RESOLUTION NO. 85-89
A RESOLUTION DENYING PRELIMINARY PLAT APPROVAL
FOR
HEIGHTS OF ST. ALBAN'S BA Y
WHEREAS, Eugene Erickson (Applicant) has an interest in certain land
within the City of Shorewood and has applied to the Council for preliminary
approval of a plat to be known as Heights of St. Alban's Bay; and
WHEREAS, Applicant's request has been reviewed by the City Planner
and his recommendations have been duly set forth in memorandums to the
Planning Commission, Mayor, and City Council dated 31 May 1989, 27 July 1989,
and 27 September 1989, which memorandums are on file at City Hall; and
WHEREAS, public hearings were held by the Shorewood Planning
Commission on 15 August 1989 and 3 October 1989, for which notice was duly
published and all adjacent property owners duly notified.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Shorewood as follows:
FINDINGS OF FACT
1. That the Subject Property is located in an R-IA zoning district
which requires a lot size of 40,000 square feet.
2. T hat the lots contained in the proposed preliminary plat range
from 30,000 square feet in area to 43,449 square feet and average 33, 188
square feet.
3. That in order to accommodate the proposed preliminary plat, the
Subject Property would have to be rezoned to RI-B.
4. That the City Council has determined that a rezoning of the
Subject Property is not appropriate.
CONCLUSIONS
1. T hat the lots contained in the proposed preliminary plat do not
meet the requirements of the zoning area in which the Subject Property is
located.

2. That the City Council of the City of Shorewood therefore denies
Applicant's application for approval of the proposed preliminary plat.
