Dear SirIMadam:
This letter will serve as my appeal of the 2005 estimated market value. My address is
21095 Radisson Road. The City Engineer and City Council are currently considering making
Radisson Road a one way road in an easterly direction. Should the City Council approve a one
way road starting at Merry Lane, the access of my property to the west would be severely
restricted (eliminated) thereby diminishing the value of my property. All trips made to the west
would require travel time and distance to be greatly extended thereby decreasing the value due to
access restriction to 21095 Radisson Road.

By directing a copy of this appeal letter to the City Assessor, I would request that I receive a
breakdown of the real property and improvements on the valuation notice (lot value and
improvements value) for not only my property but for the three properties immediately to the east
and the four properties immediately to the west of 21 095 Radisson Road, for comparison
purposes.

We believe that our assessed estimated market values, for both property and building
(home), are not in alignment with the estimated market values of our neighbors.

We do not want to see our neighbors' land and home values raised. Rather, we would
like to see our values be reassessed to be more in line with the rest of the neighborhood.

We have been told by the county assessor that the values assessed to our home and
land are fair, and it is our responsibility to prove otherwise

We are trying to understand the parameters and guidelines that drive the establishment
of market values, both estimated and limited, for area properties.
. Our estimated and limited market values continue to gain a wider spread while
neighborhood values are coming closer into alignment.
. What criteria are use to establish equity between limited and estimated market
values?
. We've been told our values are higher than our neighbors' because of the "quality"
of our house. In a neighborhood of quality homes, who establishes that the
"quality" of our home is so much greater than comparable homes surrounding us?

The 2005 Shorewood Local Board of Review has been scheduled for Monday, April 18TH.
As preparation for the upcoming Local Board of Review, please find the enclosed data to help
you. A summary of duties and responsibilities, a chart listing the amount of assessment
growth for Lake Minnetonka communities, an assessment fact sheet, and a book of sales with
photos and characteristics from a sample of sales throughout the city.
Summary of the 2005 Assessment
Each year estimated market values are analyzed along with data from the market.
Adjustments, as appropriate for each type of property are made. The results of those
adjustments for the 2005 assessment are as fellows:
. Residential Lakeshore + 11.9%
. Residential Off Lake + 6.7%
There are 3,016 taxable parcels in the city with a total market value of approximately
$1,415,168,000. This value includes $19,803,000 in new construction improvements. The
overall value increase for the City of Shore wood is 8.5%.
The County Board of Appeal and Equalization begins on June 13, 2005, application is
required no later than June 6, 2005. To appear before the County Board, you must have

The purpose of this local board meeting is to review the Estimated Market Value and Classification for the 2003
Assessment, which will be reflected in taxes payable for 2004.
Any questions regardi."lg the taxes payable in 2003 cannot be addressed atthis meeting because they are based on the
assessment made in 2002. This Board has no authority to act on the 2003 taxes as per MN statute, Sec. 274.01.
While we realize the MN Property Tax system is rather complicated and, at times, difficult to understand, it is hoped that
the following information will help you when trying to COmmunicate your questions and concerns with regard to your
property's market value.
State law requires that the value and classification of real estate be established as of January 2nd each year. Market values
are based on ~ales of properties within your market area. The Minnesota Department of Revenue requires the overall level
of assessment to be between 90% and 105% of market value. If the overall level of assessment is not at least 90%, the state
may impose an aggregate increase on all properties within a city or classification. If sales indicate the market values have
changed, the assessor must follow the trend indicated, whether it is to increase or decrease property values.
Mass appraisal is the method used by assessors to estimate the market value of properties. Each property is physically
viewed every four years. In addition, all new construction, alterations, or improvements will be appraised annually.
COMMONLY ASKED QUESTIONS AT BOARD OF APPEAL MEETINGS
1. IS IT ILLEGAL FOR THE ASSESSOR TO INCREASE MY VAL UE SO MUCH IN ONE YEAR?

No. The assessor must value property.at market value each year. Property values change continuously with
changing economic conditions. There is no limit as to the amount of increase or decrease in property values in a
gIVen year.
2, WHEN WILL THE VALUE INCREASES STOP?
This is impossible to predict. Our values are dictated by the market. If sale prices are increasing, our
estimated market values will increase. If sale prices are falling, then our estimated market values must follow
that trend.
3. WHAT DOES THE ASSESSOR LOOK AT TO DETERMINE A PROPERTY'S MARKET VALUE?
Each property is viewed to gather information on all characteristics that affect .its market value such as location,
size, age, quality of construction, amenities (i.e. walkout basements, fireplaces, and extra baths), and site
characteristics.
4. AS A HOMESTEADING RESIDENT, WILL I BE TAXElJ OFF MY PROPERTY, ESPECIALLY IF lAM
ON A LIMITED INCOME?

Homesteading residents are eligible for property tax breaks in Minnesota through the use of the Homestead
Classification. This decreases the property taxes on most residences. In addition to the Homestead Classification,
residents of Minnesota are eligible to apply for the Regular Property Tax Refund or the Special Property Tax
Refund. Both of these must beapphed for using the M - .1PR form issued by the State of Minnesota. The Regular
Refund is based on income,. so check the requirements stated.. on the form. You may qualify for the Special Refund
if your property taxes increased by more than 12% from 2002 to 2003 and the increase was $100 or more. There
are specific guidelines for 'tach refund, which are included with the instructions forthe M - IPR form

Open boak meetings are an alternative to' the Local Baard af Appeal and .
Equalization. During "apen boak" meetings, the valuatianand classificatian
issues are handled by the assessor's staffan a ane-an-ane basis with the
property owner. Typically, open baak meetings are held by the caunty assessar's
staff. However, larger cities with an appointed city assessar may hold their own
open book meetings.
Theapen baok meetings are held in lacations that are canvenient far property
awners. O~enopen book meetings are held over several days during both day
and evening hours" This allaws property awners to' .appeal when it hest suits their
schedules instead afhaving to' rearrange their schedules to' attend a local baard

Property owners dO' nat need to make an appointment to meet with the
assessment staff. They can simply show up at the dates and times stated an the
Notice of Valuation and .classificatian, and an appraiser will discuss their
assessment.
Depending an the jurisdictian, the appraisers may 'havelaptap camputers to'
access information about theta-xpayer's property. Some counties may be able to'
link directly to' their'camputer-assistedmass appraisal (CAMA) system which
allaws the appraiser to obtain data on sales af comparable properties.
When reviewing the details af the property with the owner, the appraiser can
verify the accuracyaf the caunty's data and correct any errors. The praperty
owner can alsO' schedule an appaintment far the appraiser to' view the property if
needed.

Benefits for the property owner
Property owners often find that the open book meeting IS less intimidating than
presenting their appeal to the Locai Board of Appeai and Equalization. They
often appreciate the fact that they can have their questions answered in a more
privatesetling, and not have to be apprehensive about making a presentation in
front of their friends and neighbors. In thisone-on-one setting, property owners
may spend as much time with the appraiser as they need. They can compare the
va'lue of their home with the values of similar homes owned by their neighbors,
The process is very efficient because concerns and questions are often resolved
immediately. Property owners can see that the appraiser collects the same
information on all properties, reassuring them that the process is the same for
e~eryone,and they have not been singled ouffor a va'lueincrease.
Property owners who are not satisfied with the "open book" approach may appeal
to the County Board of Appeal and Equa'fization andJor appeal to Tax Court.

than the number of appeals to the local board, the benefit fur the county is that
fhe open book process allows for immediate 'consideration of issues, and in many
