Agenda Item #3B: Staff recommends the hiring of Mr. Douglas Boegeman for the position of 'Part-Time Liquor Clerk' at a rate of$8.50 per hour, effective August 1,2006. Agenda Item #3C: Staff is recommends acceptance of Change Order No.1, final acceptance of the Crescent Beach Culvert Replacement project, and authorization of final payment. A resolution is attached for consideration. Agenda Item #3D: Staff is recommends final acceptance of the Christmas Lake Road Culvert Replacement project, and authorization of final payment. A resolution is attached for consideration. Agenda Item #3E: Community Rec. Resources has provided a written report of its park coordinator services for the first and second quarter of 2006. A motion accepting the report is in order. Agenda Item #3F: Assuming the appellant has made progress toward compliance, staff recommends that Tim Soboleski be given a 30-day extension to correct violations of City Codes on his property at 6025 Apple Road. Agenda Item #30: Kelly Krauss has requested additional time to comply with a Notice to Remove for the property at 5555 Eureka Road. Staff will inspect the property for progress prior to Monday night's meeting. Assuming a good faith effort is being made, approval of the extension is recommended. Agenda Item #3H: Last month Mary Echols was granted additional time to clean up her property at 4960 Suburban Drive and to apply for variances for accessory buildings on the property. After meeting with staff, she has decided not to apply for variances, but #fj, ~ . PRINTED ON RECYCLED PAPER ..... Executive Summary - City Council Meeting of 24 July 2006 Page 2 of2 asks for additional time to bring the accessory building into compliance. Staff recommends that she be given an additional 30 days to comply. Agenda Item #5A: Former Park Commissioner Judy Farniok will be present this evening to receive recognition for her two years of service to the Shorewood Park Commission. Agenda Item #8A: The Planning Commission has recommended unanimously to approve a revised conditional use permit for the Cemetery of the Resurrection (St. John's Church). The Church proposes to relocate a maintenance building from the north end of the looped driveway to the south end. The new location results in considerably less site alteration and is well screened from nearby residents. Staff should be directed to prepare a findings of fact for the next meeting of the City Council. Agenda Item #8B-F: For the past several months the Planning Commission has worked on updating the commercial zoning districts found in the Shorewood Zoning Code. Items B- F are the culmination of that work. The proposed amendments revise the R-C district to allow self-storage facilities by conditional use; rezone the westerly Shurgard facility on Highway 7 and the city-owned property at Christmas Lake Road and Highway 7 to R-C and R-1A/S, respectively; eliminates the C-l zoning district and completely updates the C-3 zoning district. Finally, the C-3 and C-4 zoning districts will be redesignated to C-1 and C-2, respectively. Public hearings have been held on all of the amendments and the Planning Commission has unanimously recommended approval. Agenda Item #9A: Earlier this evening Council interviewed one candidate for consideration of appointment to the Park Commission. The appointment would begin immediately and run through February 28, 2007 (to fill the term recently vacated by Steve Loheit). Appointments are made with approval of the resolution. Agenda Item #10A: Staff recommends awarding the contract for the Wedgewood Drive, Teal Circle, and Mallard Lane Improvement and Appurtenant Work Project to the low bidder, Northwest Asphalt, Inc. in the amount of$1,053,041.82. This compares favorably to the engineer's estimate of$1,049,853.50. Agenda Item #10B: As requested, staff is providing information on recent traffic counts that have been done by the city in 2002 and 2006. A comparison of the two counts indicates that there is actually a reduction in traffic volume for all three of these roads. Agenda Item #10C: Staff is recommends approval of the plans, specifications, and engineer's estimate and authorizes advertisement of bids for the Chanhassen /W oodhaven Well Interconnection Project. Margaret Henke, 243iI3:$!IYelloWstone Trail, stated it was dangerous to live on Yellowstone Trail because of the increase in trafflRIlV6lume and traffic speed. She explained she was almost hit by a vehicle traveling on Country CI};lO Road while she was trimming her grass; and it was too dangerous to walk her grandson to the park. She stated it was difficult to pick up her mail from her mailbox on the other side of the road. She went on to state the traffic speed frequently exceeds the 30 miles-per-hour posted speed limit. Ms. Henke then stated rubbish had been dropped off on her property numerous times. She also stated she did not keep her windows open because of the traffic noise. She stated the neighborhood residents were assured the traffic on Country Club Road and Yellowstone Trail would be reduced as a result of the County Road 19 project, but it had actually tripled; and the problem would only get worse if additional businesses were to open on Lake Linden Drive or in the Shorewood Village Shopping Center. She commented residents located at the intersection of Yellowstone Trail and Lake Linden Drive were CITY OF SHOREWOOD REGULAR COUNCIL MEETING July 10,2006 Page 3 of 13 relocating because of the increased traffic volume and speed. She stated she did not think a no-turn-on- red sign on County Road 19 would reduce the problem; and she suggested access to Lake Linden Drive on Country Club Road be restricted to local traffic to reduce the volume of traffic. She noted the heaviest traffic occurred between 3:00 P.M. and 6:00 P.M. Rebecca Stratman, 24275 Yellowstone Trail, stated it was at times difficult for her to pull into her driveway; and her automobile had been rear ended while doing so. She then stated if the traffic laws (e.g. no through traffic, the no-turn-on-red sign out of the CUB Foods parking lot, and the 30 miles-per- hour speed limit) were enforced, some of the traffic-related problems woulqni~reduced. She went on to state her daughter had written a letter to the City regarding the traffic prpplbm, and her daughter had not heard back from the City for a number of months. Victoria Blaylock-Schmitt, 24295 Yellowstone Trail, stated she also hadcOl1cerns about the traffic situation. She stated a sidewalk would be of little value if p<;,,:op.l~ continued t6:q~ir.~ over the residents' lawns. In response to a question from Councilmember Wellens, Mayor Love stated Council could request additional traffic monitoring of the area. He also noted traffic problems were the most frequent concern residents had. Administrator Dawson explained there were two options available when requesting additional SLMPD monitoring of the area: 1) request more attention by the SLMPD for a shorter period of time; and 2) request guaranteed directed control by the SLMPD which would result in overtime expenses the City would have to fund. Stop signs must be located at every significant road intersection; and the name of the road being crossed was normally found beneath the stop sign. He explained once the trail rules were listed on the trail kiosks, the existing signs displaying the trail rules signs could be removed. In response to a question from Councilmember Lizee, Mr. Vlaming explained the trail kiosk's concrete pad would begin at the edge of the trail's compact crushed limestone, and it would go back approximately eight feet back from the trail's edge. Councilmember Wellens commented he would look at a trail map therefore, he did not understand the need for a map on the trail. The properties had existin drainage and utility easements from previous subdivisions. The rearrangement of the lot. lines required new drainage and utility easements to be issued. He explained the simplest way to accomplish the task was to. vacate the existing easements and then issue the new easements. He then reviewed a map displaying the existing easements and the proposed easements. He noted the easements would be ten feet around the entire lot line. Nielsen stated Staff recommended vacating the easements with the stipulation the applicant apply for easements for the new subdivision. Seeing no one present wishing to comment on this case, Mayor Love closed the Public Testimony portion of the Public Hearing at 7:43 P.M. Callies moved, Turgeon seconded, Adopting RESOLUTION NO. 06-047, "A Resolution Vacating Certain Drainage and Utility Easements for Anne and Jack Carter, 5705/5725 Smithtown Way." Motion passed 5/0. Easement Vacation Applicant: Location: Andrew and Dorothy Meldahl 6180 Cathcart Drive Director Nielsen stated Council had approved a resolution for a minor subdivision for Andrew and Dorothy Meldahl, 6180 Cathcart Drive, as part of the consent agenda. The situation with regard to vacating and issuing easements was similar to that of the Carters. Nielsen stated Staff recommended vacating the easements with the stipulfli~lqn the applicant apply for easements for the new subdivision. Seeing no one present wishing to comment on this case, Mayor of the Public Hearing at 7:44 P.M. Director Nielsen stated Administrator Dawson and he had met with Mr. Quast, 24800 Smithtown Road, to discuss the situation. Mr. Quast expressed regret that his wood-burning furnace had caused discomfort to his neighbors. Mr. Quast had given considerable thought with regard to how he could make improvements to try and mitigate his neighbors' concerns. Mr. Quast had been in contact with the manufacturer of the wood-burning stove. Mr. Quast intended to: 1) heighten the existing chimney by two or three sections (each section 4 - 5 feet in length) in order to get the smoke further into the air where CITY OF SHOREWOOD REGULAR COUNCIL MEETING July 10, 2006 Page 7 of 13 prevailing winds could better disperse of it; 2) trim tree branches above the stove that may serve as a canopy, trapping smoke and preventing it from moving vertically; and 3) burn wood that was more seasoned (drier) than that which was recommended by the manufacturer, hopefully resulting in less smoke. Nielsen noted greener wood would burn slower than drier wood, but it would also emit more smoke. Nielsen stated Administrator Dawson and he thought Mr. Quast intended to make a good-faith effort to try and resolve the problem. They had advised Mr. Quast that Staff would continue to monitor the situation. The City had sent Mr. Quast one letter telling him of the problem,~n~another letter which was a follow-up to the meeting with Mr. Quast. Staff informed Mr. Quast it was not qualified to determine whether or not his proposed changes would have a positive impact on .the problem. In response to a question from Councilmember Turgeon, Directbh.Nielsell greener wood could possibly have a more pungent smell than drier wood, but he sure Councilmember Callies questioned if the Planning CmtIlnission should review of emissions from wood-burning stoves on a broader scale. Steven Pahl. 24860 Smithtown Road, stated he had researche~jthe type of wood-burning furnace Mr. Quast was using. He then stated he would not be in favor of issuing a temporary restriction on the use of the furnace. Councilmember Wellens suggested Staff encourage Mr. Quast to extend his chimney as-soon-as-possible. Review of Preliminary 2007 Budget for Excelsior Fire District Administrator Dawson stated the process for reviewing the Excelsior Fire District draft operating budget for the upcoming year was in its second year of use. The EFD Governing Board had endorsed and forwarded the 2007 draft budget to the member cities' councils for review and comment. The EFD Board would consider the comments at its July 26, 2006, meeting before forwarding the 2007 proposed budget to the city councils for formal action. The city councils would need to ac,tp'lthe proposed budget by September 1, 2006. He noted if a simple majority of the councils approy~dthe budget the budget would be put in effect. Dawson explained the budget reflected an 8.59% increase in o~en:l\1 expense$,!fM?ich included a 15.88% increase in operational expenses. If the 2007 draft budget wen~ PRIflpared to the2:0:~p projected expenses, the 2007 draft budget reflected a 5.74% increase in overall:expenses and a 9.39% inyr~ase in operational expenses. The EFD Board believed the budget figures,,"*9re realistically representedwh~t it~ould take to operate the EPD. He then explained the areas ofthemaJo~ity ofthe:proposed increases. Mayor Love stated the EPD Board 2007 draft budget was morelt~~listic. The Board's review did not find areas that would be appropriate to reduce. Councilmember Turgeon expressed her realistic budget. He stated at that meeting there had been discussion as to whether the average maximum market wage or the average actual market wage be used for comparison purposes. He stated it was prudent to bring the services of a city engineer in-house. He noted the department heads consistently exceeded a forty-hour work week. It was originally anticipated that the project would be completed last fall. However, the contract could not be executed fast enough to get work started prior to the first snow fall. As a result, the project was delayed until this spring. The project has now been completed. During construction, a sink hole developed at the upstream culvert under Birch Bluff Road. The sink hole was in the west-bound lane, creating a safety hazard. To correct the problem, staff directed the contractor to replace this culvert as well. The cost for this additional work, $12,330, is reflected in Change Order No.1, attached. Staff is recommending that Change Order No.1 be accepted, the project be accepted, and final payment for the project be issued. Recommendation Staff is recommending approval of the attached resolution that accepts Change Order No.1, accepts the project, and authorizes final payment for the Crescent Beach Culvert Replacement. It was originally anticipated that the project would be completed last fall. However, the contract could not be executed fast enough to get work started prior to the first snow fall. As a result, the project was delayed until this spring. The project has now been completed. Staff is recommending that the project be accepted and final payment for the project be issued. Recommendation Staff is recommending approval of the attached resolution that accepts the project and authorizes final payment for the Christmas Lake Road Culvert Replacement. Resources Community Rec. Resources (CRR) has strived to meet the challenges during the first half of 2006 in its role as Park Coordinator for the City of Shorewood. Through extensive on site monitoring of field usage, parking, on-going communication with sports organization representatives, and a spring sp0l1s organization meeting which resulted in a new schedule for sp0l1s users, CRR believes that they've been successful in making substantial progress to date. Looking forward, CRR anticipates full cooperation from all sports organizations for fall/winter seasonal use due to increased communications with Minnetonka Youth Hockey Association representati ves. The spring season commenced with a positive response to the continued document collection process. Community Rec. Resources staff followed the process initiated in 2005 by electronically mailing documents to all sports organization representatives which netted savings in both time and money. Additional organizations, including Minnetonka Lacrosse Association and Twin Cities' Adult Men's Baseball (TC Men's Baseball), returned for a second season. Sp0l1s data sheets were returned by users electronically allowing an accurate schedule to be drafted by mid-March, much closer to the advent of the spring sp0l1ing season. Participants were directed to attend the Spring Sports Information Meeting held on March 9, with completed documents and full fee payment in hand. In return, each representative was given the schedule for the spring sporting season, thus, completing the reciprocal exchange of documents found in the new process. With few exceptions, the collection process went smoothly. Once again, CRR staff acknowledges that total documentation collection will most likely never be fully realized due to the organizational affiliation of Southshore Softball Association (SSSA) and TC Men's Baseball. Each of these organizations must adhere to different time lines specified by their national organizations. Thus, 1 CRR Staff continues to build rapport with these organizations through continued communications, and each organization submitted the maximum amount of documentation possible by the requested dates for City submission. With the advent of the 2006 season, CRR was faced with a new set of issues surrounding the use of Freeman Park by 2 sports organizations vying for the time. Due to poor drainage and the need to rest the field, as directed by Public Works staff, Badger was omitted from the organized field use this spring/summer. This had a "trickle down" effect in many ways. Lacrosse was moved to Freeman, and based on the Park Priority Policy was given field time, which the Soccer organization felt adversely impacted their use of the facilities. After much debate and negotiation between the sports organizations, City staff, and CRR, Lacrosse agreed to relocate to Manor Park as a temporary solution this season. Ongoing intensified monitoring efforts have proven this to be a workable, yet temporary solution. As both STLL and MGSA use the facilities at Manor Park, this neighborhood park was not intended for this type of intensive use. While striping a regulation size lacrosse field has been difficult, fortunately, the sports organizations at Manor have been cooperative and attentive to the other's needs. If the youth playing on the ball fields were any older, this scenario would have been impossible. It would be CRR's recommendation that serious attention be given to improvements at Badger Park in order to make this field available for both spring and fall use. The facility is ideal with regard to field size and parking space, should be available to users, and would alleviate the problems faced this year, once attention to the drainage and lighting issues have been addressed. Most organizations will complete their park usage by mid-July with the exception of SSSA and TC Men's Baseball that conclude their seasons August 18 and 21 respectively. CRR is also pleased to report that a soccer tournament was held in Freeman Park in June without reported concerns. Once the document process and adherence to the tournament application was reviewed with representatives of TUSA due to recent personnel changes, onsite monitoring confirmed that a successful event was enjoyed by all. It was also observed that parking for tournament use continued to flow throughout the course of the tournament without issue. Passive use has remained stable at Freeman Park, though numerous calls by outside non-organized users requesting space will continue to place additional pressure on all Shorewood facilities. As mentioned above, other parks have also demonstrated increased activity of their regular seasonal use. Continued communication between the Southshore Community Center, CRR, sports organizations, and other park users regarding events have provided balance to recunent parking issues in that area. CRR Staff looks forward to providing continued Park Coordinator services in the remaining quarters of the year. While the immediate focus will be preparation for the 2006 Fall/Winter Sports Infom1ation Meeting scheduled for July 17 at City Hall, 2 CRR will continue monitoring and communication efforts for the remainder of the spring season and beyond. Amendment FILE NO. 405(06.11 ) BACKGROUND In January 2003, St. John the Baptist Church received a conditional use permit approving a master plan for the Cemetery of the Resurrection, located at 5425 Covington Road (see Site Location map - Exhibit A, attached). The plan included the construction of two mausoleum structures and a new maintenance building. Last year St. John's was granted an amendment to their conditional use permit that included one mausoleum structure and a new maintenance building. The mausoleum is currently under construction and church representatives have applied for another amendment to their C.UP. relative to the maintenance building. The original maintenance building was to be located near the northwest corner of the cemetery's looped driveway. The applicants now propose to locate the building on the south end of the loop, as shown on Exhibit B. The revised plan shows a somewhat larger building (30' x 30') than the original (24' x 24'). The building is described in the applicant's letter (Exhibit C). The property is zoned R -1 A, the southern half of which is subj ect to shoreland management requirements, nothing of which affects their plans. ANAL YSIS/RECOMMENDA TION The 2005 staff report for the previously approved C.UP. characterized the maintenance building as being basically a typical two-car garage. Also per the conditional use permit already granted to St. John the Baptist for Cemetery of the Resurrection at 5555 Covington Road, the current garage structure on the western side of the circular private service road surrounding the currently developed in-ground burial portion of the cemetery property will be demolished and removed. The garage will be 30' X 30' with a 16'X 8' insulated steel overhead garage door, a hip roof with a 4/12 pitch and 3D-year shingles, and a single steel service door. The garage will sit on a 30' X 30' rebar reinforced floating slab with a 4" center running out to a 12" edge with one row of block on top of this. The slab will sit on a base of packed sand/gravel. The location of the new garage will be on the cemetery property on the southern side of the circular private service road surrounding the currently developed in- ground burial portion of the cemetery property, at least 300 feet from any property lines. Included is a map of the property with the approximate location of the new garage construction marked. Individuals from the church will build the new garage. There will be no electricity, heat, or water at this structure. The siding will be painted cement lap-board. The fascia and soffets will be of painted steel. Exhibit C APPLICANT'S LETTER CITY OF SHOREWOOD ORDINANCE NO. AN ORDINANCE AMENDING SECTION 1201.19 (R-C DISTRICT) OF THE SHOREWOOD ZONING CODE TO INCLUDE SELF-STORAGE FACILITIES AS A CONDITIONAL USE Section 1. Section 1201.19 Subd. 4. of the Shorewood City Code is hereby amended to add: "h. Self-storage facility, as defined in this chapter, provided that: (1) Adequate screening and landscaping from neighboring residential districts is provided in accordance with 9 1201.03, Subd. 2.g.; (2) The entire facility is located within a complete enclosure. The enclosure shall conform to applicable city codes and ordinances; (3) The access to the facility shall be by a security gate; (4) The hours of operation shall be limited to 7 :00 a.m. to 10:00 p.m., Sunday through Thursday, and 7:00 a.m. to 12:00 midnight, Friday and Saturday; (5) The lighting shall be hooded and so directed so that it is not visible from the public right-of-way or from any abutting residential district; (6) The structures shall conforn1 to height restrictions of the C-1 District. In addition, all structures within 50 feet of any property line shall be limited to one story or 15 feet, whichever is less; (7) The storage is confined to enclosed permanent structures; (8) The use of all structures shall be limited to storage only. No retail service businesses or workshops shall be allowed. Each facility shall have one residential dwelling unit to be used only by a resident caretaker or manager. The requirement of a caretaker residence may be waived by the City Council, provided that: (a) A caretaker residence for an approved self-storage facility under the same ownership is located within 600 feet of the subject property; (b) The applicant shall submit a plan showing where a caretaker residence can be located on the property in the future; (c) The applicant shall submit restrictive covenants, to be recorded against the property, restricting its sale unless a caretaker residence is constructed on the property, or a caretaker residence for an approved self-storage facility under the same ownership, located within 600 feet of the subject property is provided; (9) The entire area, other than occupied by the buildings or plantings, shall be surfaced with material which will control dust and drainage and is subject to the approval of the City Engineer; (10) The number of off-street parking spaces shall not be less than six. No on- street parking shall be allowed; (11) Loading areas shall be located entirely within the site which will be designed so as not to require backing in from a public street; (12) The applicants shall provide a performance bond or letter of credit to assure completion of the facility in accordance with the plans and specifications approved by the City Council. The amount of the bond shall be established by the City Council at the recommendation of the city staff; (13) The provisions of 9 1201.04, Subd. l.d.(l) are considered and satisfactorily met. AN ORDINANCE AMENDING THE SHOREWOOD ZONING CODE TO UPDATE THE C-3, GENERAL COMMERCIAL ZONING DISTRICT, REVISE ITS DESIGNATION TO C-l, GENERAL COMMERCIAL, AND REVISE THE DESIGNATION OF THE C-4, SERVICE COMMERCIAL DISTRICT TO C-2, SERVICE COMMERCIAL Section 1. Section 1201.09 Subd. l.b. of the Shorewood City Code is hereby amended to read as follows: "( 1) C-1, General Commercial. (2) C-2, Service Commercial." Section 2. Section 1201.22 is hereby deleted in its entirety and replaced with: "1201.22 C-l, GENERAL COMMERCIAL DISTRICT. Subd. 1. Purpose. The purpose of the C-l, General Commercial District is to provide for low to moderately intense retail or service outlets that deal directly with the customer to whom the goods or services are furnished. The uses allowed in this district are to provide goods and services on a limited community market scale and located in areas that are well served by collector or arterial street facilities. Subd. 2. Permitted uses. The following are permitted uses in a C-1 District: a. Trade and services. Retail stores, personal service or business service establishments, including the following and other similar uses: (1) Amusement places (such as dance halls or roller rinks) and commercial recreation; (2) Antique, resale or gift shop; (3) Apparel sales; (4) Art and school supplies and picture framing; (5) Art gallery and sales; (6) Auto accessory store; (7) Bakery goods and baking of goods for retail sales on the premises; (8) Bank, savings and loan, savings credit unions and other financial institutions; (8) Bank, savings and loan, savings credit unions and other financial institutions; (9) Barber shops; (10) Beauty parlors; (11) Bicycle sales and repair; (12) Books, office supplies or stationery stores; (13) Bowling alleys; (14) Camera and photographic supplies; (15) Candy, ice cream, popcorn, nuts, frozen desserts and soft drinks; (16) Catering establishments; (17) Coffee houses; (18) Coin and philatelic stores; (19) Commercial tutoring and learning centers; (20) Computer and business machine sales or service stores; (21) Convenience grocery stores (not supermarket type and without motor fuel); (22) Copy service, printing service and newspaper offices; (23) Day spas; (24) Delicatessen; (25) Department and discount stores; (26) Drugstore; (27) Dry cleaning, including plant accessory thereto, pressing and repamng; (28) Electrical home appliance stores, including incidental repair and assembly but not fabricating or manufacturing; (29) Employment agencies; (30) Enclosed boat and marine sales; -2- (31) Essential services; (32) Floor covering stores; (33) Florist shop; (34) Furniture stores; (35) Garden supply stores; (36) Gift or novelty stores; (37) Government and public utility buildings; (38) Grocery store, supermarket (but not including sales from moveable, motorized vehicles); (39) Hardware; (40) Hobby and craft store; (41) Home entertainment and electronics sales; (42) Insurance sales; (43) Interior decorating studios; (44) Jewelry stores; (45) Laundromat, self-service washing and drying; (46) Leather goods and luggage stores; (47) Liquor, on and off sale; (48) Locksmiths; (49) Massage therapy services, licensed pursuant to Chapter 311 of this code; (50) Meat market, but not including processing for a locker plant; (51) Motels, motor hotels and hotels, provided that the lot contains not less than 500 square feet of lot area per unit; (52) Motor vehicle and recreational equipment sales and structures; -3- (53) Offices - commercial and professional, including chiropractic, medical, dental and laboratories accessory thereto; (54) Optical stores and laboratories accessory thereto; (55) Paint and wallpaper sales; (56) Pest control services; (57) Pet sales, supplies and grooming; (58) Photography studios; (59) Plumbing, heating, ventilation and air conditioning, electrical sales, and the repair thereof as an accessory use to the retail establishment permitted within this District, but not including fabricating or manufacturing; (60) Private clubs or lodges serving food and beverages; (61) Public utility collection offices; (62) Real estate sales; (63) Record - music shops; (64) Recreation - personal fitness; (65) Restaurants and cafes, not including drive-in facilities; (66) Shoe stores and shoe repair; (67) Sporting goods sales; (68) Tailor shops; (69) Tanning salons; (70) Theatres, not of the outdoor drive-in type; (71) Tobacco Shops; (72) Toy stores; (73) Travel bureaus, transportation ticket offices; (74) Veterinary clinic with indoor overnight care and indoor kennels; (75) Electronic media rental and sales; -4- Subd.3. Subd.4. b. Commercial parking garages, ramps and lots for passenger vehicles only, provided stacking space is provided within the structure or lot for holding cars awaiting entrance, which stacking space shall have a capacity of no less than two vehicles; c. Adult establishments, subject to the requirements of Chapter 309 and Chapter 509 of the City Code, as may be amended; d. Uses similar to those enumerated in a. above, but not included in the listing, shall be subject to review and recommendation by the Planning Commission and approval by the City Council. It is the responsibility of the applicant to demonstrate that a particular use is consistent with the uses listed above, including, but not limited to, traffic, hours of operation, noise, signage and the market intended to be served. Permitted accessory uses. The following are permitted accessory uses in a C-1 District: a. Arcade games; b. Commercial or business buildings and structures for a use accessory to the principal use, but the accessory use shall not exceed 30% of the gross floor space of the principal use; c. Off-street parking as regulated by Section 1201.03 Subd. 5. of this Code; d. Off-street loading as regulated by Section 1201.03 Subd. 6. of this Code; e. Semi truck parking; f. Signs as regulated by Section 1201.03 Subd. 11. ofthis Code. Conditional uses. The following are conditional uses allowed in a C-1 District: (Requires a conditional use permit based on procedures set forth in and regulated by S 1201.04.): a. Convenience store or grocery store with motor fuel sales (no vehicle service or repair), provided that: (1) Retail sales shall be limited to those allowed in this district (C-1); (2) Take out food: Convenience/deli food is of the take-out type only and no provision for seating or consumption on the premises is provided. Furthermore, the enclosed area devoted to such activity, use and merchandise shall not exceed 20 percent of the gross floor area; -5- (3) Litter control: The operation shall be responsible for litter control within 500 feet of the property line on a daily basis. (4) Any outdoor sales, display or storage shall be subject to a separate conditional use permit, as provided for in this Section; (5) Hours of operation: The hours of operation shall be limited to between 6:00 A.M. and midnight unless extended by the City Council; (6) Motor fuel facilities shall be subject to a separate conditional use permit as provided for in this Section; (7) For facilities constructed after 21 July 2006, the architecture of the proposed buildings shall have a residential character. Specifically, roofs, including accessory canopies, shall have a minimum pitch of 4: 12 (four feet vertical per twelve feet horizontal); (8) For facilities constructed prior to 21 July 2006, if the principal structure has a flat roof, an accessory canopy may also have a flat roof. b. Drive-in facility or convenience food establishment, provided that: (1) The architectural appearance and functional plan of the building and site shall not be out of character with the existing buildings or area so as to cause impairment in property values or constitute a blighting influence within a reasonable distance of the lot; (2) At the boundaries of a residential district, a strip of not less than five feet shall be landscaped and screened in compliance with S 1201.03, Subd. 2g; (3) Each light standard island and all islands in the parking lot are landscaped or covered; (4) Parking areas shall be screened from view of abutting residential districts in compliance with S 1201.03, Subd. 2g; (5) Parking areas and driveways shall be curbed with continuous curbs not less than six inches high above the parking lot or driveway grade; (6) Vehicular access points shall be limited, shall create a minimum of conflict with through traffic movements, shall comply with S 1201.03, Subd. 5 and shall be subject to the approval of the City Engineer; -6- (7) All lighting shall be hooded and so directed that the light source is not visible from the public right-of-way or from an abutting residence and shall be in compliance with 9 1201.03, Subd. 2i; (8) The entire area shall have a drainage system which is subject to the approval of the City Engineer; (9) The entire area other than occupied by buildings or structures or planting shall be surfaced with a material which will control dust and drainage and which is subject to the approval of the City Engineer; (10) All signing and information or visual communication devices shall be in compliance with 9 1201. 03, Subd. 11; (11) The provisions of 9 1201.04, Subd. 1d(1) are considered and satisfactorily met; c. Commercial car washes (drive through, mechanical and self-service), provided that: (1) The architectural appearance and functional plan of the building and site shall not be out of character with the existing buildings or area so as to cause impairment in property values or constitute a blighting influence within a reasonable distance of the lot; (2) Stacking space is constmcted to accommodate that number of vehicles which can be washed during a maximum 30 minute period and shall be subject to the approval of the City Engineer; (3) At the boundaries of a residential district, a strip of not less than five feet shall be landscaped and screened in compliance with 9 1201.03, Subd. 2g; (4) Each light standard island and all islands in the parking lot are landscaped or covered; (5) Parking or car stacking space shall be screened from view of abutting residential districts in compliance with 9 1201.03, Subd. 2g; (6) The entire area other than occupied by the building or plantings shall be surfaced with material which will control dust and drainage which is subject to the approval of the City Engineer; (7) The entire area shall have a drainage system which is subject to the approval of the City Engineer; -7- (8) All lighting shall be hooded and so directed that the light source is not visible from the public right-of-way or from an abutting residence and shall be in compliance with S 1201.03, Subd. 2i; (9) Vehicular access points shall be limited, shall create a minimum of conflict with through traffic movement and shall be subject to the approval of the City Engineer; (10) All signing and informational or visual communication devices shall be in compliance with S 1201.03, Subd. 11; (11) Provisions are made to control and reduce noise; (12) The provisions of S 1201.04, Subd. 1d(1) are considered and satisfactorily met; d. Motor fuel sales, auto repair - minor and tire and battery stores and service, provided that: (1) Regardless of whether the dispensing, sale or offering for sale of motor fuels and/or oil is incidental to the conduct of the use or business, the standards and requirements imposed by this chapter for motor fuel stations shall apply. These standards and requirements are, however, in addition to other requirements which are imposed for other uses of the property; (2) The architectural appearance and functional plan of the building and site shall not be out of character with the existing buildings or area so as to cause impairment in property values or constitute a blighting influence within a reasonable distance of the lot; (3) The entire site other than that taken up by a building, structure or plantings shall be surfaced with a material to control dust and drainage which is subject to the approval of the City Engineer; (4) A drainage system shall be installed, subject to the approval of the City Engineer; (5) Parking areas and driveways shall be curbed with continuous curbs not less than six inches high above the parking lot or driveway grade; (6) The lighting shall be accomplished in a way as to have no direct source oflight visible from adjacent land in residential use or from the public right- of-way and shall be in compliance with S 1201.03, Subd. 2i; (7) Wherever fuel pumps are to be installed, pump islands shall be installed; -8- (8) At the boundaries of a residential district, a strip of not less than five feet shall be landscaped and screened in compliance with S 1201.03, Subd. 2g; (9) Parking or car stacking space shall be screened from view of abutting residential districts in compliance with S 1201.03, Subd. 2g; (10) Vehicular access points shall create a minimum conflict with through traffic movement, shall comply with S 1201.03, Subd. 5g and shall be subject to the approval of the City Engineer; (11) All signing and informational or visual communication devices shall be minimized and shall be in compliance with S 1201.03, Subd. 11; (12) Provisions are made to control and reduce noise; (13) Any outside storage shall be in compliance with Subd. 4f, below; (14) All conditions pertaining to a specific site are subject to change when the Council, upon investigation in relation to a formal request, finds that the general welfare and public betterment can be served as well or better by modifying the conditions; (15) The provisions of S 1201.04, Subd. 1d(1) are considered and satisfactorily met; e. Governmental and public regulated utility buildings and structures necessary for the health, safety and general welfare of the community, provided that: (1) Compatibility with the surrounding neighborhood is maintained and required setbacks and side yard requirements are met; (2) Equipment is completely enclosed in a permanent structure with no outside storage; (3) Adequate screening and landscaping from neighboring residential districts is provided in accordance with S 1201.03, Subd. 2g; (4) The provisions of S 1201.04, Subd. 1d(1) are considered and satisfactorily met; f. Open and outdoor storage as an accessory use, provided that: (1) The use does not constitute more than 30% of the lot area and no more than the floor area of the first story of the principal structure; -9- (2) The area is fenced and screened from view of neighboring residential uses or if abutting an R District; (3) Storage is screened from view from the public right-of-way; (4) Storage area is grassed or surfaced to control dust; (5) Landscaping is provided in compliance with S 1201.03, Subd. 2g; (6) All lighting shall be hooded and so directed that the light source shall not be visible from the public right-of-way or from neighboring residences; (7) Storage area does not take up parking space as required for conformity to this chapter; (8) The provisions of S 1201.04, Subd. 1 d( 1) are considered and satisfactorily met; g. Open or outdoor service, sale and rental as a principal or accessory use, provided that: (1) Outside services, sales and equipment rental connected with the principal use is limited to an area no larger than the gross floor area of the principal use; (2) Outside sales areas are fenced or screened from view of neighboring residential uses or abutting R District in compliance with S 1201.03, Subd. 2g; (3) All lighting shall be hooded and so directed that the light source shall not be visible from the public right-of-way or from neighboring residences and shall be in compliance with S 1201.03, Subd. 2i; (4) Sales area is grassed or surfaced to control dust; (5) The use does not take up parking space as required for conformity to this chapter; (6) The provisions of S 1201.04, Subd. 1d(1) are considered and satisfactorily met; h. Accessory, enclosed retail, rental or service activity other than that allowed as a permitted use or conditional use within this section, provided that: (1) The use is allowed as a permitted use in a C-1 District; -10- (2) The use does not constitute more than 30% of the lot area and no more than 50% of the gross floor area of the principal use; (3) Adequate off-street parking and off-street loading in compliance with the requirements of S 1201.03, Subds. 5 and 6 is provided; (4) All signing and informational or visual communication devices shall be in compliance with S 1201.03, Subd. 11; (5) The provisions of S 1201.04, Subd. 1d(1) are considered and satisfactorily met; 1. Daycare facilities, as defined in Section 1201.02 Subd. 4 of this Code, serving ten (10) or more persons, as a principal or accessory use, provided that: (1) The facility shall be licensed by the State of Minnesota. No certificate of occupancy shall be issued for a daycare facility until proof of approved applicable State licenses has been provided to the Zoning Administrator; (2) All child daycare facilities shall have an outdoor activity area complying with the following: (a) The activity area shall comply with the size required for State licensing; (b) The activity area shall be located at least 25 feet from any adjacent residential lot boundary; (c) The activity area shall be screened and landscaped to buffer neighboring residential uses; (d) The activity area shall be enclosed to prevent children from leaving the premises unattended; (3) Off-street parking must be provided in compliance with Section 1201.03 Subd. 5 of this Code. The number of parking spaces required for a daycare facility shall be one (1) space for each four (4) persons of licensed capacity; (4) Adequate short-term parking or drop-off area shall be provided within close proximity to the main entrance of the building and shall be located so as not to necessitate pedestrian crossing of a drive aisle. The short-term parking or drop-off area shall accommodate at least three (3) car spaces and shall be designated as temporary in nature. The short-term parking or drop-off area shall not conflict with off-street parking access or pedestrian movement; -11- (5) The structure in which the daycare facility is located shall comply with all applicable building and fire codes; (6) The provisions of Section 1201.04 Subdivision l.(d)(1) of the this Code must be considered and satisfactorily met; J. Self-storage facility, as defined in this chapter, provided that: (1) Adequate screening and landscaping from neighboring residential districts is provided in accordance with 9 1201.03, Subd. 2g; (2) The entire facility is located within a complete enclosure. The enclosure shall conform to applicable city codes and ordinances; (3) The access to the facility shall be by a security gate; (4) The hours of operation shall be limited to 7:00 a.m. to 10:00 p.m., Sunday through Thursday, and 7:00 a.m. to 12:00 midnight, Friday and Saturday; (5) The lighting shall be hooded and so directed so that it is not visible from the public right-of-way or from any abutting residential district; (6) The structures shall conform to height restrictions of the C-1 District. In addition, all structures within 50 feet of any property line shall be limited to one story or 15 feet, whichever is less; (7) The storage is confined to enclosed permanent structures; (8) The use of all structures shall be limited to storage only. No retail service businesses or workshops shall be allowed. Each facility shall have one residential dwelling unit to be used only by a resident caretaker or manager. The requirement of a caretaker residence may be waived by the City Council, provided that: (a) A caretaker residence for an approved self-storage facility under the same ownership is located within 600 feet of the subj ect property; (b) The applicant shall submit a plan showing where a caretaker residence can be located on the property in the future; (c) The applicant shall submit restrictive covenants, to be recorded against the property, restricting its sale unless a caretaker residence is constructed on the property, or a caretaker residence for an approved self-storage facility -12- under the same ownership, located within 600 feet of the subject property is provided; (9) The entire area, other than occupied by the buildings or plantings, shall be surfaced with material which will control dust and drainage and is subject to the approval of the City Engineer; (10) The number of off-street parking spaces shall not be less than six. No on-street parking shall be allowed; (11) Loading areas shall be located entirely within the site which will be designed so as not to require backing in from a public street; (12) The applicants shall provide a performance bond or letter of credit to assure completion of the facility in accordance with the plans and specifications approved by the City Council. The amount of the bond shall be established by the City Council at the recommendation of the city staff; (13) The provisions of S 1201.04, Subd. 1d(1) are considered and satisfactorily met; k. Commercial planned unit development as regulated by S 1201.06 of this chapter, provided that: (1) Land uses allowed in a planned unit development are limited to those land uses listed as permitted uses, permitted accessory uses or conditional uses in this section; (2) The proposed development complies with the development agreement as required for planned unit developments, pursuant to S 1201.25 of this chapter." Section 3. Section 1201.23 is hereby amended to read: "1201.23, C-2, COMMERCIAL SERVICE DISTRICT:" Section 4. Section 1201.23 Subd. 1. is hereby amended to read: "Subd. 1. Purpose. The C-2 District is intended to recognize areas containing preexisting businesses that provide services primarily for the community and surrounding area. It is further intended that the location of the C-2 District may take advantage of transportation routes with existing high traffic volumes; however, activities allowed in the District will not create additional traffic." -13- Section 5. Section 1201.23 Subd. 5. is hereby amended to read: "Subd. 5. Lot requirements and setbacks. The following minimum requirements shall be observed in the C-2 District subject to additional requirements, exceptions and modifications set forth in this Chapter." Section 6. Section 1201.03 Subd. 2.u.(3) of the Shorewood City Code is hereby amended to read as follows: "(3) Commercial districts (R-C through C-1), not located in the "S", Shoreland District: 66%, provided that:" Section 2. Section 1201.03 Subd. 2.u.(4) of the Shorewood City Code is hereby amended to read as follows: "(4) Commercial districts (R-C through C-1) and Lakeshore Recreational (L-R), located in the "S", Shoreland District: 25%. Bids were opened and tabulated on July 19, 2006. The low bidder is Northwest Asphalt, Inc. in the amount of$1,053,041.82, compared to the engineer's estimate of$1,049,853.50. As you may recall, the watermain portion of this project is being funded through a special assessment. The items included in the assessment are identified as Schedule C on the Bid Tabulation. Based on the low bid, the construction costs for watermain are $202,052.25. This is $40,517.75 less than the estimated construction used to calculate the preliminary assessment roll. Ifthere are no increased costs due to unforeseen circumstances, the amount assessed to each property is projected to go down, although the final assessment amount won't be determined until after final acceptance of the project. It is anticipated that the bonds will be issued sometime in September. Recommendation Staff is recommending that the City Council approve the attached resolution that accepts the bids and awards the contract to Northwest Asphalt, Inc. in the amount of $1,055,041.82. July 24, 2006 DATE: RE: Update on Traffic Counts for Country Club Road, Lake Linden Drive, and Yellowstone Trail This memo is meant to provide you with an update on traffic counts that have been performed for Country Club Road, Lake Linden Drive, and Yellowstone Trail. Since these streets are designated as Municipal State-Aid (MSA) roads, the City conducts traffic counts on these roads approximately every three years. The counts are not done on Fridays since there are potentially less cars on the road due to people taking an early weekend. The 2002 counts were done May 29th - 30th and June 3rd - 4th, which was still during the school year when there is typically more traffic volume. The 2006 counts were done May 1 st - 4th, which was also during the school year. It should also be noted that these counts were done after the majority of the work was complete at the intersection of County Road 19 and Smithtown Road. In addition to the intersection realignment, staff is continuing to work with Hennepin County to further reduce the amount of traffic on Country Club Road (and, subsequently, the other roads) by prohibiting right turns on red for southbound CSAH 19. This project is being initiated by the city for a number of reasons. The existing Woodhaven system is served by the Woodhaven well. The well house and controls have reached the end of their service life. Even if the existing system were completely reconstructed, it is not anticipated that the new system would provide adequate fire flow protection. Extension of the system within the boundary of Shorewood is not feasible due to the length of the project and costs associated with such a project. An agreement has been reached that allows us to connect the W oodhaven system with the City of Chanhassen's water system. This connection will provide adequate fire protection within the W oodhaven system. The interconnection will consist of approximately 425 feet of 8-inch watermain. A pressure reducing vault will be located just inside the Shorewood/Chanhassen boundary. Shorewood will retain ownership of the vault, and will be responsible for maintenance of the valves and fittings housed inside. Once the interconnect is operational, the eXlstmg well house can be demolished under separate contract. We will coordinate with a certified testing firm to prepare a report evaluating the existing building for the presence of hazardous materials, as required by MPCA. It is anticipated that the demolition costs will be $20,000 to $40,000, depending on the materials present in the well house. The estimated construction and demolition costs, $175,000, will be funded with Water Revenue Bonds. Recommendation Staff is recommending approval of resolution that approves the plans, specifications, and engineer's estimate and authorizes advertisement of bids. Said plans, specifications and estimates are hereby approved and shall be filed with the City Clerk. 2. The City Clerk shall prepare and cause to be inserted in the official paper and in Construction Bulletin an advertisement for bids, attached hereto as Exhibit A, upon the making of such improvement under such approved plans and specifications. The advertisement shall be published for 2 weeks, shall specify the work to be done, shall state that bids will be opened and considered by the Council at 10:00 a.m. on August 23,2006, in the City Hall Council Chambers, and that no bids will be considered unless sealed and filed with the Clerk and accompanied by a cash deposit, cashier's check bid bond, or certified check payable to the Clerk for 5 percent of the amount of each bid.
