RESOLurlCN ID. 11-87 A RESOLurlCN GRANrlOO A c:x:l\IDITICNAL USE PERVIIT WHEREAS, Carlson Clipper Corporation has applied for a Conditional Use Pennit for converting a private residence into an office building located at 6140 Lake Linden ~ive on property legally described as: The South 130 feet of the North 295 feet of Lot 16 and 18, as measured at right angles to the North line of said Lot 18, Linden Park, Hennepin County, Minnesota. and WHEREAS, the property is zoned R-C, Residential Coomercial, and is subject to the requirements of Shorewood Zoning Ordinance Section 200.19; and WHEREAS, the City Planning Cbmmission and the City Planner have recomnended approval of the Conditional Use Pennit. tnV, TIIEREFORE, BE IT RESOLVED by the Ci ty Council of the Ci ty of Shorewood as follows: FINDlOOS OF FACf 1. That the subject property is zoned R-C and is surrounded by land use and zoning as follows: North: East: South: West: vacant lot zoned R-3A vacant lot zoned C-3 Sull ivan Center zoned R-C single family dwelling zoned R-1C 2. That the request of the applicant meets all requirements for a conditional use as a business office under Shorewood Zoning Ordinance. <XNCLUS ICNS That based on the foregoing the City Council of the City of Shorewood concludes: 1. That the application of Carlson Clipper Corporation for a Conditional Use Pennit as set out hereinabove be and hereby is granted, subject to the following conditions: . . . . ~ a) The applicant must submit an up-to-date (within 30 days) title opinion. b) The applicant's attorney must provide drainage and utility easements along side and rear property lines. He must also prepare cross-easements and a maintenance agreement for the joint driveway. These must be approved by the City Attorney. c) Park dedication fees must be paid prior to release of the Council resolution approving the request. d) The division must be recorded within 30 days of the date the applicant received the resolution approving the division. e) A professional landscape plan must be submitted. f) The applicant should be required to submit construction estimates for the costs of renovating the building and constructing the required irrprovements. Prior to issuance of a building pennit, financial capability to complete the project must be demonstrated. g) Prior to issuance of a building pennit, the applicant must submit a irrevocable letter of credit for one and one-half times the amount of required site irrprovements (e.g., landscaping and parking). h) Prior to issuance of a building pennit, construction drawings, prepared by a registered architect, must be subni tted. From these, exi ting and handicapped requirements can be detennined. i) Signage plans should be prepared in compliance with Section 200.03, Subd. 11, of the Shorewood Zoning Ordinance. j) Architectural drawings of the building must be submitted and approved by the Ci ty Engineer.
