A RESOLUrIGI GRANTING A VARIANCE ID MELISSA REIFENBERGER
WHERFAS, Melissa Reifenberger (Applicant) is the owner of real
property located at 4995 St. Albans Bay Road, legally described in Exhibit
A, attached hereto and made a part hereof; and
WHERFAS, the Applicant has a single-family dwelling, built in
approximately 1930, located on the property which does not meet the
current side-yard setback requirement of the R-lD zoning district; and
WHEREAS, the existing dwelling contains 740.5 square feet,
contains a 7.5 foot times 9.5 foot bedroom, and a 5 foot times 7 foot
ba throom wi th a shower and no bath; and
WHEREAS, the Applicant is desirous of adding a proposed addition
which will increase the area of the house to 892.5 square feet by
enlarging the bedroom to 10 feet times 12 feet and enlarging the bathroom
to 6 feet times 9.5 feet to include a bathtub; and
WHERFAS, such expansion cannot be had within the setback
requirements within the zoning district and therefore requires a variance
to the ordinance; and
WHERFAS, the application was reviewed by the Shorewood Planning
Commission at a public hearing held on January 5, 1988.
NlV, 'lHEREFORE, BE IT RESOLVED by the Ci ty Counci I of the Ci ty of
Shorewood, Minnesota, as follows:
FINDINGS OF FAC!'
1. That the small size of the existing bedroom and bathroom
justify the need for an expansion of the building to accorrmodate a
bathtub.
2. That due to a small hill located on the northwesterly corner
of the lot, the only location appropriate for the proposed addition is the
location proposed by the Applicant.
3. That the proposed location of the addition lines up with an
existing garage rather than with the main portion of the house in such
manner that the variance required is kept at a minimum.

4. That the right-of-way for the adjacent street, Woodland
Place, is 60 feet wide, rather than the 50 foot standard width for
right-of-way, providing the property with more open space than normally
would be available on a standard street.
5. That if the variance is not granted, the Applicant wi II
suffer undue hardship in that the property cannot be put to a reasonable
use under the present restrictions of the ordinance, the plight of the
Applicant is due to circumstances unique to the property and not created
by the Applicant, and the proposed addition would not alter the essential
character of the neighborhood.
aNCLUSIGIS
1. That the Applicant has establ ished an undue hardship, as
defined by Minnesota Statutes.
2. That the Applicant is hereby granted a side-yard setback
variance of 21 feet on the east lot line and a rear-yard setback variance
of 5 feet.
BE IT RJRlHER RESOLVED, that the Ci ty Clerk furnish Appl icant
with a certified copy of this Resolution for filing with the Hennepin
County Recorder or Registrar of Ti tles.
