WHEREAS, on Apri I 28, 1986, the Ci ty of Shorewood entered into an Agreement wi th
Lnndgren Bros. Construction Inc., for the developnent of certain property known as Near
Mountain; and
WHEREAS, Paragraph 3 of said Developnent Agreement provided for the Developer to
construct and install certain enumerated improvements within the plats of said property,
which improvements included streets, watermain, sanitary sewer and storm sewer; and
WHEREAS, Paragraph 13 of said Developnent Agreement provided for such improvements to
be subject to a final inspection by the City Engineer; and
WHEREAS, Paragraph 24 of said Developnent Agreement provided for the conveyance of
said improvements to the City by the Developer and for the acceptance by the City of such
improvements; and
WHEREAS, the Developer has coopleted construction and installation of the streets and
such improvements have been inspected by the City Engineer and found to be in coopliance
with the applicable plans and specifications; and

WHEREAS, the Developer is desirous of conveying said improvements to the Ci ty, and
the City is desirous of accepting said improvements from the Developer.
IDV, 1HEREFmE, BE IT RESOLVED by the Ci ty Council of the Ci ty of Shorewood as
follows:
(1) That the City hereby accepts from the Developer the streets in the plat of
McKinley Place at Near Mountain 2nd Addition.
(2) That the Developer shall furnish a maintenance bond naming the City as obligee
for the full cost of the improvements, to be in effect for a period of one year from the
date of acceptance hereof.
