WHEREAS, the City of Shorewood has previously approved the final
plat of Near l\buntain and has entered into a Developnent Agreement wi th the
Developer, Lundgren Bros. Construction, Inc., dated April 28, 1986; and
WHEREAS, the City of Shorewood has agreed to certain
modifications to said Developnent Agreement requested by the Developer and
has instructed that the said Developnent Agreement be amended to reflect
these modifications.

1. That the Developnent Agreement for Near lYbuntain dated
April 28, 1986, between the City of Shorewood and Lundgren Bros.
Construction, Inc., be and hereby is amended to include the tenns and
condi tions of the Amendnent to Developnent Agreement for Near lYbuntain
attached hereto and made a part hereof.
2. That the Mayor and City Clerk are hereby authorized to
execute the said Amendnent. to Developnent Agreement on behal f of the Ci ty
~uncil of the City of Shorewood.
