RESOLUTION NO. 22-89
A RESOLUTION GRANTING A SET-BACK VARIANCE TO
CLIFFORD ANDERSON
WHEREAS, Clifford Anderson (Applicant) is the owner of real
property located at 5351 Shady Hills Circle in the City of Shorewood,
County of Hennepin, State of Minnesota, legally described as follows:
Lot 9, Block 4, Shady Hills
and
WHEREAS, Applicant proposes to construct a single-family dwelling
on the property which will encroach five feet into the front yard set-back
area and thirteen feet into the rear yard set-back area; and
WHEREAS, the Applicant's request has been reviewed by the City
Planner, and his recommendations have been duly set forth in memorandums
to the Planning Commission dated 2 February 1989 and 16 March 1989, which
memorandums are on file at City Hall; and
WHEREAS, after required notice, a public hearing was held and the
application reviewed by the Planning Commission at their regular meetings
on 7 February 1989 and 21 March 1989, the minutes of which meeting are on
file at City Hall; and
WHEREAS, the Applicant's representative appeared before the City
Council at their regular meetings on 13 February 1989 and 27 March 1989,
at which time the Planner's memorandums were reviewed and comments were
heard by the Council from the Applicant and from the City staff.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Shorewood as follows:
FINDINGS OF FACT
1. That the Subject Property is located in an R-1C single-family
residential zoning district.
2. T hat under the present City Zoning C ode the building site
proposed by the Applicant requires a five foot front yard set-back
variance and a thirteen foot rear yard set-back variance~

3. That due to the configuration and topography of the lot, the
building site proposed by the Applicant would appear to be the most
appropriate and the most reasonable use of the property.
4. That the Applicant has established undue hardship and has
satisfied the criteria for the grant of variances under the appropriate
sections of Minnesota Statutes and the Shorewood City Code.
CONCLUSIONS
1. That based upon the foregoing, the City Council hereby grants
the Applicant's request for a five foot front yard set-back variance and a
thirteen foot rear yard set-back variance.
2. That a certified copy of this Resolution be filed with the
Hennepin County Recorder or Registrar of Titles.
