RESOLurICN ID. 37 -f:;.J A RESOLurICN GRANTING A a:N)ITICNAL USE PERVIIT AND VARIANCE 10 1HE METROroLITAN WASTE aNrROL CXlVMISSICN WHEREAS, the Me t ropo I it an Was t e Con t ro I Comni s s ion (J.\iI\tXj) has applied for a Conditional Use Permit and Variance for the purpose of expanding their lift station building located at 6198 Lake Virginia Drive, in the City of Shorewood, County of Hennepin, State of Minnesota, which property is legally described as: "Lot 11, Block 3, Virginia Highlands Addition" and WHEREAS, the property is located in the R-lA zoning district, which requires a Conditional Use Permit for governmental and public regulated utility buildings; and WHEREAS, the J.\iI\tXj has also requested a front-yard setback variance of approximately twelve (12) feet in order that the building addition may be accommodated to the existing building; and WHEREAS, the City Planning Comnission and the Ci ty Planner have recorrmended approval of the Conditional Use Permit and Variance; and WHEREAS, the Ci ty Counci I, on the mot ion of Gagne, seconded by Brancel, directed the City Attorney to draw a resolution setting forth findings and conclusions and conditions for the grant ing of applicant I s request for a Conditional Use Permit and Variance. l'OV, 'lHEREFrnE, BE IT RESOLVED by the Ci ty Counci I of the Ci ty of Shorewood as follows: FINDINGS OF FAcr 1. That the subject property is zoned R-lA and that there is justification for the expansion of the proposed lift station on such property for the purpose of increasing pumping capacity from 4,500 to 12,000 gallons per minute. . . . 2. That the R-lA district requires a front-yard setback of fifty (50) feet. However, the MWOC has shown a hardship resulting from the location of the existing building on the property sufficient to justify a twelve (12) foot variance for the proposed building addition. 3. That the request of the Applicant meets all other requirements of city ordinances. cna.USICNS That based on the foregoing, the City Council of the City of Shorewood concludes: 1. That the application of MWOC for a Conditional Use Permit and Variance as set out hereinabove be and hereby is granted, subject to the following conditions: a) That the property is screened and landscaped in accordance with the landscape plan, attached hereto and made a part hereof as Exhibit A. b) That the building is constructed in such manner as set forth in the proposed site plan, attached hereto and made a part hereof as Exhibit B. c) That in order to control the odor eminating from said lift station, MWOC shall change the carbon bed annually and conduct regular tests of the effectiveness of such carbon bed. The first test is to be conducted six months after installation or replacement, the second test to be conducted after nine months, after installation or replacement, and the bed to be replaced in its entirety at the end of each year. MWOC will send copies of all test results to the City of Shorewood and maintain said equipment in conformance with PCA Standards No. APe 1-15 . d) That in order to control the noise eminating from said lift station, MWOC shall make decibel noise tests and shall control the level of such noise so that such noise shall not exceed the current level emitted by the existing lift station or the noise level permitted by Shorewood Ordinance No. 200.03, Subd. 2(m), whichever is less. e) That all the work performed in the construction of such building addition shall be performed between the hours of 7 a.m. and 7 p.m. on weekdays only, unless speci fie notification has been given to the Shorewood City Staff, the -2- . . . Shorewood Council, and residents of Shorewood residing in the immediate area of the construction, 48 hours prior to the anticipated work. f) That to ensure that the street is restored to its original condition prior to commencement of construction, MWOC wi II obtain a bond to be furnished by the construct ion contractor naming MWOC and the Ci ty of Shorewood, as obligees, in an appropriate amount to cover any damage that might result to City facilities as the result of the proposed construction.
