Agenda Item #3C: Aaron's Tree Service has applied for a license to provide tree trimming
service in the City. As all license requirements have been met, staff recommends
adoption ofa resolution approving a Tree Trimmer License for 2005.

Agenda Item #3D: Included in the packet are excerpts of the plans, specifications, and
engineers estimate for the Badger Well Reconstruction Project. Cost for construction of
the project is estimated at $585,568.50. StaIfis recommending approval of the resolution
that approves the plans, specifications, and estimate and authorizes advertisement of bids.

Agenda Item #6A: On November 22, 2004, the City Council approved Resolution 04-098,
which Declared the Adequacy of a Petition for the Extension of Municipal Water Service
On Timber Lane.
The City Council is to conduct a public hearing for the improvement project. If found
acceptable, Agenda item lOA on the agenda approves the plans specifications and
engineers estimate and authorizes advertisement of bids.
Agenda Item #9A: The City Council has expressed its interest in transferring the local Board
of Review responsibilities to Hennepin County in an "open-book" process. No public
hearing is required for this matter. State law requires that the transfer of duties be for at'
least three years. The City's contract for property assessment services runs through 2008.
A resolution has been prepared that would transfer these responsibilities to Hennepin
County for three years. After that length of experience, the Council in 2008 could decide
whether and for how long the transfer of responsibilities should be continued. A simple
majority is required to approve the resolution.

3. CONSIDER ADJUSTMENTS TO APPELLANTS' VALUATIONS
Administrator Dawson explained since the last meeting of the Board of Review held on April 18,
2005, Mr. Kunik had worked diligently with appellants to review cases presented, and wished to
present findings and recommendations to the Board this evening. To that end, Mr. Kunik had
prepared a report for the Board that had been distributed prior to the meeting, regarding the cases
heard at that meeting. He also noted no review or valuation had been considered for Mr. Kessel
from the last meeting as there had been no communications from him requesting further
consideration.
Bob Manders, 6105 Rampart Court, P .I.D. 33-117-23-44-0040, had spoken with Mr. Kunik
and stated to Administrator Dawson that there would no longer be an appeal on his valuation at
this time.

Dick Lundy and Lucille Goodwyne, 5525 Timber Lane, PID 34-117-23-22-0029. The
appellants had indicated to Mr. Kunik that they would not proceed further with the local Board
of Review.

John Cross, Minnetonka Moorings and the Shorewood Yacht Club 600 West Lake Street,
PID 34-117-23-21-0061, met with the Hennepin County Assessor regarding commercial
properties. Mr. Cross was unavailable for the meeting this evening. Administrator Dawson
suggested the value to be sustained. Assessor Johnson from Hennepin County may assign a
revised value at a later time.
Scott and Vicki Young, 26865 Edgewood Road, PID32-117-23-22-0021, spoke with Mr.
Kunik by phone. Mr. Kunik noted he had explained there were several factors influencing the
other property valuations the appellants had cited as part of the valuation process that would not
support the decrease in valuation that the appellants were requesting for their own property. He
also stated he had met with his supervisors regarding this property, and all agreed the valuation
of $545,000 was correct as stated.
Mrs. Young thanked Mr. Kunik for speaking with her; however, she noted she still had several
concerns as there were a number of properties detailed in her packet submitted at the last Board
of Review meeting that were acknowledged as inequities in the valuation process. She also
stated Mr. Kunik had explained it was important to examine total values of properties due to land
and building ratios.

Mr. Young stated he also appreciated Mr. Kunik taking the time to speak with him; however, he
thought there were contradictions in how the valuation process was being handled, as he believed
the guidelines for valuation shifted each time a new concern had been raised in this valuation
process. Further, he stated his assessed valuation was not aligned with his neighbors currently,
and he was not bringing this forward to have his neighbors properties raised. He requested the
value of his property be reassessed to be more in line with his neighboring properties' .

Mr. Kunik explained the Assessor's Office separated different parts of the City into different
neighborhoods for comparison purposes, and proximity to the lake factored into decisions made
in valuation. Wetland issues also impacted land values. He noted land values in that
neighborhood had remained stagnant in 2002-2003 and land values were being adjusted
accordingly in recebt years. He also stated the Assessor's Office had taken an exhaustive
examination of this property and believed the value to be justified. He explained a neighboring
property had sold in the last year for $523,000. He also explained this sale reinforced the point
that the appellants' property would sell for near the assessed valuation.

Mr. and Mrs. Young both explained their property was difficult to access as well as several other
factors and the assessed valuation should be reduced as they did not believe their property would
sell in the marketplace for the assessed market value.
Mr. Kunik stated there were no other appellants to be heard this evening.

no change in the valuation until all parties had received appropriate information regarding the
valuation for this property.

Boardmember Wellens stated he had looked at the evidence presented by the Youngs in this
matter, and he complimented them on their thoroughness in comparison to other property
valuations in the neighborhood. He stated he thought the valuation included a sizeable increase,
much higher than the neighbors, and he would like to propose a change in the valuation.
.Boardmember Lizee stated she thought the house had been nicely improved in recent years, and
the property was quite nice as well. She stated she did not see an abnormal land value increase
in this case.
Chair Love also complimented the Youngs on the information presented as part of the valuation
process. He stated he did not believe this valuation was out of character with the area, and his
inclination was to support the assessed valuation as well. He explained the process for the right
to appeal the valuation in this case, and noted the difficult role of the Board in matters like this
one as he realized the financial impacts were difficult to receive. He noted the size of the
property in the lake shore district as a factor for supporting the assessed valuation.

A. Report by Tom Skramstad, LMCD Representative
Mr. Skramstad, Chair and Shorewood's Representative to the Lake Minnetonka Conservation District
(LMCD), reported on issues pertaining to the Veterans Camp on Big Island, deicing permits, a
communication process on high water emergencies, zebra mussel prevention programs, boat density
committee and study, boating restrictions on Six Mile Creek and logistics of the LMCD.
In response to Mayor Love's question, Mr. Skramstad explained the process for communicating high
water emergencies to citizens was under review by the LMCD, and more information would be presented .
to residents at a later date.

Mr. Skramstad also requested the City consider additional articles on zebra mussels within the City
newsletter as a way to educate the public on this topic. He agreed the LMCD would provide additional
articles to Administrator Dawson for inclusion in the upcoming newsletters. Councilmember Lizee also
suggested he contact the school districts to work with the Staff and students on this topic. Mr. Skramstad
thanked Council for its suggestions and time in these matters, and encouraged all interested persons to
contact the LMCD regarding a boat density study. He stated there would be a meeting of the Boat
Density Committee ofthe LMCD on Wednesday, May 11,2005, at the Wayzata City Hall to gather
feedback on this topic.
Mayor Love thanked Mr. Skramstad on behalf of the Council for all his efforts in representing the City
on the LMCD.

7.
PARKS
A. Report on Park Commission Meeting Held April 12, 2005
Commissioner Meyer reported on matters considered and actions taken at the April 12, 2005, Park
Commission Meeting (as detailed in the minutes of that meeting).
Discussion ensued regarding matching funds for contributions received for the Music in the Park series.
Information on the matching program for this series would be made available in the next newsletter.
B. Authorize Expenditure of Funds for Skate Park Equipment
Turgeon moved, Wellens seconded, Authorizing Expenditure of Funds for Skate Park Equipment
as outlined in the proposal provided by TrueRide. Motion passed 4/0.

PLANNING
Commissioner Conley reported on matters considered and actions taken at the April 19, 2005, Planning
Commission Meeting (as detailed in the minutes of that meeting).
A. C.U.P. For Accessory Space over 1200 Sq. Ft.
Applicant: Paul and Nancy Zander
Location: 5215 Howard's Point Road
Director Nielsen explained the history of the case, noting the applicants proposed demolishing the
existing house located at 5215 Howard's Point Road, intending to build a new home on the property
which would include space under the attached garage for additional storage. Total floor area of the two
garage levels would be greater than 1200 square feet in area and necessitated a request for a Conditional
Use Permit, pursuant to Section 1201.03 Subd. 2.d.(4) of the Shorewood Zoning Code.

He went on to explain the property was zoned R-IAlS, Single-family ResidentiallShoreland and .
contained approximately 28,008 square feet in area. The garage areas were located on the front of the
house and would contain 2180 square feet of area, split evenly between the two levels. The upper level
garage faced west, while the lower level garage faced north.
Director Nielsen stated the request for a Conditional Use Permit complied with all necessary criteria for
this request; however, he noted the lower level garage doors would be double doors, rather than three
doors as on the upper level.
The Zander's were present this evening and stated they would answer any questions the Council may
have had of them.

Conditional Use Permit for Additional Accessory Space to Paul and Nancy Zander, 5215 Howard's

B.
C.U.P. For Reconstruction of Badger Well House and Parking Lot Improvements
Applicant: City of Shorewood
Location: 5745 Country Club Road

Director Nielsen explained several years ago the City prepared an improvement plan for its Badger field
property, located at 5755 Country Club Road. At that time the site was occupied by Badger field Park,
City Hall, Shorewood Public Works Department and a pole building housing the Badger field well. That
plan has been mostly implemented, including paving, curbing and striping of parking areas; landscaping;
and removal of the old pole barn that housed the Public Works Department. Since that time, the Badger
well house was placed at the top of the Capital Improvements Program and would be reconstructed as
called for in the original plan.

He went on to explain the existing well house was located on a separate parcel of land currently zoned C-
3, General Commercial. Surrounding land uses and zoning included a self-service car wash to the north;
zoned C-3, the South Shore Center; zoned R-IC, Single-family Residential to the east, Badger field
Park; zoned R-IC to the South, and an auto repair shop; zoned C-3 to the West.
.
The subject property was occupied by the well house and 14 parking spaces that served the park and
South Shore Center. The existing building contained 1665 square feet of area, and did not conform to
current zoning requirements due to its pole barn construction and proximity to property lines. Also the
building's proximity to a steep slope to the north plagued it with drainage problems.
It had been proposed that the building be totally replaced. The new building would be one story in height
and would contain 1040 square feet of floor area. The new building would be of masonry construction,
. using rock faced block at its lJase with a burnished block above. The gable ends would have metal siding
above the block and on the fascia and soffits. The roof would be asphalt shingles.
Three existing parking spaces for the park and one for the South Shore Center would be lost for the
driveway to a new parking area on the west side of the new building; however, nine new spaces would
replace the four. A sidewalk and security lighting would be located at the rear of the building to provide
safe pedestrian access from the new parking to the South Shore Center.

Proposed landscaping for the site would consist of foundation plantings on the south side and northeast
comer of the building. Two sugar maple trees were shown on the west side of the new parking lot with
ornamental trees and arborvitae planted along the sidewalk area.
With regard to the analysis of the case, Director Nielsen explained public regulated utility buildings were
provided in both commercial and residential zoning districts. He noted several areas of concern
including issues related to legal combination of the subject parcel with the Badger Field property, and
consideration of rezoning the property from commercial to residential. He also noted various issues
including buildings and parking setbacks, screening and landscaping, lighting, and building color.
Despite these issues, he recommended the proposed building, parking and landscaping, as proposed, were
a vast improvement over what currently existed. Staff recommended the request for Conditional Use
Permit be approved, subject to several conditions outlined by Staff.
In response to Councilmember Wellens's question, Director Nielsen explained the drainage issues for the
site would be remedied as part of this project.

Rezoning From C-2, Auto-Oriented Commercial to R-IC, Single-Family
Residential

Director Nielsen explained that last year the Planning Commission, in its annual review of the Zoning
Code, determined that the C-2, Auto-Oriented Commercial District, was obsolete and should be
eliminated from the Code. Last month a public hearing was continued, pending a rezoning of the one
parcel of land in Shorewood that had that zoning classification. The subject property was located at
25575 Smithtown Road and was currently occupied by Lake South Automotive - an auto repair garage.
He noted a survey of the subject property was not available at this time; however, an aerial photo
depicted the existing building and parking areas on the site. The property had 19,961 square feet of area,
according to Hennepin County tax records. The site was entirely surrounded by single-family residential
development with R-1C zoning to the north and west, and R-1A zoning to the south and east.
The Land Use Plan in Shorewood's Comprehensive Plan designated the future land use of the subject
property as low-to medium-density residential. The Area Plan for Planning District 4 stated "Any land
use decision relative to the small C-2 property should favor redevelopment to low to medium density
residential (one to two units per acre)".

Director Nielsen also went on to explain when the Comprehensive Plan was being discussed, it was noted
that although the auto repair operation was an allowable use in the C-2 zoning district, the existing
building did not comply with the setbacks of that district, nor did the existing parking area comply with
the standards for commercial property (e.g.) setbacks, curbing and striping, and screening from
residential property). He also noted the site was essentially unbuildable, due to the requirement that
commercial buildings have a 50-foot setback from residential properties. This was considered one of the
main reasons that "spot zoning" was so strongly discouraged.

By contrast, the site was very usable as a residential site. He then provided an illustration of the setbacks
if the property would be zoned R-I C, Single-Family Residential. He stated it was worth noting that there
were two choices as to which residential classification the property should have in the future. Property to
the east of the site was zoned R-IA, while property to the south of the site was zoned R-IC. The subject
property would not be buildable as an R-IA (40,000 square feet), therefore the R-IC classification was
recommended.
Next he reviewed how the property would be affected by the change in zoning classification. The
property would be "grandfathered in" and the business could continue to operate as it had in the past. It
could be sold as a nonconforming use and a new owner might continue the business as it has been
operated in the past. Under the new classification, neither the building nor the parking area could be
expanded. However, he noted, that was the case under the existing classification as well, due to the
substantial nonconformity of the site. Perhaps the most significant impact of the rezoning was that any
change in the existing use of the property would have to be to residential use rather than the list of
allowable uses in the C-2 district. Again, the site was quite buildable and usable as a residential
property .
In working with the City on this matter, the property owner had suggested that the "down zoning" of his
land represented a taking and questioned how he would be compensated at the last public hearing on this
matter. Staff had contacted the City Attorney to address this issue, and he was present this evening to
provide information on that topic.
Attorney Keane summarized a memorandum he had presented to the Council earlier in the evening
regarding issues related to "down-zoning" and whether a zoning change constituted a regulatory taking
including denial of an owner's economically viable use of hislher land. He noted in this case, the uses
allowed in the auto-oriented commercial district were fairly limited in scope and probably had limited
commercial viability given the low volumes of traffic and surrounding residential character of the area.
The proposed R-I C District would allow the property owner to redevelop the property as residential use
as was consistent with the Comprehensive Plan and the surrounding land use pattern. Residential lot
sales throughout the City had been exceedingly strong in recent history. In addition, he noted the
business could remain as was being currently operated or could even be sold as the same business use.
Further, there was no sunset clause associated with the use in this case. In summary, he stated,
Minnesota statutes required metropolitan cities to conform zoning classifications to Comprehensive Plan
designations. A property owner had no vested right in a zoning classification, and based on current
regulatory takings law, it was his opinion that the change in zoning for the property would not constitute
a regulatory taking.
Mayor Love stated the City was in receipt of a petition submitted on this matter by the owner of Lake
South Automotive.

Bill Kirchner, owner of Lake South Automotive located at 25575 Smithtown Road, stated he had several
remaining concerns. He questioned the urgency in rezoning his property, and noted his business was
wanted in that location by area residents as he provided several valuable services to the community in
addition to automotive repair. He stated his site was considered a non-conforming site only since Kelsey
Lane had been added as part of a recent development project. He did not see value in changing the
rezoning as it impacted his long term financial benefits for his family. He stated a rezoning of the
property would "devalue" his property by approximately 30% as lenders would interpret the rezoning as .
wishing to eventually rid the area of the business site. He requested the City table this matter until some

time in the future since his business had been in place since 1932, prior to many ofthe City's current
zoning ordinances.
Sheryl Gilbertson, 26055 Shorewood Lane, stated she was a long-time resident ofthe City who believed
strongly that this matter should be pursued. She implored the Council to look beyond the legalities of the
situation and examine the ramifications of action on this matter. She stated Lake South Automotive had
been a good neighbor for the past 21 years, and she did not like the idea that this property would be
devalued as result of City actions. She stated she liked the mixed use of the area and the small town feel
of the area. She did not see any advantages arising out of the rezoning that would better the City and
only saw negative impacts to Mr. Kirchner and his business. She further stated redevelopment in the area
had already begun to take place in the area, and she could not understand any reasons why this matter had
to be pursued at this point in time. She requested the City table action on this matter, and if it could not
at this time, consider compensating Mr. Kirchner for the action.
Michael Hoy, 25480 Smithtown Road, stated he had lived across the road from Lake South Automotive
for seven years, noting there were many fine qualities of Mr. Kirchner. He stated he thought it was
disingenuous of the City to remove property rights from Mr. Kirchner without compensation. He thought
the rezoning seemed unfair in this case, and he believed it was nice to have diversity in Shorewood.
Councilmember Wellens stated it seemed as though this case was driven by the Comprehensive Plan. He
stated he thought it was important for the City to have the Comprehensive Plan fit its residents and not
the other way around. He stated this seemed to be a solution without a problem and he did not believe
adequate justification had been made in this case. Further, he stated he did not see why a resident should
ever have to defend his or her property from the City, and while this proposed action might be legal, it
did not seem at all like the right thing to do.
Councilmember Callies stated she heard the numerous accolades related to Mr. Kirchner and noted these
also impacted property values. She summarized the actions taken related to the Comprehensive Plan in
this case, and noted the State of Minnesota and City of Shorewood required good planning for the City,
including the removal of spot zoning sites within the City. She stated she thought it was beneficial to
have the parcel fit into the neighborhood. She further stated this case was not about Mr. Kirchner but
about the use designated for his property, and that was the exact reason for planning for the future. She
noted the rezoning would not preclude Mr. Kirchner for continuing his operations.
Councilmember Lizee agreed, noting she viewed this matter as consideration of changing a commercial
site to a residential site with uses remaining into perpetuity. She also did not think this case infringed on
the property rights of Mr. Kirchner.
Councilmember Turgeon clarified this property was the only site of its kind remaining in the City, and
noted the decision would be quite difficult if Mr. Kirchner could not operate his business at all or could
not sell it; however, that was not the case.
Mayor Love questioned the impact to any potential business plans for the site. Attorney Keane explained
lenders frequently examined sites for zoning compliance and some were more stringent than others in
this regard.
Paul Zisla, attorney representing Lake South Automotive, stated the proposed action would create
problems in viability for the site and the owner believed a diminution would take place. While legally
the action could be taken, he stated it did not mean it had to be taken at this point in time. Further, he

stated there was a great deal of support for Mr. Kirchner and the property would be less valuable for him .
with a loss of flexibility. He suggested the Council look to find alternatives.
Mayor Love stated the issues of acting versus reacting to a situation defined planning in the utmost sense
of the word.
Councilmember Lizee agreed, noting there was very little that was less flexible with the rezoning than
was the current situation.
Councilmember Turgeon questioned what modifications could be made to the property currently.
Director Nielsen explained the property could be maintained, but not expanded or altered. He also
clarified there was not a conditional use permit associated with this property in any way at this time.
Mayor Love stated he appreciated all comments received on this case, and it was the Council's
responsibility to review any removal of property rights from a resident.
Callies moved, Amending the Zoning Code to Eliminate the C-2, Auto-Oriented Commercial
District. Motion failed for a lack of second.

E. Sign Permit for Sunsplash Sun Studio
Director Nielsen explained Edison Signs, on behalf of Sunsplash Sun Studio, had requested a sign permit
for their location with the Shorewood Village Shopping Center. Director Nielsen noted the request was
consistent with the Conditional Use Permit governing the site and Staff recommended approval ofthe
matter.

GENERAL/NEW BUSINESS
A. Calling for the Sale of Bonds
Administrator Dawson stated at a Work Session Meeting held on January 24,2005, the Council had
indicated support for water system improvements and the issuance of water revenue bonds to finance
same. He noted the proposed action this evening would set a date for the sale of bonds and would
approve a financial services agreement allowing that action to take place.
Engineer Brown then noted the projects that would be financed from the sale of these bonds. Finance
Director Burton reviewed the budget and bond scenario for these projects for Council. Mr. Paul Donna,
of Northland Securities, explained the bonding process for Council and providing a brief synopsis of the
issuance environment in the current marketplace.
B. Authorization of Services of BKV Group
Administrator Dawson explained that at its March 28,2005, Work Session meeting, Council agreed
concepts for improvements to City Hall should be developed further especially in light of the recent
acquisition of property adjacent to City Hall. He also noted since BKV Group had performed the City
Hall evaluation completed early last year, there might be economies to having that firm build upon its
work. To that end, BKV Group had submitted a proposal to further evaluate concepts in greater depth
over the next few months. .Its work program would include identification and assessment of up to seven
options, including enhancement of previous options as well as development ofthree new concepts. Costs
for this evaluation were estimated to be $10,000.
Councilmembers Callies and Turgeon expressed concern for the amount of hours and associated costs for
this evaluation. Discussion ensued regarding this topic.
Lizee moved, Turgeon seconded, Recommending Authorizing the Services of BKV Group to
develop further refinement of option for City Hall improvements, not to exceed $10,000. Motion
passed 5/0.
10. ENGINEERINGIPUBLIC WORKS
Engineer Brown stated there was nothing to report on at this time.
11. STAFF AND COUNCIL REPORTS
A. Administrator & Staff
1. County Road 19 Intersection
Engineer Brown noted the utility realignment work had begun and was proceeding nicely in the northern
section of the project near the carpet store. In addition, he noted there would be a significant change in
the landscape in the area of the chocolate shop near the Tonka Village Shopping Center.
Councilmember Turgeon questioned the status of the utility costs for the project. Engineer Brown noted
the costs had shifted significantly in recent months and Staff continued to pursue resolution of these
issues. Attorney Keane stated it would be appropriate for the City to engage an expert regarding

segmenting the costs associated with upgrades to utilities and construction. Engineer Brown stated he .
would report back to Council on this matter.
2. Concession Operation Services Update
Engineer Brown stated Staff was pleased to report an agreement had been reached with a new contractor,
Mr. Russ Withum, to provide concessions services at Eddy Station in Freeman Park beginning April 18,
2005.
B. Mayor & City Council
1. SLMPD Issues Group
Mayor Love stated the South Lake Minnetonka Police Department Issues Group continued to make
progress in the mediation process outlined for the member cities. Further meetings would take place in
May and more information would be available at that time. One tentative agreement had been reached on
members of the Coordinating Committee by the Issues Group.
Councilmember Lizee stated she had attended the Met Council's West Metro Transit Meeting in Hopkins
on April 12, 2005, regarding changes in transit routes. She provided a status report on the actions at that
meeting, noting more information would be available at a later date.

Councilmember Turgeon requested a Work Session Meeting to be held after the next Regular Council
meeting.

A RESOLUTION APPROVING PLANS, SPECIFICATIONS AND
ESTIMATES AND AUTHORIZING ADVERTISEMENT FOR BIDS FOR
THE BADGER WELL RECONSTRUCTION PROJECT,
CITY PROJECT 98-06
WHEREAS, the City Council, of the City of Shorewood has identified Badger Well
Facility as a critical element within the overall municipal water system; and
WHEREAS, the City of Shorewood, has ordered the preparation of Plans, Specifications
and Estimate for improvements to said well facility; and
WHEREAS, WSB and Associates Inc. has prepared said Plans, Specifications and
Estimate dated, April 25, 2005, for the Badger Field Well House Improvement Project, further
known as City Project 98-06; and
WHEREAS, the City Council has determined that the Plans, Specifications and Estimate
are found to be in order.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of
Shorewood, Minnesota:
1. Plans, Specifications and Estimates, prepared by WSB & Associates, Inc., dated
April 25, 2005, for said Improvement, are hereby approved and shall be filed with
the City Clerk.
2.
The City Clerk shall prepare and cause to be inserted in the official paper and in
Construction Bulletin an advertisement for bids, attached hereto as Exhibit A, ad
for bids, upon the making of such improvement under such approved plans and
specifications~ The advertisement shall be published for 3 weeks, shall specify the
work to be done, shall state that bids' will be opened and considered by the Council
at 10:00 a.m. on June 8th, 2005 in the City Hall Council Chambers, and that no bids
will be considered unless sealed and filed with the Clerk and accompanied by a
cash deposit, cashier's check, bid bond, or certified check payable to the Clerk for
5 percent ofthe amount of each bid.

On November 22, 2004, the City Council approved Resolution 04-098, which Declared the Adequacy
of a Petition for the Extension of Municipal Water Service on TimberLane. Attachments 1 and 2 are
project site maps. Attachment 3 is Resolution 04-098. The public hearing was initially scheduled for
April 25th, 2005. Unfortunat(,'lly, the public hearing date had to be revised to May 9th, 2005.
Attachment 1 is the site location map for the project. Attachment 2 depicts the parcels involved with
the project.

The City Council may recall that this project is a petitioned project. Eight of the nine properties to be
assessed have filed a petition with the City Clerk, requesting the improvement project and waiving
their right to appeal an assessment associated with the improvement.
Costs associated with the design, watermain construction, and inspection services are to be assessed to
the abutting properties. This includes restoration of the roadway after the excavation is completed,
replacement of storm sewer cross culverts and a bituminous overlay. The Council has stated that the
upgrade of storm sewer replacement and bituminous overlay is to be paid for by the City of
Shorewood. Remaining costs for installation of the watermain and roadway restoration due to the
installation would be assessed to adjacent properties benefiting from the water service.

EXECUTIVE SUMMARY
City Project No. 04-_ provides for the extension of municipal water service to initially serve
the eight of the existing single residences located along Lake Minnetonka on Timber Lane.
To achieve the most advantageous option for the City, two waterline options and two pavement
restoration options were explored
Construction of the water main from the end existing water main at Timber Lane and Lawtonka
Drive to the end of Timber Lane and the repair and overlay of Timber Lane is recommended. If
the City has adequate funding, some considerations should be given to complete reconstruction
pfTimber Lane. This will provide the long term objectives of the project and provided for the
restoration of the pavement.
The total estimated project cost is $183,026 which includes a 10% contingency and 30% indirect
costs. Funding for the project will consist of special assessments and 2004 Capital Improvement
Plan (CIP) funds. The assessment hearing will be held in the fall of2004.
The proposed assessment rate is $10,000 per lot. This will generate approximately $80,000 or
approximately 44% of the total project costs.
It is proposed that construction would take place in 2004. Construction will be completed,
including all restoration items in 2004.
This project is feasible, necessary, and cost effective from an engineering standpoint and should
be constructed as proposed herein.

INTRODUCTION
2.1 Authorization
On February 23, 2004, the Shorewood City Council authorized the preparation of an engineering
Feasibility Report for the Timber Lane Watermain Project. This project has been designated as
City Project No. 04-_.
2.2 Scope
The proposed project primarily provides domestic water service for single family residential lots
on Timber Lane. No criterion was given for fire protection. Hydraulic modeling of the City of
Shorewood's water distribution system is not a part of this report.
The Timber Lane environment leaves little choice but to construct the water main within the
existing pavement. As a result, the pavement will need some restoration as a part of this project.

3. GENERAL BACKGROUND
3.1 Project Location
The project is located on Timber Lane in the northeast portion of the City of Shorewood.
The proj ect area is identified on Figure 1 in Appendix A of this report.
3.2 Project Zoning
Generally, the project area is zoned residential.
3.3 Project History
This project was initiated through a petition from the residents currently living on Timber Lane.
Currently, only one parcel is connected to municipal water service, this parcel located at the
westerly end of the Timber Lane cul-de-sac. Many years ago the owner of this property obtained
permission to connect to the City of Tonka Bay's water system.
3.4
Existing Conditions
3.4.1 Streets
Timber Lane is an older roadway of varying paved widths. The pavement varies
from approximately 18 feet wide to 22 feet wide. No curb and gutter exists on the
portion of Timber Lane under review. The general condition of the pavement is
deteriorated, indicating moisture infiltration and poor sub grade soils. There is
visual evidence of lake shore erosion attacking a short stretch of the roadbed.
Portions of the pavement may not necessarily be within the existing right-of-way.
Right-of-way widths vary from 30 feet to 60 feet.
3.4.2 Sanitary Sewer
The existing sanitary sewers within the project area consist of a 30-inch RCP
trunk sanitary sewer line and a 9" diameter PVC sewer line.
3.4.3 Watermain
Currently, no watermain exists within the project area.
3.4.4 Storm Sewer
All surface water runoff is collected using a system of roadside ditches. Water
collected in the ditch along the south side of the road is conveyed to Lake

Minnetonka using corrugated steel culverts, placed in two locations. Both of the
culverts are almost completely buried with sediment and are in very poor
condition.

4. PROPOSED IMPROVEMENTS
4.1 Watermain
The proposed water main is intended to serve those residential properties that petitioned for the
improvement. Study of the water distribution system indicates two possible water main routes to
accomplish this objective.
Watermain Alternate 1: Install the proposed water main entirely within the roadway of Timber
Lane. The water main would run between the intersection of Lawtonka Drive and Timber Lane
and the cul-de-sac at the extreme northwest end of Timber Lane. The water main improvement
consists of approximately 1,560 lineal feet of 8-inch ductile iron water main, four fIre hydrants
and ten residential service lines. These improvements will provide for the delivery of potable
water to the homes and enhance their fIre protection.
Watermain Alternate 2: Install the proposed water main from the Lawtonka Drive cul-de-sac,
across private property to Timber Lane, then, within the Timber Lane roadway to the cul-de-sac
at the extreme northwest end of Timber Lane. The water main improvements consist of
approximately 1,050 lineal feet of 8-inch ductile iron water main, three fIre hydrants and nine
residential service lines. These improvements will provide for the delivery of potable water to
the homes and enhance their fIre protection.
Both alternatives will meet the requirements of the scope of this project.
The proposed water main routings are shown on Figure 2 in Appendix A.
4.1.1
Redundant Water Connections (looping)
Strong consideration should be given to creation of a continuous water
distribution system and the elimination of dead end water mains. Of particular
concern are long dead-end water mains that serve only a few residential
customers. Generally these water mains are sized to provide minimum fIre
protection but are too large to be adequately flushed for typical domestic use.
The existing water main on Timber Lane and Lawtonka Drive is an example of a
dead end water main. The extension of this main will exacerbate the problems
associated with dead ends. Considering the farthest northwest residence on
Timber Lane (5425, Kramer) has domestic water provided by the City of Tonk a
Bay, suggests that Tonka Bay has a dead end water main in the vicinity. All
indications are that both communities are in a similar situation; a dead end water
main at or near the corporation line. The proposed water main extension
described in this report provides an opportunity to eliminate a potential dead end
water main for both communities. The exact location of the water main that

serves 5425 Timber Lane is not known, but is assumed to be on Brentwood
Avenue, (City of Tonka Bay) not far from the corporation line.

A potential solution to be considered is the connection of a water main between
the cities of Tonka Bay and Shorewood near the cul-de-sac of Timber Lane. This
connection is suggested via one of two routes:
Option A would be through permanent easement between the easterly
terminus ofBrentwood Avenue (Tonka Bay) and the northwest corner of
the cul-de-sac of Timber Lane (Shorewood).
Option B would be through an existing un-named public right-of-way
southeasterly from Florence Drive (Tonka Bay) to Timber lane just south
of the cul-de-sac (Shorewood).
The exact location of the connection would have to be agreed upon by both
communities. If Option A is selected, the effected property owner would have to
be agreeable to executing a permanent easement for the construction of the water
mam.

Assuming both communities can agree on a connection of the water distribution
systems at the west end of Timber Lane, there are a number of benefits that could
be realized by both Tonka Bay and Shorewood.
.
A. Enhanced fIre flow in the case of a fIre demand; water can potentially be
drawn for two sources at the same time to fight a fire
B. Reliability;
1. two sources are available in the event that one source is damaged
or interrupted for any reason
2. if a portion of the water main is taken out of service, fewer
customers will be effected
C. Improved or more consistent water quality; water having the ability to
flow in two directions is less likely to become stagnate then water at the
end of a water main. Dead ends water mains have a tendency to have
rusty water with low chlorine residuals.
.
Connection of the City of Tonka Bay water distribution system and the City of
Shorewood water distribution system would provide a benefIt to both
communities.
Each system operator can control activity of the connection with a valve, one
installed for each community near the corporation line.
Potential disadvantages of a connection between the two water systems are:

A. Unequal pressure between the two systems could cause one system to
drive or flow unrestricted into the adjoining system. This can be
addressed with a pressure reducing, pressure sustaining valve.
Installation of this valve would require a review of both water
distributions.
B. Lack of agreement on operation between the two communities
C. Cost of installing the connection
D. Difficulty with the adjoining property owners regarding easements
E. Billing
4.1.2 Lawtonka Dead End Water Main
The dead end water main on Lawtonka Drive should be eliminated if there is
routing that makes sense for continuous flow through a distribution system.
One obvious solution to eliminate the dead-end is to would be to connect the
end of Lawtonka Drive water main back to Timber Lane. This would only be
beneficial if the Timber Lane water main did not dead end. One route to
consider is between units 10 and 11 at the west end of Lawtonka Drive.
The issue of redundant waterlines will have little effect on the cost and design
of this project. The final design will include points to connect redundant
water mains to the proposed water main along Timber Lane. '
The proposed water main redundant connection points are shown on Figure 3
in Appendix A.
4.2
Roadway
The rehabilitation of the existing street is intended to improve the design strength of the
pavement system and provide a smooth street surface with an extended life for the City of
Shorewood and for the local residents. The existing street width and character will be
maintained, as much as possible to minimize the impacts on the existing driveways, boulevards,
and landscaping.
The installation of any underground improvement on Timber Lane is a critical factor in
triggering rehabilitation of the existing pavement. Construction traffic (heavy equipment and
loaded dump trucks) generally causes distressed pavements to deteriorate at an accelerated rate.
Installation of a water main in the pavement or along the edge of the pavement will require the
pavement to be rehabilitated in some form or other.
As a part of the water main installation, two methods of rehabilitating the pavement will be
explored. Generally, the best long term method to strengthen this type ofa street is to construct a
pavement section based on accepted practices and engineering judgment. This approach
generally requires removal of the existing pavement and building a more substantial pavement.
If available funds were not an issue, this is the only method that would be investigated. This

type of construction may not fit into the City's short term budget constraints, for that reason a
bituminous overlay will be investigated as an alternative.
.
Specifically, the two alternatives proposed to rehabilitate the pavement are:
A. The reconstruct the pavement, consisting of two 2-inch layers of bituminous pavement, 6-
inches of Class 5 aggregate base and up to three feet of select granular material as needed
to replace any poor sub grade soils.
B. Overlay the existing pavement with a 2-inch surface course of bituminous pavement.
Patch the trench with four to six inches (flush with the existing surface) of a bituminous
pavement.
The proposed roadway sections are shown as Figures 4A and 4B in Appendix A.
4.3
Right-of-Way I Easements
.
Portions of the existing pavement may be out of or built up to the right-of-way line of Timber
Lane. Generally the corporation stops (shut off valves) for the water services are place outside
the pavement, at or near the right-of-way line. In this case some corporation stops may have to
be outside the right-of-way to get them a reasonable distance away from the edge of the
pavement.
For work outside the right-of-way it is necessary that a Waiver of Trespass I Right of Entry be .
executed by each affected property owner. Realignment of the pavement is not within the scope
of this project.
Should Watermain Option 2 (paragraph 4.1 and Figure 2) be selected, permanent easements are
necessary from Gideon Cove (Lawtonka Drive) and the Hennepin County Regional Railroad
Authority (HCRRA).
The HCRRA has ownership of a former railroad bed that crosses the project site. Verbal .
indications are that easements are not necessary for work confined within the existing right-of-
way of Timber Lane.
Three Rivers Park District operates a trail for non-motorized use on HCRRA lands. The park
district has requested appropriate signage to warn trail users of construction on the days the trail
will be affected.

Construction Traffic
This project will require significant excavation and disposal of unsuitable material from the
existing street area and a supply of significant volumes of granular base, aggregate base, and
bituminous pavement materials. This effort will increase loaded truck traffic on the streets
adjacent to the construction area. All residents will have access during construction, however
some inconvenience is expected. Construction will be phased to minimize inconveniences to the
residents.

5. FINANCING

5.1 Opinion of Cost
Detailed opinions of cost can be found in Appendix B of this report. The opinions incorporate
estimated 2004 construction costs and include a 10% contingency factor and all related
administrative costs. The administrative costs are estimated at 30% and include legal,
engineering, financing, and other administrative items. The cost does not include any easement
acquisition costs.
There are two primary watermain alternatives with three looping sub-alternatives for the
watermain portion, and two street alternatives as follows:
Watermain Alternative No. I $ 95,481
Consists of approximately of approximately 1,560 feet of 8-inch ductile iron water main, copper
service lines for ten single family residential lots and four fire hydrants; follows the Timber Lane
pavement its entire length.

Watermain Alternated No.2 $ 92,035
Consists of approximately 1,050 feet of 8-inch ductile iron water main, copper service lines for
nine single family residential lots and three fire hydrants; runs across private property from the
Lawtonka Drive cul-de-sac to Timber Lane, then along the length of Timber Lane.

This option consists of a total reconstruction of the pavement. The scope of this work includes
removal of the entire existing pavement section, removal of un-sui tab Ie sub grade material and
the construction of a substantial pavement: includes replacing culverts.
Street Alternate No.2 (Patch trench and overlay) $ 87,545
This option consists of repairs to the trench area damaged by the installation of the proposed
watermain and asphalt over of the entire pavement; includes replacing culverts.

FUNDING

Funding for the project will consist of a combination of Special Assessments, Street CIP funds,
Storm Sewer funds.
The proposed Timber Lane Watermain Project was initiated by local residents submitting a
petition for the extension of municipal water service. The existing road surface will also need to
be rehabilitated due the deteriorated pavement condition and the construction of the watermain
with in the roadway; therefore, it is proposed that all costs associated with the extension of water
main and the pavement surface be funded by way of special assessment to the benefiting
properties.
The selection of Watermain Alternative No. 1 will provide the benefit of the project to an owner
that did not petition for the improvement. It is suggested that this owner be included in the
assessment if Watermain Alternative 1 is selected.
Name: Bagdons
Address: 5585 Timber Lane
Situation: Currently this property with very limitedfrontage, if any, along the existing water
main that serves Lawtonka Drive. The construction of the proposed waterline will provide the
benefit of the water main to this property owner without having to pay an assessment. It is
suggested that this property be participate financially in this project.

It has been determined that each benefiting property will be assessed approximately $10,000
totaling $80,000 which is approximately 44% of the total project cost. This is based on $10,000
per lot, per the City of Shorewood' s current ordinance.

The proposed parcels to be assessed are shown as Figures 5 in Appendix A.
The existing pavement is severely deteriorated indicating poor sub grade soils. It is proposed that
any costs associated with sub grade correction will be funded by the City's Street Capital .
development fund.
The City's Storm Sewer Core Fund and Utility Fund are available to fund any storm sewer
improvements. It is proposed that all storm sewer improvements associated with the Timber
Lane Watermain Project be funded by the City's Storm Sewer Core Fund and Utility Fund.

FEASIBILITY AND RECOMMENDATION
A. Watermain
Watermain Alternative No.1 is recommended; it provides for the domestic water service
as petitioned, provides for fire protection and provides for future redundant watermain
connections in the future. Watermain Alternate No.2 provides the same benefit, but does
not provide a significant cost savings to justify the need for easements, difficult
construction and potential disruption caused by construction and the potential difficulty
for future maintenance.
B. Roadway
Street Alternate No.2 is recommended due to funding concerns. If the City has adequate
funding, it is strongly recommended that the reconstruction alternate be considered.
C.
Redundant Watermain Connections
Lawtonka Drive dead-end connection to Timber Lane is recommended in the future to
alleviate future water quality issues that may develop. This work may be done anytime
funding and demand creates the necessity.
Timber Lane dead-end connection to Florence Drive is recommended in the future to
alleviate future water quality issues that may develop. This work may be done anytime
funding and demand creates the necessity.

recommend the restoration of the street and utility improvements as outlined in this report.

A RESOLUTION APPROVING PLANS, SPECIFICATIONS AND
ESTIMATES AND AUTHORIZING ADVERTISEMENT FOR BIDS FOR
THE TIMBER LANE W A TERMAIN PROJECT,
CITY PROJECT 04-05
WHEREAS, on February 23rd, 2004, the Shorewood City Council approved resolution
04-017 that declares adequacy of petition for the Timber Lane Watermain Project; and
WHEREAS, the City of Shorewood, has ordered the preparation of Plans, Specifications
and Estimate for improvements to said Improvement Project; and
WHEREAS, WSB and Associates Inc. has prepared said Plans, Specifications and
Estimate dated, April 4>> 2005, for the Timber Lane Watermain Project, further known as City
Project 04-05; and
WHEREAS, the City Council has determined that the Plans, Specifications and Estimate
are found to be in order.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of
Shorewood, Minnesota:
1.
Plans, Specifications and Estimates>> prepared by WSB & Associates, Inc., dated
April 25>> 2005, for said Improvement>> are hereby approved and shall be filed with
the City Clerk.
2.
The City Clerk shall prepare and cause to be inserted in the official paper and in
Construction Bulletin an advertisement for bids, attached hereto as Exhibit A, ad
for bids, upon the making of such improvement under such approved plans and
specifications. The advertisement shall be published for 3 weeks, shall specify the
work to be done, shall state that bids will be opened and considered by the Council
at 10:30 a.m. on June 8th>> 2005 in the City Hall Council Chambers, and that no bids
will be considered unless sealed and filed with the Clerk and accompanied by a
cash deposit, cashier's check, bid bond, or certified check payable to the Clerk for
5 percent of the amount of each bid.

Transfer of Board of Appeal and Equalization (aka Board of Review) Authority
To Hennepin County
.

Background: Minnesota statutes provide the authority for cities whose property assessment is done
by the County to transfer the duties of the local board and equalization (often referred to as the Board
of Review) to the County Assessor. The City Council has had discussions in 2004 and 2005 about
transferring this authority to Hennepin County, which would conduct an "open-book" process for
valuation appeals. The Council further indicated its preference to transfer this authority to the
County as it did not send one of its members for statutorily-required training earlier this year for the
2006 local board process.
Process: The statute (MS 274.01, Subd. 3) requires that the City Council give public notice ofthe
meeting at which the proposal for transfer be considered. The posting of the agenda for this City
Council meeting is sufficient to comply with statute. Neither a public hearing nor a notice of hearing
published in the City's official newspaper is required.

The action to transfer duties must be done by December 1,2005, for the County to perform these
duties in 2006. The transfer of authority must be for a period of at least three years. However, the

for assessment services with Hennepin County runs through July 31,2008.
RECOMMENDATION:
It is recommended that the Council adopt the Resolution transferring the local Board of Appeal
and Equalization authority to Hennepin County for a three-year period (initially).

extended in the future or even transferred permanently.

RESOLUTION AUTHORIZING THE TRANSFER
OF THE DUTIES OF THE LOCAL BOARD OF APPEAL AND EQUALIZATION
TO HENNEPIN COUNTY FOR A THREE-YEAR PERIOD
COMMENCING IN 2006
WHEREAS, Minnesota Statutes allow cities to transfer the local Board of Appeal and
Equalization (also known as the Board of Review) duties to the County if said cities contract with
their county for property assessment services; and

WHEREAS, the City of Shorewood currently contracts with Hennepin County for annual
assessment services; and .
WHEREAS, the City of Shorewood desires to transfer the duties of the local Board of
Appeal and Equalization to Hennepin County for a three-year period beginning in 2006; and
WHEREAS, the City Council has considered this matter pursuant to the requirements of
M.S. 274, Subd. 3,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shore wood that:
1. The City of Shorewood hereby transfers the duties of the local Board of Appeal and
Equalization to Hennepin County for a three-year period commencing with the 2006
review/equalization process.
2. The City Council directs the City Administrator to notify the County Assessor in writing of
this action before December 1, 2005.

Timber Lane Watermain Improvement Project
Attachment 1 are the plans for the Timber Lane Watermain Improvement Project.

Costs associated with the design, watermain construction, and inspection services are to be assessed to
the abutting properties. This includes restoration of the roadway after the excavation is completed,
replacement of storm sewer cross culverts and a bituminous overlay.
.
As outlined during the public hearing process, upgrades to the storm sewer replacement and
bituminous overlay is to be paid for by the City of Shorewood. Remaining costs for installation of the
watermain and roadway restoration due to the installation would be assessed to adjacent properties
benefiting from the water service.

Radisson Road Safety and Operation Study
WSB Project No. 1585-00
A Safety and Operation Study was completed for Radisson Road between Christmas Lake Road and Old
Market Road. This study was completed in January 2005 and included an analysis of both operational and
safety improvements for Radisson Road. The primary issues were the safety of the roadway with respect
to roadway alignment and cut-through traffic. The alternative improvements that were evaluated
included the following:
Safety Alternatives
1. Reconstruct/widen Radisson Road.
2. Signing and striping improvements.
Operational Alternatives (Cut-Through Traffic)
3. Close the street access at Broms Boulevard.
4. Create an eastbound one-way street system.
The project has gone through a significant public involvement process. This has included the following:
1. Public Information Meeting, Thursday, December 3,2004 - The purpose of this open house was
to receive input from the public on the draft Safety and Operation Study. There were
approximately 30 people in attendance at this meeting. Public comment was taken and the final
Safety and Operation Report was prepared for City Council based on this input.

2. City Council Meeting, Monday, February 14,2005 - At this City Council meeting the Traffic and
Operation Report was presented and additional City Council comment and public comment was
received. The result of this meeting was that additional alternatives needed to be reviewed and a
second public information meeting be held to discuss the additional alternatives. .

Public Information Meeting, Monday, April 4, 2005 - This public information meeting was held
to discuss the additional study alternatives that were completed for the roadway. This included
presenting three additional alternatives and receiving input on these alternatives.
The additional alternatives that were presented at the public meeting and discussed at the previous
City Council meeting included:
Alternative la - Widen Only at Jab's Property - This alternative included only widening at Jab's
property, improving the curve radius and width ofthe roadway.
Alternative 2a - Additional Signing - This alternative included additional signing at the
intersection of Old Market Road and Broms Boulevard., restricting the turning
movements during peak hours onto Broms Boulevard.
Alternative 3a - Close Broms Boulevard to Eastbound One-Way - This alternative involved
closing the Broms Boulevard approach to an eastbound one-way, and creating
cul-de-sac on the southern access to Covington Road.
In addition to the additional alternatives discussed above, it was requested that a comparison be made of
Radisson Road to other "Residential" streets. There are approximately 72 homes that use Radisson
Road. The recommended traffic generation rate calculation is approximately 10 trips per dwelling per
day. This translates into approximately 720 trips per day on Radisson Road. Based on the traffic counts
conducted in February 2004, there were 500 vehicles per day on Radisson Road. These values are very
typical for a low volume residential street.
Based on the analysis of the additional alternatives and input from the public at the April 4, 2005 meeting,
the following improvements were recommended:
1. Improve the signing and striping along the roadway, as indicated in the original Alternative 2 and
the additional signs in Alternative 2a.
2. Monitor vehicle and pedestrian traffic over the next year and determine if additional study and/or
additional improvements may be needed along the roadway.
3.
Prepare plans and specification for the signing and pavement marking improvements for City
Council approval.
