RESOLUTION NO. 4-89
A RESOLUTION ACCEPTING SANITARY SEWER, WATERMAIN, AND
STORM SEWER IMPROVEMENTS IN THE PLAT OF
McKINLEY PLACE AT NEAR MOUNTAIN FOURTH ADDITION
WHEREAS, on June 10, 1988, the City entered into an Agreement
with Lundgren Bros. Construction, Inc., for the development of the plat
known as McKinley Place at Near Mountain Fourth Addition; and
WHEREAS, said Agreement included by reference all the terms and
conditions of a certain Development Agreement previously entered into
between the parties on July 28, 1986, for the development known as Near
Mountain; and
WHEREAS, Paragraph 3 of said Near Mountain Development Agreement
provided for the Developer to construct and install certain enumerated
improvements, which improvements included sanitary sewer, watermain and
storm sewer; and
WHEREAS, Paragraph 13 of said development agreement provided for
such improvements to be subject to a final inspection by the City
Engineer; and
WHEREAS, Paragraph 24 of said development agreement provided for
the conveyance of said improvements to the City by the Developer and for
the acceptance by the City of such improvements; and
WHEREAS, The Developer has completed construction and
installation of the sanitary sewer, watermain, and storm sewer
improvements in the plat of McKinley Place at Near Mountain Fourth
Addition, and all such improvements have been inspected by the City
Engineer and found to be in compliance with the applicable plans and
specifications; and
WHEREAS, the Developer is desirous of conveying said improvements
to the City and the City is desirous of accepting said improvements from
the Developer.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Shorewood as follows:
That the City hereby accepts from the Developer the following
improvements in the plat of McKinley Place at Near Mountain Fourth
Addition:
Sani tary Sewer
Watermain
Storm Sewer
