Agenda Item #3B:
Staffing - no action required
Agenda Item #3C: One additional Tree Service has applied for a license to provide tree
trimming service in the city. As all license requirements have been met, staff
recommends adoption of a resolution approving Tree Trimmer Licenses for 2005.
Agenda Item #3D: The Wells Fargo Bank is once again sponsoring a half marathon race that
begins in Wayzata and extends through Shorewood, ending in Excelsior. This year's race is
scheduled for the morning of Sunday, May 1. Approval requires a simple majority vote.

Agenda Item #3E: Senior Community Services, the agency that provides programming at the
Southshore Center and operates the dial-a-ride transit service for the South Lake
Minnetonka area, has historically received funds from the federal Community
Development Block Grant (CDBG) program administered through the Hennepin County
Consolidated Pool. It is requesting resolutions from the communities it serves, indicating
their support for Senior Community Services and its application for CDBG funding. The
Council has supported this request for the past several years. Such a resolution has been
prepared for Council adoption.
Agenda Item #3F: Mr. Michael Catain, owner of property at 4550 Enchanted Point, has
submitted a petition for local improvementinaccordance with the Minnesota State
Statute 429, He is requesting that the City perform an engineering analysis and
construction project to relocate a dry hydrant located in a utility easement on his
property. Mr. Catain wants the hydrant to be relocated outside of his property, and within
the public right-of-way of Enchanted Point. Staff is recommending approval ofa
resolution that declares adequacy of petition, in order to allow the preparation of
engineering reports and construction documents for relocation of the dry hydrant on the
subject property,

Agenda Item #3G: The Camp Coffee business, located at 19215 Highway 7, is under new
ownership and will have a new name. The new owner has applied for a permit to replace
the existing pylon sign. The proposed sign complies with the code and staff recommends
approval of the sign permit.
Agenda Item #3H: Mr. Tom Brausen has requested additional time to comply with a "Notice
to Remove" for his property at 25125 Glen Road. Staff recommends that the property
owner be given an additional 30 days to comply, after which the matter will be turned
over to the prosecuting attorney for legal action, without further notice.
Agenda Item #31: On May 24th, 2004, the Shorewood City Council adopted Resolution
04-049, granting a conditional use permit to Voice stream Minneapolis for the installation
of antennas on the SE Area Water Tower, located at 5500 Old Market Road. Staffhas
requested that KLM Engineering provide the technical inspections and welding .
certifications for this installation. Under the lease agreement executed with Voicestream, ..
the City shall be compensated for any and all costs that are directly attributable to the
Lessee's improvements. Staff is recommending that the proposal submitted by KLM
Engineering be accepted.
Agenda Item #6A: Due to recent legislation, amendments to fees associated with land use
regulation require a public hearing. Staff has analyzed the City expenses associated with
these applications as well as surveyed what other cities charge, and found our schedule in
need of update (it has been several years since many of these fees have been updated).
Enclosed in your packet is a revised fee schedule comparing current charges with those
proposed by staff. Council members should contact the Planning Director prior to
Monday night's meeting if they have any questions.
Agenda Item #7 A: A report on the February 8, 2005, Park Commission meeting and activities .
will be provided this evening by Larry Brown, City Engineer.
Agenda Item #7B: Mr. Ken Dallman, President of the Shorewood Parks Foundation,
appeared at the February 8t\ 2005, Park Commission meeting, to request approval of a
memorial sign for the Freeman Park Plaza. The Park Commission recommended approval
of the monument sign, as presented.
Agenda Item #9A: Minnetonka Community Education and Services (MCES) has requested
the City to appoint a member of its Council, professional staff or an active, interested
resident, to the MCES Advisory Council. (After the January 24 Council meeting, staff
confirmed that these persons are eligible for this position.) Tad Shaw of 5580 Shore
Road, has been the City's long-time representative to the MCES Advisory Board. Mr.
Shaw is willing to continue serving as the City's representative on the MCES Advisory
Council. Staff recommends Council adopt the resolution appointing the City's
representative the MCES Advisory Council.

Agenda Item #9B: The City Council has endorsed a two-part process to proceed with the
discussion and resolution of issues related to the SLMPD. The City of Excelsior
declined, and the SLMPD Coordinating has accepted, to include its payment of an
addition -$42,000 for services in 2005. The other three cities have OK'd going ahead
with the facilitated process without further conditions. As the terms have changed since
its last action, the Shorewood City Council needs to approve entering the facilitated
process without any other conditions. (The first meeting of the Issues Group, or whatever
its title will be, is planned for March 2.)

Agenda Item #9C: The City Council will have interviewed all candidates for the Planning
Commission at the special meeting held earlier in the evening. This item is on tonight's
agenda if Council wishes to make appointments (which may be timely, as the
commissioners' first meeting would be on March 1.) Council should adopt the
resolution making the appointments, or continue the item to the February 28 meeting.
Agenda Item #10A: City Staff is in receipt of an e-mail, dated February 10,2005, that serves
as an appeal for a decision regarding the seeking of compensation from the City for the
extension of a sanitary sewer service, constructed within the public right-of-way of
Charleston Circle. This service is to serve the newly constructed house at 5590
Charleston Circle.
Staff has provided the City Council with the appeal letter and invoice provided, and will
be forwarding an appropriate response under separate cover.

Agenda Item #10B: On December 2,2004, the City of Shorewood, hosted an open house/public
information meeting regarding safety and traffic concerns brought to the City Council's
attention in a petition from several residents along the roadway. Staff requested that
residents provide feedback prior to completion of the study. Their comments have been
received and incorporated into the report.
Mr. Chuck Rickart ofWSB and Associates, the City's consulting engineer firm, has
recommended establishment of eastbound, one-way traffic between Merry Lane and
Radisson Road entrance on a trial basis. This trial should be conducted over a minimum
nine-month period, from April to December. This will incorporate both school traffic,
recreational traffic, and the winter conditions along Radisson Road.
Mr. Rickart, will be at Monday night's City Council meeting to present the report.
Notices were sent out informing residents of the agenda item, and were notified that the
entire report is available on the City's web page for their review.

Mayor Love reviewed the Agenda for the meeting. Administrator Dawson requested A Discussion of
Alleged Cougar Sighting be placed as Item 2 on the Agenda for the evening. All other items would then
follow after that insertion.
Without objection from the Council, Mayor Love proceeded with the revised Agenda for the meeting.
2. A DISCUSSION OF ALLEGED COUGAR SIGHTING
Administrator Dawson thanked Bryan Leuth of the Minnesota Department of Natural Resources (DNR)
and South Lake Minnetonka Police Department Chief Bryan Litsey for appearing as part of the
discussion on the alleged sighting of a cougar by a resident.

Administrator Dawson explained there had been an alleged sighting of a cougar by a Shorewood resident
in the city in mid-December. This resident had contacted the DNR and been advised that by the
description of the eyes and head as described, the animal could have been a cougar. Since no further
description or sighting of the animal was available, the City had referred the DNR to work with the
SLMPD on the matter as these two agencies would be working together should any further sightings be
reported. Administrator Dawson also noted the City of Plymouth had provided information about how to
deal with such an issue within a municipality as a cougar had been sighted in that city approximately
seven to eight years ago.
Mayor Love stated he had spoken with the resident as well as three additional people regarding the
sighting. He noted all accounts revolved around a single sighting of the alleged animal.
Mr. Leuth explained this sighting had taken place in the vicinity of Silverwood Park near Old Market
Road. He went on to explain alleged sightings were fairly common with most cases resulting in a
sighting of another type of animal, such as a large house cat or dog. He also explained some cougar
sightings were linked to domesticated cougars that were out for a foray. He stated he did not want to
understate the potential risk of the situation; however, until there was substantiated evidence of such an
animal, either through a photo of a track or the animal itself, there was nothing further the DNR could do

to take action in this matter. He also went on to explain should suchan animal exist, a threshold of
public safety must be crossed. Injury to a person or livestock would be reason to take further action.
While he explained several scenarios for tracking such an animal, he noted there would a great expense
as well as issues of trespass if the animal were to be tracked with dogs. He also explained that, at this
point in time, the DNR had no reason to believe the animal sighted was a cougar as there was no
evidence to substantiate the description given by the resident. He suggested any additional sightings be
handled by calling 911 so that a report could be generated of the activity, and then the DNR could be
alerted as needed.
Chief Litsey explained information regarding the sighting as well as information regarding cougars in
general had been placed on the SLMPD web site with a link to the DNR website.
Mayor Love questioned what action residents should take if encountering a wild animal such as a cougar.
Mr. Leuth stated the action for dealing with a cougar would be the same as those to be taken in dealing
with any large wild animal, such as a bear. He stated it was important to first attempt to back away
slowly without turning and running as this could initiate a chase reaction by the animal. Then a person .
should attempt to appear larger than normal, and to yell, or make any other noise so that the animal knew
a person was near it. He noted wild animals, even cougars, were typically shy and given the chance to
escape would be much more willing to leave the situation than become aggressive.
In response to Mayor Love's question regarding reports of a cougar attacking a human, Mr. Leuth stated
there had been no attacks on a human in Minnesota or surrounding states; however, there had been an
attack several years ago on a human in California in a remote area. He also stated it was important to
remember that the chances of a person being hit while traveling to the grocery store in the local area were
greater than ever being attacked by a large animal in this area. He stated many times cases received a
great deal of attention because of the uniqueness of a situation.
Administrator Dawson stated there had been no additional reported sightings within the past six weeks.
After a brief discussion by Council, consensus indicated information would be made available to
residents via the City's newsletter, The Shore Report, as well as safety issues and tips about dealing with
wild animals would be posted on the City's website. .
On behalf of the Council, Mayor Love thanked Mr. Leuth and Chief Litsey for being present at this
meeting to discuss this issue.
3. ANNUAL APPOINTMENTS
Administrator Dawson explained each year Council made annual appointments to various liaison
positions for Commissions and Boards within the City, as well as other represented city positions such as
weed inspector. Council held a brief discussion regarding the positions and noted this matter would be
placed on the Regular City Council Agenda for this evening for approval.
4. WATER SYSTEM IMPROVEMENTS - BOND ISSUE
Engineer Brown provided historical information and made a visual presentation of several needed
improvements to the City's water system. He provided a brief description and potential cost for each
improvement and noted the 2005 Capital Improvement Plan (CIP) included a substantial project list. He
noted there were several facilities requiring substantial improvements, including reconstruction of the

Badger Well House, replacement of the well controls for the Arnesbury well, interconnection of the
W oodhaven well, implementation of a radio read meter system, Arnesbury well house building repair and
polyphosphate system, and inspection, cleaning, and painting of the interior and exterior of the Southeast
Area Water Tower. Total project costs contemplated were estimated to be $1,471,500.
After various questions of clarification by the Council, Finance Director Burton introduced Paul Donna of
Northland Securities, noting Mr. Donna had been asked to review the process for Council of municipal
bonding as it related to the financing of these improvements.
Mr. Donna presented two scenarios for municipal bonding, noting modifications could be made should city
revenues change over time.
In response to Councilmember Turgeon's question, Finance Director Burton stated the City had been
contemplating these improvements for several years as well as the necessary bond issue for such
improvements, thus, based on budgeted numbers for 2005, the potential for bonding had been included in
those rates. She also stated, as with any service, rates should be subject to review on an annual basis.
Engineer Brown also stated there were a number of capital expenditures with regard to the water system
that had not been included in this bond issue despite necessary implementation in the next few years.
Council indicated support for the projects and bonding issues as outlined by Engineer Brown and Mr.
Donna this evening. Further detailed information on these matters would be made available at a Regular
City Council meeting in the future.

4. MATTERS FROM THE FLOOR
John Garfunkel, 5665 Grant Lorenz Road, stated his pleasure to speak before the new City Council this
evening, as he represented thirteen past and present advisory Commissioners. He explained all parties
involved had submitted a letter to Council requesting reconsideration of the ward system of representation
as these residents were concerned it may not have been the right course of action for the City.
He then read the letter into the record. He stated these residents believed the amount of public education
and comment that took place prior to the Council's decision on this issue was inadequate. He also stated
these residents requested the issue be place upon the 2005 Work Plan for the current Council as they
believed a progressive, open government should not be afraid to question past decisions. He thanked the .
Council for its time this evening.
Mayor Love stated the letter presented was well written and held legitimate concerns. He stated while he
supported the ward system currently in place, he agreed it was always important to review issues at any
time.
Mr. Garfunkel stated the concerned residents responsible for the letter wanted to be certain all issues of
concern were put forward when considering the ward system, and they were also requesting an annual
review of the ward system of representation into the future as well. He stated he thought it important to
consider the fundamental need for the change, as well as the process itself. He further stated it was
extremely important to allow the community at large to provide input on the issue.
Mayor Love, without objection from Council, directed Staff to notify all thirteen residents of this item each
time it would be placed on the Agenda for Council review and consideration.

. REPORTS AND PRESENTATIONS
.
A. Sump Pump Surcharge - Ron Johnson
Administrator Dawson explained Mr. Ron Johnson, 5355 Shady Hills Circle, had requested a "First
Amendment Petition for 'Sump Pump Penalty' Hearing." The payment was due January 31 of each year
before surcharges would accrue, and Mr. Johnson had wished to address Council prior to that date. He
also stated the surcharge in Mr. Johnson's current utility bill was not in the amount certified as delinquent
in 2004. He also noted Staff had been enforcing the City's ordinance regarding sump pump surcharges,
and in the past, the Council had been consistent in applying its ordinance when Mr. Johnson had appealed
delinquent charges.
Mr. Johnson stated he had requested to be placed on the Agenda for this meeting so that the "new" Council
could review the situation regarding the sump pump "penalty". He stated he was not pursuing this issue
for naught as each time he had gone through the process new legal suits had developed. He requested
Council not take action this evening, but suggested that it discuss the matter in a future Executive Session.

He then shared his interpretations of his current sump pump surcharge situation for the Council, noting it
was important for this Council to review a brief he had submitted previously regarding this matter.
Specifically, he noted several communications regarding plans for construction near his property and his
interpretations of those communications.
Mayor Love stated he was unclear about how these interpretations impacted the surcharge issue. Mr.
Johnson stated the information presented related to an uncompensated taking with water being directed to
storm sewers and draining on his property. Mayor Love requested Mr. Johnson summarize his points
related to this matter, and Council would discuss this issue at an Executive Session meeting in the future.
Mr. Johnson stated drainage water was going to where excavation was taking place adjacent to his
property. He questioned whether Council had visited the site as there had been a fence placed on the site
without any notice.
Mayor Love stated Mr. Johnson's comments would be made part of the record on this matter.

PUBLIC HEARING
There were no public hearings scheduled for this meeting.
7. PARKS
A. Report on Park Commission Meeting Held January 11, 2005
Commissioner Westerlund reported on matters considered and actions taken at the January 11, 2005, Park
Commission Meeting (as detailed in the minutes of that meeting).
Councilmember Turgeon questioned the status of the wetland restoration project. Engineer Brown stated
the project was completely dependent on grant funding, and to date, none had been received. He went on to
explain Staff would continue to seek out grant opportunities and a report would be made at a later time.
. Mayor Love suggested, since the area was a potential regional ponding area, further grant opportunities be
explored with a regional ponding focus with the Minnehaha Creek Watershed District as well.
Commissioner Westerlund stated she believed there would certainly be opportunities for partnering with the
MCWD in this project. Engineer Brown stated the feasibility report for the project should be placed on the
Park Commission Work Program for 2005.
8. PLANNING

recent regular City Council meeting.

Director Nielsen explained the history of the case, noting Sharratt Design, representing Tom and Tina
Verburgt, was in the process of remodeling the home on the property located at 5310 Elmridge Circle. Part
of the remodeling project included the addition of a new attached garage on the southeast comer of the
house. The garage was designed with a storage area adjoining the garage that would technically be counted
as part of the dwelling. Since the owner had decided to make this space part of the garage, and since the
area of this space, added to the garage, exceeded 1200 square feet, the change required a conditional use
permit pursuant to Section 1201.03 Subd. 2.d.(4) of the Shorewood Zoning Code.
Director Nielsen went on to explain the property was zoned R-WS, Single-Family ResidentiallShoreland
and contained approximately 57,350 square feet in area. The garage was angled to conform to the shape of
the lot, currently contained 1200 square feet of area, and would be 1325 square feet of area with the
proposed change. The proposed home contained 2208 square feet on the main level alone, with even more
space on the second level.
With regard to analysis of the case, Director Nielsen stated the request complied with all criteria for a
conditional use permit. He noted the heavy vegetation on the site, thus, there was not a need for additional .
landscaping.
Council had no questions regarding this case.
Callies moved, Wellens seconded, Adopting RESOLUTION NO. 05-006, "A Resolution Granting a
Conditional Use Permit for Additional Accessory Space for Tom and Tina Verburgt, 5310 Elm Ridge
Circle." Motion passed 4/0.
9. GENERAL/NEW BUSINESS
A. Making Appointments to Certain Offices and Positions within the City of Shorewood
for the Year 2005
Administrator Dawson explained each year Council made annual appointments to various liaison positions
for Commissions and Boards within the City, as well as other represented city positions such as weed .
inspector. He then read through the list of positions and Councilmembers willing to accept each
appointment for the Year 2005. He further noted Council had agreed to remove a position for Liaison to
the Friends of the Southshore Senior Community Center from the list of appointments as anyone was
welcome to participate on this Board.
Wellens moved, Turgeon seconded, Adopting RESOLUTION NO. 05-007, "A Resolution Making
Appointments to Certain Offices and Positions within the City of Shorewood for the Year 2005,
subject to the condition that Item M. on the appointment list be stricken from the resolution granting
such appointments." Motion passed 4/0.
B. Making MCES, LMCC, and LMCD Board Representative Appointments
Administrator Dawson explained appointments of representatives to the Minnetonka Community Education
Services (MCES) Board, the Lake Minnetonka Communications Commission (LMCC), and the Lake
Minnetonka Conservation District (LMCD) were typically done in January of each year. The City had
advertised these volunteer board opportunities to residents, with the current representatives being the only
residents to express an interest in serving as representatives for the City to these Boards. The current

representatives were Tad Shaw, 5580 Shore Road, for the MCES Board; Patrick Hodapp, 26195
Shorewood Oaks Drive for the LMCC; and Tom Skramstad, current chair of the LMCD residing at 28020
Woodside Road.
He also noted the Minnetonka School District had reorganized Community Education and the MCES
Board, with some shift in representation to the Advisory Board being requested. Each of the candidates
had expressed an interest in continuing to serve on the respective Boards for the remainder of this year.
Councilmember Turgeon questioned the term of the appointments for each candidate, as she had believed
there was a specific requirement for either Councilmembers or Staff to participate on the MCES Advisory
Board as outlined by Minnetonka School District Staff in a previous presentation to Council earlier in the
year. Administrator Dawson stated he would check on this issue and report back at the next Regular City
Council meeting.

Council indicated consensus for continuation of representation for a one year term for each candidate.
Administrator Dawson clarified Patrick Hodapp would then be appointed to the LMCC for a one-year
term, as would Tom Skramstad for a one-year term to the LMCD. Council agreed.
Turgeon moved, Wellens seconded, Adopting RESOLUTION NO. 05-008, "A Resolution Making an
Appointment to the Lake Minnetonka Communications Commission." Motion passed 4/0.

C. South Lake Minnetonka Police Department (SLMPD) Issues

Administrator Dawson explained the SLMPD Operating Committee, comprised of the member cities city
administrators/managers had developed a process, supported by the SLMPD Coordinating Committee, that
would bring together representatives from each city to attempt to bring resolution to the long outstanding
SLMPD issues. He noted a facilitator would be hired to work through this process with local
representatives, and a second portion of the process included a suggestion that the City of Excelsior put
forth $42,500 to meet the funding requirements for the SLMPD Year 2005 Operating budget expenses.
Administrator Dawson reported the City of Excelsior had met in a Work Session meeting and indicated
support for the process but would not, however, put forth any additional monies for the year.
Mayor Love stated he had, through a number of informal conversations with Mayor Ruehl of Excelsior,
noted a sincere desire to bring all member cities together to work through resolution this year. He noted the
Joint Powers Agreement (JP A) would be part of the discussions with all municipalities to consider either
disillusionment options or how to improve relations to allow for only one level of service being funded and
supported for the SLMPD. He stated he remained optimistic as he had seen all parties interested in
resolution this year.
Councilmember Wellens stated he believed this discussion to be worthwhile, and he thought all member
cities should provide funding as specified in the JP A with one level of service being supported for the
SLMPD. Councilmember Callies agreed.

Administrator Dawson stated he had received word from the MCWD regarding bids on the Gideon Glen
project. . The bids for the project were within expected ranges so the project would be moving forward in
the near future.
B. Mayor & City Council
Mayor Love noted the next meetings of the SLMPD Coordinating Committee as well as the next Excelsior
Fire District Governing Board Committee meeting.
Councilmember Turgeon requested Engineer Brown explore options for restriping the roadway heading
northward on County Road 19 as the old striping had worn away and she had experienced several
occasions where northbound drivers were actually driving in the southbound lanes near the Gideon Glen
area. Engineer Brown stated he would do so.

A RESOLUTION APPROVING LICENSES FOR TREE TRIMMERS
WHEREAS, the Shorewood City Code Chapter 305 provides for the annual
licensing of tree trimmers in the City; and
WHEREAS, said Chapter provides that an applicant submit an application and
fulfill certain requirements concerning insurance coverage and pay a licensing fee; and
WHEREAS, the following applicant has satisfactorily completed this process and
has submitted the requirements for the issuance of a License for Tree Trimmer.

RE: A Motion Approving a Request to Allow the Wells Fargo Half Marathon to
Travene the City on Sunday, May 1, 2005
The annual Wells Fargo Half Marathon is scheduled for Sunday, May 2,2005. The attached
correspondence from Loretta Docken, Race Director, states that there will be no change to the
marathon route. A copy of the route map is attached.

The runners will remain on Cty. Rd. 19 until they enter the LRT in Excelsior near Beehrle Street.,
The runners are on the LRT for just a short time until they finish the race in Excelsior at the
Wells Fargo Bank. The race begins at 8:00 a.m., the first runners finish around 9:15 a.m., and
the last of the runners enter Excelsior around 11 :00 a.m.
Staff recommends Council approve the request to allow the marathon to traverse the City on
Sunday, May 1,2005.

A RESOLUTION SUPPORTING THE APPLICATION
BY SENIOR COMMUNITY SERVICES
FOR COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDING
FROM THE HENNEPIN COUNTY CONSOLIDATED POOL
WHEREAS, the City of Shorewood has supported services for its elderly and disabled
residents through Senior Community Services' programs at the Southshore Senior Community
Center with the allocation of Community Development Block Grant (CDBG) funds for many years;
and
WHEREAS, the City of Shorewood believes that the provision of services for these
residents is of great importance for residents of the City and of the South Lake Minnetonka
community, and therefore should be continued; and
WHEREAS, Senior Community Services is making application to the Hennepin County
Consolidated Pool for the continued funding in the next fiscal year,
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Shore wood that it
recommend to the Consolidated Pool Selection Committee that CDBG funding of Senior Community
Services for programming at the Southshore Senior Community Center be considered a high priority

Mr. Michael Catain is the property owner of 45 50 EnchantedPoint, as shown in Attachment 1.
Mr. Catain has submitted a petition for local improvement, in accordance with the Minnesota State
Statute 429, requesting that the City perform an engineering analysis and construction project to
relocate a dry hydrant that is located on the subject parcel via a utility easement. Attachment 2 is the
subject petition. Mr. Catain desires that the hydrant be relocated outside of his property, and within the
public right of way of Enchanted Point.

The City of Shorewooddoes not own or operate a municipal water system on Shady or Enchanted
Islands. As such, homes are served by private wells.
On February 28th, 1994, the City awarded contracts to construct three dry hydrant systems as a public
improvement project that was assessed to the benefiting property owners of Shady and Enchanted
Islands. Attachment 3 is Resolution 94-24, awarding the contract. Attachment 4 is a general site
location map for each of the systems.
The dry hydrant systems allow fire fighters to pump water from Lake Minnetonka. Quite simply, pipe
was extended into Lake Minnetonka to a depth that would support a fire flow, and a fire hydrant was
installed on the shore-side of the system. A fire truck simply hooks up the hose from the pump truck,
to the dry hydrant, to draw lake-water to fight a fire. The City accepted this project on August 8, 1995.
Each property owner on Shady and Enchanted Island was assessed for the improvement project.
The hydrant located on the Catain property is by way ofa recorded utility easement (refer to
Attachment 4). Mr. Catain is requesting that the hydrant be relocated offhis property, and to the
public right of way of Enchanted Point. Staff has reviewed the petition and site with the City of
Mound's Fire Chief, Greg Pedersen.

Chief Pedersen and Staffboth agree that relocation of the dry hydrant to the public right of way serves
the public's interest in that the hydrant will be more accessible, and will actually be located closer to a
greater number of structures. This is of particular concern since this project was assessed. Staff will
want to insure that relocation would not reduce the benefit to the surrounding property owners that the
original installation was predicated on.
While the proposed location of the hydrant is perceived as a benefit, the piping system that feeds the
hydrant will have to be lengthened. A longer length of pipe can result in a decrease of the volume of
flow. If significant, this would not serve the public's interest.
Therefore, Mr. Catain has agreed to petition the City to perform an initial flow test and engineering
analysis to determine if the relocated hydrant and resulting increase in pipe length will result in a
significant decrease in flow for fire protection. The petition further requests that the City undertake the
improvement (if found feasible) and assess all associated costs of the feasibility, construction and .
project costs to the subject property. Said petitioner waives the right to appeal the assessment
associated with this project.
Mr. Catain's Attorney has voiced some concerns regarding the petition, in that it appears to provide the
City free reign regarding the amount of the assessment to be levied. I have assured Mr. Catain's
Attorney that the City will provide a proposal for feasibility, construction, and engineering along the
way. Mr. Catain will have the right to stop the process at any time, and have the coststo that point
paid or levied to the subject property.
Recommendation
Staff is recommending approval of the attached resolution that declares the adequacy of petition for
relocation of a dry hydrant on 4550 Enchanted Point.

RECITALS

Grantors are the owners in fee simple of real property in the County of Hennepin,
Minnesota, which is legally described on Exhibit A attached hereto (the Easement Tract)
and depicted on Exhibit B attached hereto (Easement Sketch). Grantee desires to use a
portion of the Easement Tract for the construction and maintenance of certain utilities.
NOW, THEREFORE, in consideration of the sum of One Dollar ($1.00) and

Camp Coffee, located at 19215 State Highway 7, is changing ownership and the building
will now be occupied by Cafe Lettieri's. Sign Maintenance Lighting and Electric has
submitted plans and an application for new signagefor the new business. As shown on
Exhibit A, attached, the existing pylon sign in front of the. site will be slightly larger than
the one currently in place (61 square feet vs. 56 square feet). Alt.hough the illustration on
Exhibit B shows additional future wall signage, this is nofproposed with this application.
Presumably, the existing drive-thru sign and menu board that were previously approved
will remain in place.

Based on the size of the building (881 square-foot silhouette as viewed from Highway 7
and Vine Hill Road), the site is allowed a total of 88 square of signage. If the drive-thru
and menu board remain in place, the new sign will bring the total amount of signage to 77
square feet. This complies with the Zoning Code and approval of the freestanding sign is
recommended, subject to setback and height requirements.
Since commercial properties are allowed only three signs, the owner should be aware that
any future wall signs would necessitate the removal of one of the other signs on the
property. This would be addressed as a separate sign permit.

In response to neighborhood complaints, our office sent a "Notice to.~Remove" to Mr.
Tom Brausen at the above-referenced address (see Exhibit A, attached). Mr. Brausen has
now appealed for additional time to correct the violations (see Exhibit B). In his letter he
indicates his intentions to comply with City codes, but requests 30 to 60 additional days
to do so.

Since the Council routinely grants an extension of30 additional days for compliance,
provided the property owner is making a good faith effort to comply with the Code, staff
will reinspect the property prior to Monday night's meeting to check on progress.
Assuming the owner is making progress as of Monday, the extension of time is
recommended. Failure to comply with the extended deadline should result in legal action

RE: Accept Proposal for Professional Services; Construction Engineering by KLM
Engineering
On May 24th, 2004,. the Shorewood City Council adopted Resolution 04-049, granting a conditional
use permit to Voice stream Minneapolis for the installation of antennas on the SE Area Water Tower,
located at 5500 Old Market Road.
Staff has requested that KLM Engineering provide the technical inspections and welding certifications
for this installation. Under the lease agreement executed with V oicestream, the City shall be
compensated for any andall costs that are directlyattributableto the Lessee's improvements.
KLM's proposal is attached for the City Council's consideration.

KLM is pleased to submit this proposal to perform lease agreement review, engineering
review,.and welding and coating inspection during the antenna installation on the
elevated water tower in Shorewood, Minnesota.
Lease agreement review helps ensure that the owner's interests are protected, particularly
during periods of maintenance and repainting.
Engineering review assures that the proposed antenna and equipment attachments are
structurally sound, and identify inconsistencies or omissions pertinent to construction and
operation of the antenna facilities and maintenance of the tower. The review is intended
to protect the interests of the tower's owner prior to construction, by identifying and
eliminating elements of the proposed construction that are not in the owner's best
interests.

Part time inspection by an A WS Certified Welding Inspector during structural
modifications and a NACE Coating Inspector during surface preparation and coating
application assures that the work performed by the contractor is in conformance with the
specifications and will realize its intended operating life. KLM's inspector will monitor
workmanship during all phases of construction and approve the contractor's work.
The experience of KLM' s staff in water tower inspection has been enhanced by our
training as National Association of Corrosion Engineers (NACE) Certified Coatings
Inspectors and American Welding Society (AWS) Certified Welding Inspectors. This
training, plus the years of experience in abrasive blasting (surface preparation) painting,
rigging, welding, and inspecting, has given this company a competitive edge for
performing this type of work in a safe and professional manner.

KLM will perform an engineering review of the plans and specifications to determine
structural soundness of the proposed antenna attachments. Our experience in
construction and reconditioning inspection as well as in the design of water towers has
greatly enhanced our ability to recognize and correct unsatisfactory design principles.
KLM will send to the city our comments of the reviewed specifications and drawings.
At a minimum, the engineering review will include the following:
. Review of the proposed lease agreement
. Review of tower for ability to withstand any additional loadings from antennas
. Review of proposed antenna attachments for structural adequacy
. Review of proposed penetrations through tank and/ottower walls for structural
soundness
. Review of proposed surface preparation and coating
. Review for hazards andphysicalinterference/obstruction problems
. Inconsistencies and/or omissions in construction drawings pertinent to project
.
Installation Inspection
The inspector assigned to this project will be a NACE Trained Coating Inspector atld/or
A WS Certified Welding Inspector. All of our inspectors have extensive practical
experience and knowledge of water storage tank reconditioning and antenna installations.
They are experienced sandblasters, painters, climbers, riggers, coating inspectors, welders
and welding inspectors, which allows the inspector to perform inspections alongside the
contractor to ensure conformance to the project specification.
At a minimum, the field inspections will include the following:
. Monitoring and approval of the structural modifications for conformance to the plans
and specifications
. Inspection of welds
. Inspection ofthe abrasive blasting media and equipment for conformance to the
specifications and to prevent contamination of surfaces during surface preparation
with moisture and oil or other contaminants
. Monitoring the contractors mixing and application ofthe coatings for conformance to
the specifications, and the coating manufacturer's recommendations
. Approving surface preparation
. Monitor punch list items and subsequent corrective action by the contractor
. Final inspection, substantial completion, and project acceptance

From past experience, it is anticipated that at least two or three reviews will be required
before the proposed construction modifications shown on the plans are acceptable. The
engineering review will be performed in accordance to this proposal and our current Fee
Schedule on a Time and Materials Basis. Review costs typically range from $1,200 to
$1,600, but are dependent on the number of reviews required until an acceptable plan is
submitted. Fees for engineering review will be billed upon completion of the review.
Inspection Fees
The following fees are based on KLM performing inspections three (3) separate times;
once for inspection of welding, once for inspection of abrasive blasting and priming, and
once for final coating inspection and site restoration. However, more or fewer
inspections may be required in this case. The inspections will be performed in
accordance to this proposal and our current Fee Schedule on a Time and Materials Basis.
For new installations this can range from $1,000 to over $5,000.

Increases in scope of work, additi~nal reviews or inspections (such as inspection of shop
blasted and painted items) required or due to re-inspection of rejected work or materials,
or other additional inspections requested by the Owner and/or Contractor may result in
fees in excess of this estimate.
Owner Requirements
KLM requests that the owner provide approved drawings, specifications, schedule,
materials, welder's certifications, and a contact list.
Fees for inspection services will be billed following the final or punch list inspection.

KLM has attached our standard Terms and Conditions. The attached Terms and
Conditions are part ofthis agreement between the City of Shorewood and KLM
Engineering, Inc. unless otherwise agreed to in writing by both parties.

Time Frame
This proposal is valid for sixty (60) days. If the City of Shorewood finds this proposal
acceptable, please sign and return. When KLM receives the signed proposal, the city can
send KLM specifications and drawings to review. KLM will need to be notified by the
Owner or contractor a minimum of two days beforehand to schedule inspection times.

A number of the fees associated with planning, zoning and building have not been
updated for quite some time. Ordinarily, a new fee schedule for all of the various City
fees is adopted at the first of the year. Any fees associated with land use regulations
require a public hearing, which has been scheduled for next Monday night.

The City's fee schedule attempts to recover expenses associated with various types of
applications. Staffhas analyzed the following fees based upon staff time associated with
review and processing, out of pocket expenses (e.g. copying, mailing, publishing), and
follow-up (e.g. map changes, preparation of resolutions and publishing of amendments).
We also took into consideration what other cities of similar size and situation charge for
various applications. Based on these considerations the following fees are proposed:

Approval of Monument Sign - Freeman Park Plaza
Mr. Ken Dallman of theShorewood Parks Foundation appeared before the February 8th, 2005, Park
Commission meeting, to request approval of a memorial sign for the Freeman Park Plaza.
Attachment 1 is the site plan for the plaza. Attachment 2 is the proposed wording of the monument
sIgn.
Mr. Dallman described the plaque as a 12" x 18" plaque that will be permanently fastened to a large
rock. It is anticipated that the rock will be approximately 24-36 inches in height.
.
Staff mentioned that weight restrictions will be enforced, starting March 1, 2005 through April 30,
2005. The rock described may weigh upwards of 1,000 pounds. Since permits for weight restrictions
are not granted, the contractor will have to either locate the boulder prior to March 1 S\ or provide
transportation that will meet the restricted requirements.
.The Park Commission recommended approval of the monument sign, as presented.

SUBJECT: Appointment to MCES Advisory Council
This item has been continued from the January 24 Council meeting. Under the Minnetonka School
District's new structure for Community Education, each of the ten cities served by the District has
one position on the Advisory Council for Minnetonka Community Education and Services (MCES).
The Council requested clarification about who would qualify for the "City" position.
I spoke with Tim Litfin, Executive Director for MCES, and he confirmed what had been presented to
Council on January 24. While the District has a preference for a Councilor professional staff
member, an active, interested resident also qualifies.

Tad Shaw, 5580 Shore Road, the City's long-time representative to the former MCES Advisory
Board, has expressed a willingness to continue his service on the new Advisory Council.
City Council Action:
Staff recommends that the Council appoint a representative to the MCES Advisory Council
and adopt the resolution to formalize that appointment.

Revised Proposal for Process To Address SLMPD Issues

Council will recall that in late November the SLMPD Coordinating Committee put forth a two-part
proposal to work through member cities' issues regarding the SLMPD.
1) A facilitated process proposed by the Operating Committee (comprised of the city
manger/city administrators of the member cities); and
2) A "baseline" 2005 payment of $416,400 from Excelsior, plus a $26,159 supplemental
payment in 2005 from Excelsior, so that 'all member cities would be provide the same Tier II
service (which had been proposed earlier by Excelsior).
The Shorewood City Council approved this proposal at its December 13,2004, meeting.

In its actions during January, the Excelsior City Council indicated that it would approve (1) the
facilitated process, but not do (2) any payment above $400,000 for 2005. At its special meeting on
January 28, the Coordinating Committee believed that it was important to begin the facilitated
process, and believed it appropriate for Excelsior to receive Tier I service if it chose to do so.
On February 2, the Coordinating Committee authorized execution of a letter to engage the services of
a facilitator for the process, provided that all cities give any necessary final approvals. As the city
councils of Greenwood, Shorewood, and Tonka Bay had endorsed the two-part proposal-which
included the equal-share expenditures for facilitation services-it has been deemed necessary that the
city councils affirm what is now a single-component proposal. The Operating Committee's estimate
of expense is $10,000 - $11,000. As of this writing, all cities except Shorewood have done so.
RECOMMENDATION:
Staff recommends that the Council authorize proceeding with the facilitated process to address
the member cities' issues regarding the South Lake Minnetonka Police Department.

Appeal for Compensation for Sanitary Sewer Charges, 5'590 Charleston Grcle
Water Street Homes, Inc.
City Staff is in receipt of all. e-mail, dated February 10, 2005, that is to serve as an appeal for a decision
regarding the seeking of compensation from the City for the extension of a sanitary sewer service,
constructed within the public right of way of Charleston Circle. This service is to serve the newly
constructed home at 5590 Charleston Circle.
Timing of the letter has left City Staff unable to prepare a response, prior to the publication of the City
Council packet. However, the property owner is seeking a quick resolution to this matter to permit the
sale and closing on the property.

Therefore, Staff has provided the City Council with the appeal letter and invoice provided, and will be
forwarding an appropriate response under separate cover.

Dear Craig:
Water Street Homes constructed the home located at 5950 Charleston Circle for Jeff and Dawn Ackerson. As a
part of our job, we were to connect their home to the city sewer service.
.
In the Ackerson's purchasing the lot, they confirmed that the property had access to city sewer, and in our
customary work, we confirmed the location with the city engineering dept., and ordered the work to be performed
by Widmer Construction.
After digging to the street, Widmer was unable to locate the service anywhere near the location indicated by the
city staff. After further consultation with the city staff, we were given permission and instruction to: 1) dig into the
street, where the service was eventually found; 2) repair the street surface; 3) pay the contractor; and 4) the
owner would be able to submit an invoice to the city for reimbursement of the additional cost incurred.
Attached hereto is a copy of the invoice from Widmer Construction. On behalf of the owners, we hereby request
the City of Shorewood to reimburse the owners in the amount of $3,956.75. If a different form of request for
payment is required, please notify me of the process immediately.
I understand that staff may not have been authorized to represent that the city would reimburse us for the
expenditure, and made the statement in good faith. It is with the same good faith that we ordered the work, and
the same good faith I have in the council, if necessary, to do the right thing and authorize the expenditure. The
cost to correct inadequate work, not the fault of any party currently involved, should not be born by the Ackerson's
because: 1) they have paid the city for the sewer access; 2) doing so would deprive them of a benefit implicit with
the payment of assessments; 3) the work was performed in an efficient and economical manner; and 4) it's the
right and equitable thing to do.

Attachment 1 is a written appeal, to have the City of Shorewood participate in construction costs for
connection to the City's municipal sanitary sewer system for 5950 Charleston Circle. Attachment 2 is
. a supporting invoice for the appeal.
This written appeal was received just prior to publication of the City Council packet. As such, there
was not adequate time to put together a written report for the City Council, prior to distribution of the
packet. Therefore, this is being supplied to the City Council under a separate cover.
Background
.
The City of Shorewood, during the late 1986 and 1987 timeframe processed the preliminary and final
plat for what is known as "WCL Acres." This plat includes seven lots, as shown in Attachment 3. The
subject lot is denoted at Lot 2 of Block 1, on the referenced attachment.
Municipal sanitary sewer service was installed, as part of the plat, along with sanitary sewer services.
Services extend from the sewer main in the center of the road surface, to what is shown to be the edge
of the public right of way. This is consistent with current design standards. William Englehardt and
Associates, Inc. is the design engineer on record for the project.
During the construction of such systems, measurements are taken, as to the location and depth of the
sanitary sewer stubs at the property line, and at the centerline, before they are back-filled. This allows
contractors making the final connection from the service to the home, to locate the stub provided to
make the connection.

The engineer of record is responsible for showing these measurements (referred to as "service ties") on
the "asbuilt" drawings. These are provided to the City by the design engineer and become part of the
permanent utility records on file at the City.

Staff reviewed the plat file, and also found that sanitary sewer charges for all seven lots were paid on
September 14, 1987.
Lot 2 was never built upon, until 2004. Water Street Homes, obtained a permit for construction in
2004, and managed the construction project for Lot 2, Block 1. A single family home has been
constructed on the property.
During the construction process, the contractor requested a permit for connection to the sanitary sewer
service stub on record. Staff provided the service tie information to the contractor and granted a
permit to excavate within the public right of way, to make the connection.
On October 6,2004, the builder's plumber, Widmere Construction, attempted to locate the sanitary
sewer stub, based upon the measurements provided by the asbuilt drawings. However, the service was
not successfully located. Successive attempts were made on October 7, and 28th. On October 28th, the
sanitary sewer stub was located, not at the right of way line shown, but more towards the center of the
street. This necessitated excavation and restoration of a portion of the roadway.
Sanitary Sewer Ordinance
Section 904.08 BUILDING SEWERS AND CONNECTIONS; Sub. 4., Sub i. Connections to public
sewer states
(1) The connection of the building sewer into the public sewer shall be made at the "Y"
branch, if the branch is available, at a suitable location. If the public sewer is J 2 inches
in diameter or less and no properly located "Y" branch is available, the owner shall, at
his or her expense, install a "Y" branch in the public sewer at the location and manner
specified by the Sewer Inspector. Where the public sewer is greater than J 2 inches in
diameter and no properly located "Y" branch is available, a neat hole may be cut into
the public sewer to receive the building sewer with entry in the downstream directions
at an angle of about 45 degrees.
Per this ordinance, the property owner is responsible for the service stub to the sewer main in the
center of the roadway.
Having stated this, Staff misrepresented the code at the time of the permit. Staff was operating under
the premise, at the time of the permit that the sanitary sewer and municipal water utility ordinances
were in unison with each other.
Under the water ordinance, a property owner can receive credit for installation ofthat portion of the
service stub within the pubic right of way. It was only until such time, as Staff was to present a copy
of the sanitary sewer ordinance to Water Street Homes, that it was discovered that the ordinances for
sanitary sewer service do not provide credit for provisions for work within the public right of way.
Staff has determined that there are two such instances, where the code was misinterpreted.

Analysis
The appeal received can be broken down into two main points.
1. The sanitary sewer stub, provided on the record drawing, was not in the exact location, as provided
by the engineer of record to the City. Therefore, the builder has incurred additional expense in
locating the sanitary sewer stub along with the necessary restoration to the roadway. .
2. Staff misrepresented the ordinances for the sanitary sewer services at the time of the permit.
Staff has reviewed the information provided, and offers the following observations.
. The City is provided the service tie locations by the engineer of record. While the City provides
oversight inspection services, and in fact attempts to verify tie information provided, the engineer of
record is responsible for the accuracy of such service tie information.
Therefore, Staff does not believe the City can be found negligent for the error of the information
shown on the asbuilt drawings.
.
With regard to the misinterpretation of the ordinances:
This was clearly a mistake, in misrepresentation of the sanitary sewer ordinances. For that we
apologize.
.
Having stated this; if Staff had of provided the correct information regarding zero credit being offered
for work being completed within the public right of way, the result would have remained the same.
The builder would have still had to have their contractor locate the stub and make the connection, for
the new home to be served. While it was an honest mistake that was made, it has no bearing on the
work that would have had to be performed.
Therefore, Staff has declined the request by Mr. Rick Carlson, of Water Street Homes for
compensation by the City of Shorewood, in the amount of $3,956.75 for the extra costs incurred.
Mr. Carlson has asked that this decision be appealed to the City Council.

Dear Craig:
Water Street Homes constructed the home located at 5950 Charleston Circle for Jeff and Dawn
Ackerson. As a part of our job, we were to connect their home to the city sewer service.
In the Ackerson's purchasing the lot, they confirmed that the property had access to city sewer, and in
our customary work, we confirmed the location with the city engineering dept., and ordered the work
to be performed by Widmer Construction.
After digging to the street, Widmer was unable to locate the service anywhere near the location
indicated by the city staff. After further consultation with the city staff, we were given permission and
instruction to: 1) dig into the street, where the service was eventually found; 2) repair the street
surface; 3) pay the contractor; and 4) the owner would be able to submit an invoice to the city for
reimbursement of the additional cost incurred.
Attached hereto is a copy of the invoice from Widmer Construction. On behalf of the owners, we
hereby request the City of Shore wood to reimburse the owners in the amount of$3,956.75. Ifa
different form of request for payment is required, please notify me of the process immediately.
I understand that staff may not have been authorized to represent that the city would reimburse us for
the expenditure, and made the statement in good faith. It is with the same good faith that we ordered
the work, and the same good faith I have in the council, if necessary, to do the right thing and authorize
the expenditure. The cost to correct inadequate work, not the fault of any party currently involved,
should not be born by the Ackerson's because: 1) they have paid the city for the sewer access; 2) doing
so would deprive them of a benefit implicit with the payment of assessments; 3) the work was
performed in an efficient and economical manner; and 4) it's the right and equitable thing to do.

Recommendations for Traffic Changes to Radisson Road
On December 2,2004, the City of Shorewood, hosted an open house/public information meeting
regarding safety and traffic concerns that have been brought to the City Councils attention, by way of a
petition from several residents along the roadway. This meeting was well attended by many of the
residents of the area.
.
Mr. Chuck Rickart, of WSB and Associates, presented four alternatives to assist the City and the
neighborhood in evaluating what changes may be feasible from a cost and engineering viewpoint.
Many comments were received during the meeting. Similarly, Staff invited residents to continue to
submit written comments or e-mails to be incorporated into the study. Comments have been
incorporated, with the bound report being included in the City Council packet.
Staffhas excerpted the final conclusion of the report as follows:
Based on the TrafficAnalysis, Alternative Analysis and public input, the following conclusions can be
made:

. The primary issues related to the Radisson Road project are the safety of the roadway
and cut-through traffic on the roadway.
. The Traffic Analysis indicated that, although the traffic volume during the AM and PM
peak hours is quite low (106 vehicles inthe AM and 119 in the PM). There is a cut-
through issue ranging from 30% in the AM peak hour to 68~ in the PM peak hOUl:,
. Four alternatives were analyzed as part of the study. The public consensus on each
alternative is listed below:

1. Alternative 1 - ReconstructionlWiden Street - Not a good option.
2. Alternative 2 - Signing and Striping Improvements - May help.
3. Alternative 3 - Close Street Access - Good alternative, but may have additional
impacts to other neighborhoods.
4. Alternative 4 - One-Way Street - Good alternative.
Base on the above conclusions the following recommendation is offered:
1. On a trial basis create an eastbound, one-way between Merry Lane and Radisson Road
entrance. This trial should be conducted over a minimum nine-month period from April to
December. This will incorporate both school traffic, recreational traffic and the wint.
conditions along Radisson Road.
2. During the trial, monitor pedestrian traffic to determine impacts and potential solutions.
3. Improve the signing along Radisson Road, specifically at horizontal and/or vertical curves
that do not meet typical design speeds (25 M.P.R.).
4. Conduct a second public meeting in late June to discuss the outcome of the trial and signing
improvements.
Mr. Chuck Rickart, ofWSB and Associates, will be at Monday night's City Council meeting to present
the report. Notices were sent out informing residents of the agenda item, and were notified that the
entire report is available on the City's web page for their review.
Staff is in agreement with Mr. Rickart's recommendation for a one -way designation of Radisson Roa.

I. INTRODUCTION I BACKGROUND
The Shorewood City Council has identified a concern with the safety and operation of traffic on
Radisson Road between Christmas Lake Road and Old Market Road on the north side of
Christmas Lake. Figure 1 shows the project location.
Several residents along the corridor have raised specific concerns relating to the roadway. These
concerns include the following:
. Cut-through traffic on the road has continued to increase over the past several years. It
appears that this cut-through traffic is primarily students from the high school using
Radisson Road as a shortcut to avoid the signals on TH 7.
. The roadway is very narrow, with many substandard curves and poor alignment. There
are several locations along the roadway where retaining walls are continually being hit.
Based on these primary concerns/issues, the City Council directed WSB & Associates, Inc. to
prepare a study to evaluate the safety and operation of Radisson Road between Christmas Lake
Road and Old Market Road.
Contained in this report is a traffic analysis of the cut-through traffic on the roadway,
development and analysis of alternatives for improvement to the operation and safety, and
conclusions and recommendations for possible improvements.

II. TRAFFIC ANALYSIS
To address the concerns about the number of vehicles using Radisson Road instead ofTH 7 to
make through trips between Christmas Lake Road and Old Market Road and/or Vine Hill road, a
survey was conducted to document the traffic volumes and pass through trips during the AM and
PM peak periods. This was accomplished by performing a vehicle license plate survey at the
intersections of Radisson Road with Christmas Lake Road and Covington Road on Thursday,
February 12, 2004. The morning survey was conducted between 6:00 and 10:00 AM; the
evening was surveyed between 2:30 and 6:30 PM.
Analysis Tabulation
Table 1 documents the information gathered for analysis during the survey. The table is divided
into three parts under three major headings:
. The west recording station located at Christmas Lake Road
. The east station at the intersection of Covington Road and the TH 7 south frontage road
. Vehicle match
Each of the two station headings is broken down into several data columns. The first column is a
number that identifies each vehicle passing through the station using consecutive numbers for the
survey. The second column under the east station (Covington Road) indicates theID numbers of
the vehicles that match those that were recorded at the west station (Christmas Lake Road). A
similar column is not included under the west station.
A vehicle license number was entered in the next column for both stations. Note that these
numbers do not have a uniform format as truck and bus license numbers as well as vanity plates,
conservation plates, licenses from other states, etc., use a variety of formats that may differ from
Minnesota's common three letters and three numerals (or vice versa). Those plate numbers that
were recorded at both stations (presumably through trips) have been shaded as follows:
Eastbound vehicles originating at the west station
_ Westbound vehicles originating at the east station
An eastbound or westbound direction for each vehicle passing through the stations was entered
in the next column and the time of day in the next. The east station includes two columns
indicating by an "X" whether eastbound vehicles passing through the station continued on
Covington Road or the TH 7 frontage road, or which of those two roads was the origin for
westbound vehicles. Shading as indicated above has been used to highlight the through trips in
those two columns.
Time of day for each vehicle passing through is indicated in the next column for each station.
An "X" in one or the other of the next two columns indicates AM or PM.

Comments, either provided by the station observers or those potentially pertinent to the analysis,
are noted in the "Remarks" columns for both the east and west stations.
An "X" has been placed in one of the three "Match" columns for each vehicle recorded at both
stations (through trips) as follows. The "X" entries are red or green corresponding to the

. The "Possible" match column indicates that even though a match was found, either the
elapsed time was sufficiently long enough to presume that a stop was made somewhere in
the neighborhood before passing through the second station; or the license numbers,
though indicating the possibility of actually being the same, had too many differences to
give much certainty to a match. (It should be noted that when several closely spaced
vehicles are approaching a station, the observer has very little time to read and record
each license number. Furthermore, dirty plates are a common problem, particularly at this
time of year. There is no opportunity to check what was recorded and accuracy can be
com-promised at times. This is further discussed in the discussion of the next column.)
Where a possibility of a match has been determined to be particularly remote - even
though it has been recorded, a question mark rather than an "X" has been placed in this
column. In one case in this survey, the elapsed time between stations was 96 minutes.
(Through trips generally took two to four minutes.) It can be assumed that legitimate
stops were made within the area for those through trips with long durations.
. The "Likely" column indicates those matches that are quite probable although there is
some discrepancy in the plate number recorded at each station, e.g., it is possible that a
transposition has occurred in one ofthe numbers or, in the case of one observer reading
out loud while another records, a misunderstanding occurs such as the letter "A" being
heard as the number "8." Office misreading of hurriedly written observation recordings
can also occur.
. The "Exact" column was checked when there were exact matches between plates
observed at both the east and west stations and no time discrepancies were noted.

Conclusions
The analysis indicates that there are a relatively large number of through trips on Radisson Road,
ranging from 29% to 68%. The latter is associated with the number of westbound through trips
at Christmas Lake Road in the PM peak. The largest number of through trips in one direction is
34 westbound trips in the PM peak. Overall, a total of 88 through trips were observed over both
peaks out of a total volume of 180 trips passing the westerly station and 225 passing the easterly
station. These numbers could be considered higher than what might be expected for traffic using
lower level streets to bypass major arterials.
The through trips in both directions were somewhat evenly divided between those arriving or
departing the split at the Covington Road/TH 7 south frontage road. This finding would tend to
lessen the presumption that most of through traffic is related to Minnetonka High School. It
could also be said that there is some legitimacy associated with the Covington Road through trips
as the use of Radisson Road reduces the distance from TH 7 to the Covington Road intersection
with Vine Hill Road.

III. ALTERNATIVES
A. Development
Alternatives were developed for each specific issue identified in the introduction. The
alternatives which have been developed address the cut-through traffic and safety issues related
to the roadway. Each alternative is discussed below:
Safety Alternatives
1. Reconstruction/Widen Street: This alternative provides for the
realignment/reconstruction of the roadway from approximately 1,000 feet east of
Christmas Lake Road to Covington Road. Figure 2 shows the proposed alternative.
The reconstruction/realignment of Radisson Road would include improving the roadway
to a low speed urban design. The design speed would be 20 mph for both horizontal and
vertical curves. The roadway width would be 25 feet from face-of-curb to face-of-curb.
Several retaining walls would be required along the alignment in order to meet design
standards. In addition, a storm sewer system and water quality pond would be required.
2. Signing and Striping Improvements: This alternative involves additional signing and
striping on the existing roadway maintains the existing geometrics. Figure 3 shows this
proposed alternative.
Currently, no roadway striping exists from approximately 1,000 feet east of Christmas
Lake Road to Covington Road. It would be proposed that a center yellow skip stripe be
provided to help delineate the roadway lanes. Several of the existing curves do not have
adequate signing. Curve signs would be installed with a 15 mph advisory speed limit. In
addition, a "No Through Traffic" sign should be installed at either end of the roadway to
help discourage the cut through traffic.
Cut-throul!h Traffic Alternatives
3. Close Street Access: This alternative would close the roadway to through traffic at
Covington Road from Old Market Road via Broms Boulevard. Figure 4 shows this
proposed alternative.
One of the primary concerns with the cut through traffic was the traffic from the high
school cutting through the area. This alternative would help discourage cut-through
traffic by disconnecting the through connection from Old Market Road to Covington
RoadlRadisson Road via Broms Boulevard. Traffic would then need to use Old Market
Road one-half mile south to the intersection of Covington Road to access Radisson Road.
4. One-Way Street: This alternative would create an eastbound one-way street for traffic
on Radisson Road from Merry Lane to Radisson entrance. Figure 5 shows this proposed
alternative.

Based on the traffic analysis, a significant westbound cut-through traffic movement was
identified. This alternative would create an eastbound one-way between Merry Lane and
Radisson entrance. Additional signing would be needed to identify and alert motorists
that this is no longer a through street for westbound traffic. In addition, traffic would
improve on this segment of roadway as a result of eliminating the westbound movement
and providing extra pavement width for eastbound traffic.
B. Alternative Costs
The anticipated construction costs for each alternative are shown in Table 2 below. These costs
do not include right-of-way acquisition if required.

IV. PUBLIC INPUT I COMMENTS
A Public Information Open House was held on Thursday, December 3,2004, from 5:30 to 8:00
p.m. The purpose of the open house was to receive input from the public on the draft safety and
operation study for Radisson Road. There were approximately 30 people in attendance at the
meeting.
The format of the meeting included an open house/general discussion with the alternative maps
available for people to look at and gather information. A short presentation with questions and
answers followed the general open house.
There were several good comments and suggestions from the people in attendance at the public
meeting. The summary of the comment cards received and the sign-up sheet is included in the
Appendix. The summary includes comment cards received at the meeting and others received
following the meeting.
Comments from the public included:
. Do nothing. Improvement attracts traffic.
. Install speed bumps along Radisson Road.
. Concurrence with the one-way street (Alternative 4) and street closing (Alternative 3)
options.
. Concurrence that widening ofthe road was not feasible.
. Addition of pedestrian accommodations.
. Conducting a trial to see if the one-way or street closure would work.
In addition, comments were received in a memo for Mr. Dennis Jabs dated December 1,2004.
This memo is included in the Appendix. He prefers Alternative 3, closing the street access.

V. CONCLUSIONS I RECOMMENDATIONS
Based on the Traffic Analysis, Alternative Analysis and public input, the following conclusions
can be made:
. The primary issues related to the Radisson Road proj ect are the safety of the roadway and
cut-through traffic on the roadway.
. The Traffic Analysis indicated that, although the traffic volume during the AM and PM peak
hours is quite low (106 vehicles in the AM and 119 in the PM). There is a cut-through issue
ranging from 30% in the AM peak hour to 68% in the PM peak hour.
. Four alternatives were analyzed as part of the study. The public consensus on each
alternative is listed below:
1. Alternative 1 - Reconstruction/Widen Street - Not a good option.
2. Alternative 2 - Signing and Striping Improvements - May help.
3. Alternative 3 - Close Street Access - Good alternative, but may have additional impacts
to other neighborhoods.
4. Alternative 4 - One-Way Street - Good alternative.
Base on the above conclusions the following recommendation is offered:
1. On a trial basis create an eastbound, one-way between Merry Lane and Radisson Road
entrance. This trial should be conducted over a minimum nine-month period from April
to December. This will incorporate both school traffic, recreational traffic and the winter
conditions along Radisson Road.
2. During the trial, monitor pedestrian traffic to determine impacts and potential solutions.
3. Improve the signing along Radisson Road, specifically at horizontal and/or vertical
curves that do not meet typical design speeds (25 M.P.H.).
4. Conduct a second public meeting in late June to discuss the outcome of the trial and
signing improvements.

Comments
After reviewing the costs, safety record, and pro's & con's, I would recommend
making no changes.
Option #3, closing street access, appears to be best solution if it reduces cut-through
traffic. Suggest temporary barricade to close street and then re-assess effectiveness
before choosing as permanent solution. Temporary barricade is inexpensive and
may also be long-term solution (just like barricades at the Mpls.-St. Paul airport).
One-way option compromises school bus routes and would be problematic with
school district.
I like the idea of trying Radisson as a one-way. It may not cut out the cut-throughs
both ways, but it would one way. Also, it would make traveling the road generally
safer by automatically widening for traffic.
Alternative 4 will inconvenience me, but it is the best option. It will mean that
getting to Excelsior will be more difficult. A walking path, especially by Petersons
& Jabs, would be wonderful.
I do not like the idea ofa one-way street going east. You still have eastbound traffic
going through and I am not sure it will improve safety that much. I feel the safety
issue is a bit overblown. Everyone slows at Peterson's comer because it is so
narrow. There is no way to make any road accident-free or guarantee no risk. I
would rather see the closed street access alternative than the one-way road. If the
one-way option is chosen, I would prefer westbound.
A. Speed bumps would maybe help.
1) Slow them down.
2) Discourage drivers not living on road from using it as a "cut through"
short cut away from Highway 7.
B. I don't mind the so-called "crappy road." I'm not in a hurry to "tear through"
my own neighborhood.
C. The dumbest thing would be to make it one-way, either way!
D. My final suggestion is to leave it alone, put up some signs "No Through
Traffic" and enforce it.
E. Close the connection to Radisson Road.
F. Unless we get tort reform, you can be sued for a blind curve ... unless you have
signage?
We strongly feel that the road should carry the historical name of Radisson Inn
Road, which has always been its name. A couple of years ago, I researched the early
days of Christmas Lake, the history of the Radisson Inn, which was a special
destination for people, and other historical facts about the lake, its early yachting
club, the 1965 tornado, etc. There is a Radisson Road nearby, I believe, in the
Forest Hills area near Hopkins. Our mail has gone that route before arriving at our
home. Also, it is confusing to visitors and delivery people to have the sign on the
west end read "Radisson Road" and the sign on the other end read "Radisson Inn
Road." Radisson Inn Road has historical importance.
We appreciate your study of this issue. We have 5 children, ages 6-18, so we have
one older son who drives the street and younger children who play near the street.
So we have strong concerns about safety. After reviewing all the options, we are in
favor ofleaving things as they are. None of the options seems to guarantee slower
cars or less traffic, and they all seem to place a major burden on residents in terms of
inconvenience.

road half way - Radisson Entrance Road. This would definitely eliminate cut-
through traffic from both directions and decrease traffic overall. There is already a
natural turnaround by either backing into Radisson Entrance or going all the way
down to the end of Radisson Entrance to turn around.

The concern regarding a long cul-de-sac does not seem more significant than the
already very long distance between Christmas Lake Road / Radisson Road and
Covington Road/Old Market Road if Brom is closed off to make a I-way. Isn't
Christmas Lake Road up to Brand Circle essentially a long cul-de-sac? There are
safety considerations in addition to emergency vehicle access that need to be

Felt the study did not address most needs of citizens, especially pedestrians.
Radisson Road is used as a circumference road by many people living 2 miles in any
direction of the lake walking/running and as a bile trail access to the Hennepin
County Trail in Excelsior. People coming from Near Mountain, Sweetwater and
Lake Lucy Road and Co. Rd. 41 use this as a recreational trail, routinely even in the
winter months. The one-way direction failed to take into account that our 3 schools,
Excelsior-Elementary and MMW -middleschool are west and Charten School in
Chaska. Not to mention the town of Excelsior, dentists, library, etc. This road was
temporarily one-way during construction. Instead of 1/10 of a mile to access the
highway (west), we had to go nearly 1 mile east on a very compromised road to
access the highway and then back west. Five to 7 minutes versus 15 to 20 minutes
to access the highway. Way too much of an inconvenience! We live right on the
frontage road.

Would like to see (1) study blocking Broms Road temporarily with another study for
cut-through traffic occurring well after it becomes known that this access is not
available.

More 2 to 3 weeks Ix each traffic control police enforcing speed limit. If this did
not work out, then another plan not studied by the consultants to City could be
suggested - blocking or a dead end with a cul-de-sac at Radisson Entrance. This,
while not ideal, would still allow emergency vehicles to enter from both directions.
(Example is the end of Christmas Lake Road as it enters or would connect to Mill
Street.) Blocking or dead ending at this point is defmitely more 1/2 way for
residents between Christmas Lake Road and Brom Road.

Analysis of Alternatives (AoA). I attended the information meeting held on 12/2/04
and offer the following comments.

Do not consider this as a viable alternative. It is cost prohibitive. Further,
completion of this alternative does not suggest that the problem would be fixed. In
fact, this may only exacerbate the problem by providing a more inviting alternative
to Hi 7.

Alternative 2: Signage
If this alternative will provide the police with better enforcement opportunities, then
this would be a good alternative. The impact of this option, we suspect, will
diminish with time. People will become used to the signs and ignore them.

Alternative 3: Close Street Access
This is an attractive alternative. This allows exiting our home either to the east or
the west. Our normal pattern would be to exit to the west which would be no
problem. The impact to the affected neighborhoods needs to be examined carefully.
This will have a significant increase in traffic for at least two neighborhoods.

Alternative 4: One-way (East)
My main concern with this alternative is the winter driving during or right after a
storm or wet snowfall. I leave for work around 6 AM and am very concerned about
going up the hill. Shorewood does a good job with the streets during the storm, but
this is early in the morning to feel the full affects of recovery after a storm. My
normal route has been to go west to the Christmas Lake lights and this works very
well during winter inclement weather. If the road to the east is plowed and salted
suffIciently early in the morning this would also be workable.

One-way (West)
My main concern with this is also related to winter. I live at 20820 and have a bad
winter driveway. During winter storms, the only way I have a chance of making it
up my driveway is to take a run starting at Tiffany Lane. The person that plows our
driveway lives close and does a good job, but he is not always able to get to it by the
time I return home. Even with the driveway plowed, we rarely try to drive up the
driveway in the winter coming from the east of the driveway. If the decision were to
have a one-way to the west, we would appreciate help in understanding how to
manage the "winter" issue.

our road with the one-way west road.

Suggestions:
Several suggestions.
1. If the police would try saturation patrol on Radisson Inn Rd. during peak
traffic times and when the cut-through traffIc is at a peak, we suspect that
this will be a real deterrent. This could be instituted quickly while other
alternatives are reviewed.
2. All alternatives need to be examined in the context of winter driving.
3. All alternatives need to be examined from driveway access to trucks, e.g.,
delivery vehicles, garbage and recycling traffIc.
4. All alternatives need to be examined from the impact to school busses.
5. One-way traffIc could be a very critical problem between Tiffany Lane and
Christmas Point Road - the sight lines are not good in the best of conditions, winter
only magnifIes the sight issues (from the East for Tiffany Lane and from both ways
on Christmas Point Road). There are three very diffIcult driveways between these
two roads which also create and experience issues with sight lines in ALL weather
conditions.
Biggest safety concern is protecting countless citizens that walk daily around lake!

Sorry I'm out of town until Friday and cannot attend the Radisson Road meeting set for tomorrow.
However, I have the following comments based on a review of the information you sent me on November
5, 2004. Please accept these comments as part of the record for the December 2, 2004 meeting.
Alternative 1 - Reconstruct / Widen Road
Cost: $2.000.000
Pros:
1. Safer for high traffic volume.
Cons:
1. This alternative would change Radisson Road from a residential street to a collector / frontage
road for Highway 7. Traffic volume would increase. The speed of traffic would increase.
2. The character of the neighborhood would change from residential to freeway.
3. House set backs would be at issue. Many homes are within feet of the road right of way.
4. The $2,000,000 price tag is the most expensive alternative.
5. Additional cost may be needed for sidewalks (similar to Old Market Road) due to the increased
traffic.
Comments:
This alternative costs too much anq would have an overall negative impact on the neighborhood.
Alternative 2 - Sianina and Stripina Improvements
Cost: $60.000
Pros:
1. Traffic will be better informed as to the centerline of the road and speed limit.
Cons:
1. Ineffective in reducing traffic volume. Does not address the severity of safety hazards present.
2. Does not address the substandard aspects of the exiting road.
3. Enforcement.
4. Radisson Road would continue to be used as a frontage road for Highway 7.
Comments:
This alternative does little to solve the traffic volume and does not address the substandard aspect of the
road.

Alternative 3 - Close Street Access
Cost: $180.000
Pros:
1. This alternative transforms Radisson Road from a substandard Highway 7 frontage road /
collector road back to its original purpose as a residential road built to serve the immediate
surrounding residential neighborhood.
2. Traffic volume would significantly be reduced negating the need for major additional road
improvements.
3. The character of the neighborhood would remain residential.
4. Nominal cost.
5. Potential benefit to adjacent park to claim vacated roadway land.
6. Consistent with good road planning principles. This alternative forces traffic either to Highway 7
or Old Market Road (which is built to a collector road standard). Radisson Road is substandard
even for residential use and eliminating its use as a Highway 7 frontage road / collector road
improves safety.
Cons:
1. Neighbors in the immediate area will have to travel further to get to Highway 7 via Old Market
Road. Note there are only a few homes this will affect.
2. Does not address the substandard aspects of the exiting road.
Comments:
This is my most favored alternative.
The road to be closed is the primary reason for the high volume of traffic from outside the neighborhood.
It serves as a shortcut, transforming Radisson Road into a frontage road for Highway 7. My observation
is that significant traffic on Radisson Road is from traffic frequently the Holiday gas station and shopping
center, the high school and traffic from Highway 7 when it get backed up due to congestion. Radisson
Road should only serve as local access for residents in the neighborhood.
It may be advantageous to relocate the cemetery entrance to the cui de sac after the road closing. This
would allow access to the cemetery without cutting through residential areas. The cemetery would
benefit by having direct access to the cemetery via collector roads and the neighborhood would benefit
by not having cemetery procession traffic.

Alternative 4 - Onewav Street
Cost: $40,000
Pros:
1. This alternative transforms Radisson Road from a substandard Highway 7 frontage road /
collector road back to its original purpose as a residential road built to serve the immediate
surrounding residential neighborhood.
2. Traffic volume would significantly be reduced negating the need for major additional road
improvements.
3. The character of the neighborhood would remain residential.
4. Nominal cost.
Cons:
1. Radisson Road serves the community around Christmas Lake. The proposed one-way road
configuration disrupts the continuity of the neighborhood that has existed for many years.
2. Travel to neighbors in the opposite direction of the one-way causes one to travel several miles
and onto Highway 7. This is detrimental to the neighborhood.
3. Does not address the substandard aspects of the exiting road.
Comments:
This alternative accomplishes the goal of eliminating traffic that rightly belongs on Highway 7 and
surrounding collector roads. However it disrupts the existing neighborhood community by creating long
and circuitous travel for the neighbors. Neighborhood traffic would need to go onto Highway 7 to visit
neighbors located a few homes away in the wrong direction of the one-way road.

Final Recommendations
The major problem for Radisson Road is the high volume of non-neighborhood traffic on this substandard
residential road.
I recommend Alternative 3 - Close Street Access because it would significantly reduce the traffic volume
and be the least disruptive to the Christmas Lake community and the existing neighborhood traffic flow.
Only Alternative 1 - Reconstruct / Widen Street addresses the problem that Radisson Road is dangerous
because it is of substandard design and construction. I recommend that in addition to any of the other
alternatives an amendment be made to improve portions of Radisson Road associated with areas of
extreme deficiencies which make the road dangerous.
For example, my residence is located on a blind corner. Not only is the corner blind but the width of the
road is dangerously narrow. Due to the blind corner, I'm not able to safely use an attached garage on my
residence located near the road. Further, due to the road's narrowness, trucks and buses frequently hit
the retaining wall along my property, creating property damage. This area of Radisson Road is obviously
a safety hazard and could be remedied by realigning the road to the north, where the city already owns
considerable land along the Radisson Road right of way. In my opinion this blind corner is one of the
most dangerous areas of Radisson Road and could inexpensively be remedied because Shorewood
already owns land on the north side of the road and to the east of the blind corner.
