RESOLUTION NO. 15-91
A RESOLUTION GRANTING AN AMENDMENT TO A
CONDITIONAL USE PERMIT FOR
LEE LaBORE
WHEREAS, Lee LaBore (Applicant) was granted a Conditional Use Permit
for an accessory building in excess of 1,000 square feet of floor area on 26
June 1989; and
WHEREAS, said Conditional Use Permit allowed the Applicant to
construct a new garage that, when added to the area of the existing garage on
the property, totalled 1,167 square feet which exceeded the amount of
accessory space permitted by the City Code; and
WHEREAS, said approval was based upon the existing garage being
allowed to remain as a nonconforming structure but not to be enlarged or
structurally altered; and
WHEREAS, Applicant now finds the roof of the existing garage to be
beyond repair and, in order to match the roof line of his new house, it is
necessary to replace the damaged roof with a steeper pitch roof; and
WHEREAS, the Applicant's request for an Amended Conditional Use
Permit was considered at a public hearing by the Shorewood Planning
Commission held on 22 January 1991, the minutes of which meeting are on file
at City Hall; and
WHEREAS, the Applicant's request was considered by the City Council
at their regular meeting on 28 January 1991, at which time the Planner's
memorandum and the minutes of the Planning Commission were reviewed.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Shorewood as follows:
FINDINGS OF FACT
1. T hat the architectural character of the garage with the steeper
pitch roof is similar and consistent with other buildings on the site and in
the area in conformance with Section 1201.03, Subd. 2.d. (4) (d) of the
Shorewood City Code.

2. That Applicant's request is reasonable and consistent with the
approval given for the original Conditional Use Permit granted on 26 June
1989.
CONCLUSION
T hat the application of the A pplicant for an amendment to his
Conditional Use Permit as set forth hereinabove be and hereby is granted.
