RESOLurIOO' KO. 137-88 A RESOLurIOO' APPROVING '!HE PlAT OF TRAL"EY AIDITIOO' WHEREAS, the final plat of lracey Addition has been submitted in the marmer required for the platting of land under the Shorewood City Code and under Chapter 462 of Minnesota Statutes, and all proceedings have been duly had thereunder; and WHEREAS, said plat is consistent with the Shorewood Comprehensive Plan and the regulations and requirements of the laws of the State of Minnesota and the City Code of the City of Shorewood. WV, llIEREFURE, BE IT RESOLVED by the City Council of the Ci ty of Shorewood: 1. That the plat of Tracey Addition is hereby approved. 2. That the approval is specifically conditioned upon the tenus and conditions contained in the Declaration of Covenants attached hereto and made a part hereof. 3. That the Mayor and Ci ty Clerk are hereby authori zed to execute the Certificate of Approval for the plat on behalf of the City Counci I . 3. That this final plat shall be filed and recorded within 30 days of the Developer's receipt of this Resolution. BE IT FURllIER RESOLVED, that such execution of the Certificate upon said plat by the Mayor and City Clerk shall be conclusive, showing a proper compliance therewith by the subdivider and City officials and shall entitle such plat to be placed on record forthwith without further fonuality, all in compliance with Minnesota Statutes and the Shorewood Ci ty Code. WITNESSETH: WHEREAS, the Declarants are Ovners and lVbrtgagees of real property located in the City of Shorewood, County of Hennepin, State of Minnesota, legally described as follows: Lots 1 and 2, Block 1, '!RACEY AIDITICN; and WHEREAS, there is presently a garage/carriage house located on Lot 1 of said real property which encroaches into the public right-of-way of Covington Road; and WHEREAS, Declarants desire to keep and maintain said garage/carriage house in its present location on the property so long as it does not interfere with the public's use of said right-of-way.
