RESOLUTION NO. 134-90
A RESOLUTION GRANTING A CONDITIONAL USE PERMIT
FOR FILLING AND GRADING TO
BARTHEL CONSTRUCTION
WHEREAS, Duane Barthel of Barthel Construction (Applicant) has
requested a permit to fill and grade the property located at 24155 Wood
Drive, in the City of Shorewood, County of Hennepin, State of Minnesota,
legally described as:
Lot 1, Block 1, Oak Pond
and
WHEREAS, Applicant's request proposes that fill be placed on the
subject site in the amount of approximately 380 cubic yards; and
WHEREAS, Section 1201.03, Subd. 8, of the Shorewood City Code
provides that any fill or grading which exceeds 100 cubic yards shall
require a Conditional Use Permit; and
WHEREAS, the application was reviewed by the Shorewood Planning
Commission at a public hearing held on 20 November 1990, and approval was
recommended by the Commission; and
WHEREAS, the Applicant's application was considered by the City
Council at their regular meeting held on 26 November 1990, at which time
the Planner's memorandum was reviewed, minutes of the Planning Commission
were reviewed, comments were heard from the City Council members and
staff, and the City Attorney was directed to prepare a resolution setting
forth findings and conclusions approving the application.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Shorewood as follows:
FINDINGS OF FACT
1. T hat the lot drops off from the cul-de-sac at the end of Wood
Drive, easterly to Riviera Lane.
2. That the Applicant proposes to add up to 380 cubic yards of
fill to the building pad location and southeast corner of the lot to
create a level area for a front yard and future home on the lot.

3. That the City Engineer has reviewed the Certificate of Survey
showing the proposed grading plan and determined that drainage will not be
adversely affected by the fill.
4. That a 12-inch culvert is required where the Applicant
proposes to build the new driveway.
CONCLUSIONS
That the application of the Applicant for a Conditional Use
Permit as set forth hereinabove be and hereby is granted, subject to the
following conditions:
1. That the Applicant provide a 12-inch culvert under the
proposed driveway.
2. That the Applicant plant seed or sod no later than June of
1991.
