88-025 . . . ,~ RESOLUl'IOO" 00. 25-88 RESOLUl'ICN APPROVING AN Al\1ENllVIENr 'ID '!HE RESIDENrIAL SUBDIVISICN DEVELOH\1ENT AGREBV.IENr BRENIRIDGE WHEREAS, the City Counc il 0 f the Ci ty 0 f Shorewood, by it s Resolution No. 113-87 on 14 September , 1987:, approved the Final Plat of BRENIRIDGE and authori zed the Mayor and Ci tyC1erk to execute a Development Agreement on beha1 f of the City; and WHEREAS, such Development Agreement was duly executed by the Developer and the Ci ty on 2 February , 19~; and WHEREAS, the parties now wish to amend such Development Agreement temporarily limiting the development of such plat to a total of 19 sing1e-froni1y lots. N:JN, 1HEREFORE, BE IT RESOLVED by the City Council of the Ci ty of Shorewood as follows: 1. That the Amendment attached hereto amending the Residential Subdivision Development Agreement, Brentridge, dated 2 February , 1988, is hereby approved. - 2. That the Mayor and City Clerk are hereby authorized to execute said Amendment on beha1 f of the Ci ty Counci 1. 3. That this Resolution, together with the Amendment attached hereto, shall be filed and recorded within thirty (30) days of Developer's receipt of this Resolution. WHEREAS, a Development Agreement was made and entered into on the 2nd day of February , 1988, by and between the Ci ty of Shorewood, a Minnesota municipal corporation (hereinafter referred to as "Ci ty"), and Shorewood Oaks Development, Inc., a Minnesota corporation (hereinafter refereed to as "Developer"), for the development of certain lands into single fronily dwelling sites; and WHEREAS, said Agreement contemplated a development consisting of 24 single-fronily lots; and WHEREAS, the Metropolitan Waste Control Comnission (l\IMU::) has since detenuined that due to limited capacity of the sewer system, it will allow only 19 sewer connections to be made to the Shorewood sewer line which serves the Development at this time; and WHEREAS, Paragraph 1 of said Agreement provides for the development of lots within the plat pursuant to the Shorewood City Code; and WHEREAS, the parties therefore desire to modify and amend the tenus and conditions of said Agreement to accommodate said detenuination made byl\lMU:: limiting sewer connections within the plat to 19. IDV, 1HEREFORE, in consideration of the mutual covenants and guarantees contained herein, the City and the Developer agree as follows: That Paragraph 1 of that certain Development Agreement dated 2 February , 1988, between the Ci ty of Shorewood and Shorewood Oaks Development, Inc., is hereby amended to read as follows: 1. IDr DEVEWH\1ENT. Single fronily lots will be developed pursuant to the requirements of the R-1C Zoning District as contained in Shorewood City Code Section 1201.12. Such development shall be limited to a total of 19 single fronily lots until such time as the Lake Ann Interceptor sewer line has been completed by the l\IMU:: and is available to serve the plat, or until such other time as additional sewer connections to the Shorewood sewer line are approved by the J.\Ii\re.
