above. CONCLUSION 1. The application of Boyer Building Corporation for approval of the Revised Concept Plan for the Gideon's Cove P.D.D. as set forth above is hereby approved. 2. .. ""lI '.. . .~ ~ A......,. ~-' 2.
