88-019 RESOLUTION NO. J 1 ,. j 0 . A RESOLUTION GRANTING A CONDITIONAL USE PERMIT ~~ WHEREAS. on 9 June 1975. the Shorewood City Council granted a nonconforming use permit to Mr. Charles Crepeau to operate a fresh fruit and vegetable sales outlet (known as the Garden Patch) at 23425 Smithtown Road for a period not to exceed 10 years; and WHEREAS. Mr. Crepeau wishes to continue operation of the Garden Patch on a permanent basis; and WHEREAS. in order to maintain the Garden Patch as a permanent land use. Mr. Crepeau must bring his entire property. including Crepeau Docks. into conformity with the requirements of the C-4. Commercial Service District; and WHEREAS. in order to bring the property into conformity with the C-4 District. Mr. Crepeau has applied for conditional use permits (C.U.P.'s) for the following activities: 1. Open and outdoor storage as an accessory use. 2. Open or outdoor service. sale. rental and display as an accessory use. 3. Fabrication (cutting. assembly. and/or welding) of wood or metal products only when accessory to an activity allowed as a permitted use or conditional use within the C-4 District; and WHEREAS. the Shorewood Planning Commission held public hearings to consider the applicant's request on 6 August 1985 and again on 1 March 1988; and WHEREAS. the Planning Commission recommended approval of the C.U.P.'s . listed above subject to certain conditions. NOW. THEREFORE. BE IT RESOLVED that the City Council of the City of Shorewood hereby approves the conditional use permits listed herein subject to the following conditions: 1. The subject property shall be developed and maintained based upon the approved site plan. attached hereto and made a part hereof. 2. The property shall comply with the requirements of Section 1201.03 Subd. 4. b.- d. of the Shorewood City Code. 3. The applicant must obtain an access permit from the Hennepin County Department of Transportation. ~ The parking lot shown on the attached site plan shall be paved. curbed and striped in accordance with plans approved by the City Engineer. 5. Landscaping must be maintained in compliance with a landscape plan approved by the City Council. . 6.
