RESOLUTION NO. 31-90 A RESOLUTION APPROVING SUBDIVISION OF REAL PROPERTY WH ERE AS, Jay Thompson (A pplicant) is the owner of certain real property in the City of Shorewood, County of Hennepin, State of Minnesota, legally described in Exhibit A, attached hereto and made a part hereof; and WHEREAS, Applicant has applied to the City for a subdivision of said real property into two parcels legally described in Exhibit B, attached hereto and made a part hereof; and WHEREAS, the Applicant and all other parties holding an interest in the said real property have agreed to grant to the City certain drainage and utility easements legally described in Exhibit C, attached hereto and made a part hereof; and WHEREAS, the subdivision requested by the Applicant complies in all respects with the Shorewood Zoning Code. . NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood as follows: 1. T hat the real property legally described in Exhibit A be divided into two parcels, legally described in Exhibit B. 2. Prior to construction of a building on either parcel, Applicant shall submit detailed grading and drainage plans for approval by the City Engineer. 3. That the City Clerk furnish Applicant with a certified copy of this resolution for recording purposes. 4. That Applicant record this resolution, together with the drainage and utility easements legally described in Exhibit C, with the Hennepin County Recorder or Registrar of Titles within thirty (30) days of the date of the certification of this resolution. Thompson, husband and wife, of the County of Hennepin and State of Minnesota, for good and valuable consideration, receipt of which is acknowledged, do hereby grant to the City of Shorewood, its successors and assigns, an easement for utilities and drainage over, under and across the Easterly, Southerly, Westerly and Northerly 10 feet of the following parcel of land: Lot 4 and Lot 19, inclusive, and the West 33.04 feet of Lot 5 and Lot 18, all in Block 2, Mann's Addition to Birch Bluff (Lake Minnetonka), according to the recorded plat thereof, Hennepin County, Minnesota. Within the easements, no structures shall be placed or permitted to remain which may damage or interfere with the installation and maintenance of utilities, or which may change the direction or flow of drainage channels in the easements, or which may obstruct or retard the flow of water through the drainage channels in the easements, except that a bituminous or concrete driveway or walk which does not impede the surface water runoff and drainage may be installed and maintained across the easements subject to disturbance for installation and maintenance of utilities. The easement area and all improvements shall be maintained continuously by the owner of the property, except for those improvements for which a public authority or utility company is responsible.
