WHEREAS, 1.Vlr. Jeff Thompson and Ms. Loxi e lVbck own a two- f amil y
dwelling at 5875 Division Street in the City of Shorewood; and
WHEREAS, the property is presently zoned R-1C, single-fami ly
residential, and their home is therefore a nonconfoftTIing use in that
district; and
WHEREAS, there are several other two-family dwellings in the same
neighborhood that are existing as nonconfoftTIing uses; and
WHEREAS, thirteen residents in the immediate area have petitioned
the City to rezone an area along Division Street containing approximately
10.7 acres, and including the property on which the two-family dwellings
are located, to R-2A or R-2B, two-family residential; and
WHEREAS, a public hearing was held and the matter reviewed by the
Planning Comnission on 7 June 1988, and the Planning Comnission could not
foftTI a consensus as to the matter; and
WHEREAS, the Ci ty Council considered the matter at their regular
meeting on 13 June 1988, voted to deny the application, and directed the
City Attorney to prepare Findings and Conclusions for review and action by
the Council at their next regularly scheduled meeting.
N:lV, 1HEREFORE, BE IT RESOLVED by the City Council of the Ci ty of
Shorewood as follows:
FINDIKGS OF FACT
1. 'rhat the above-described property is located in a district
zoned R-1C.
2. That a substantial majority of the homes in the immediate
area of the subject property are single-family residential units and
confoftTI to the R-1C zoning requirements.
3. That rezoning the subject district to R-2A or R-2B,
two-frnmily residential, would increase the density of the district and
create additional traffic in the irnrnediat~ area.

4. That the construction of additional two-family residential
dwellings would not be consistent with existing dwellings in the immediate
area and therefore would be incompatible with present and future land uses
of the area.
5. That the proposed rezoning would be adverse to the general
welfare, public health and safety of the community.

That based on the foregoing the City Council of the City of
Shorewood hereby denies the request for an amendnent to the zoning
ordinance changing the classification of the subject property from R-1C to
R-2A or R-2B.
