RESOLUTION NO. 143-88
A RESOLUTION GRANTING A CONDITIONAL USE PERMIT
TO MARCUS REAL ESTATE DEVELOPMENT CORPORATION
WHEREAS, Marcus Real Estate Development Corporation, representing
Y.E.S. Properties Partnership (applicant) is developing property located
at 24365 Smithtown Road, in the City of Shorewood, legally described in
Exhibit A attached hereto and made a part hereof, as the "Shorewood
Convenience/Service Center"; and
WHEREAS, applicant is requesting to be allowed multiple signage for
its three principal uses including The Good Year Service Center, The Fina
Gas/Car Wash/Food Mart, and the Dairy Queen Restaurant; and
WHEREAS, the Shorewood City Code provides for multiple signage on a
site occupied by two or more tenants, and applicants request therefore
requires a Conditional Use Permit; and
WHEREAS, applicant's application was reviewed by the Shorewood
Planning Commission at a public hearing held on 1 November 1988.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Shorewood as follows:
FINDINGS OF FACT
(1) That applicant is proposing the following signage:
Good Year wall sign
Fina wall sign
Car Wash wall sign
Food Mart wall sign
Dairy Queen wall sign
Free standing pylon sign
55 square feet
22.5 square feet
11. 5 square feet
30 square feet
35 square feet
196 square feet
TOTAL
350 SQUARE FEET
(2) That applicant's building silhouette area totals 3,431 square
feet and therefore, applicant's allowable sign area would be 343 square
feet (10% of silhouette) pursuant to Shorewood Zoning Code.
( 3) That there will be other signs on the site which are required for
motor fuel stations. These are classified as regulatory and directional
signs and will not count against the number of allowable signs.
( 4 ) That applicant has agreed to eliminate the car wash sign and to
combine the Dairy Queen sign with the Fina sign to comprise the one free
standing sign permitted by the Code.

(5) That the rema1n1ng signs appear to be appropriate for the site
and the business operation.
(6) That the applicant's modified proposal for multiple signage will
meet the intent and requirements of the City Code.
CONCLUSIONS
(1) That applicant's application for conditional use permit for
multiple signs is hereby granted, subject to the following conditions:
(a) That the signage consist of the following:
Good Year Wall Sign
Fina Wall Sign
FoodMart Wall Sign
Dairy Queen Wall Sign
Free Standing Pylon Sign
TOTAL OF ALL SIGNS NOT TO EXCEED 343 SQUARE FEET
. (b) That applicant may erect "directional" entrance and exit signs for
the car wash.
(c) That applicant may erect such other signs as are required on the
site for a motor fuel station.
(d) That one of the Fina signs now located on the canopy be
eliminated.
(e) That any additional advertising will be accommodated on the
message boards incorporated into the free standing sign.
(2) That this Resolution be filed and recorded with the Hennepin
County Recorder or Registrar of Titles within thirty days of the date of
certification hereof.
ADOPTED BY THE CITY COUNCIL of the City of Shorewood, on the 14th day of
November, 1988.
