A RESOLUTION DENYING A ZONING ORDINANCE AMENDMENT
FOR
HEIGHTS OF ST. ALBAN'S BAY
WHEREAS, Eugene Erickson (Applicant) has an interest in
certain land within the City of Shorewood known as "Heights
of St. Alban's Bay" (Subject Property) and has applied to
the Council for the rezoning of said property from R-IA to
R-IB, and
WHEREAS, Applicant's request has been reviewed by the
City Planner and his recommendations have been duly set
forth in memorandums to the Planning Commission, Mayor and
City Council dated 31 May 1989, 27 July 1989 and
27 September 1989, which memorandums are on file at City
Hall, and
WHEREAS, public hearings were held by the Shorewood
Planning Commission on 15 August 1989 and 3 October 1989,
for which notice was duly published and all adjacent
property owners duly notified, and
WHEREAS, the matter was considered by the City Council
at its regular meeting of 9 October 1989, and after
deliberation and review by the Council, a motion to amend
the zoning ordinance failed to receive the required votes
for approval, and the City Attorney was directed to prepare
Findings of Fact,
NOW THEREFORE BE IT RESOLVED by the City Council of the
City of Shorewood as follows:
FINDINGS OF FACT
1. That the Subject Property is located in an R-IA
zoning district which requires a lot size of 40,000 square
feet.
2. That a rezoning of the Subject Property to R-IB
would reduce the required lot size to 30,000 square feet.

3. That the lot size of the majority of the lots in the
neighborhood of the Subject Property is 40,000 square feet
or more.
4. That the proposed rezoning of the Subject Property
to permit lot sizes of less than 40,000 square feet would
not be compatible with present and future land uses of the
area.
CONCLUSIONS
1. That rezoning the Subject Property to permit smaller
lot sizes than is permitted under the present zoning
ordinance is not in the best interests and general welfare
of the community.
2. That Applicant's request for a rezoning of the
Subject Property from R-IA to R-IB is hereby denied.
