Monday, 24 July 2006
5:30 PM - Special meeting to interview a Park Commission candidate
6:00 P.M. - Work Session regarding Southshore Center future funding
An EDA meeting will immediately follow the Regular City Council meeting
Agenda Item #3A:
Enclosed is the Verified Claims List for Council approval.
Agenda Item #3B: Staff recommends the hiring of Mr. Douglas Boegeman for the position of
'Part-Time Liquor Clerk' at a rate of$8.50 per hour, effective August 1,2006.
Agenda Item #3C: Staff is recommends acceptance of Change Order No.1, final acceptance
of the Crescent Beach Culvert Replacement project, and authorization of final payment.
A resolution is attached for consideration.
Agenda Item #3D: Staff is recommends final acceptance of the Christmas Lake Road Culvert
Replacement project, and authorization of final payment. A resolution is attached for
consideration.
Agenda Item #3E: Community Rec. Resources has provided a written report of its park
coordinator services for the first and second quarter of 2006. A motion accepting the
report is in order.
Agenda Item #3F: Assuming the appellant has made progress toward compliance, staff
recommends that Tim Soboleski be given a 30-day extension to correct violations of City
Codes on his property at 6025 Apple Road.
Agenda Item #30: Kelly Krauss has requested additional time to comply with a Notice to
Remove for the property at 5555 Eureka Road. Staff will inspect the property for
progress prior to Monday night's meeting. Assuming a good faith effort is being made,
approval of the extension is recommended.
Agenda Item #3H: Last month Mary Echols was granted additional time to clean up her
property at 4960 Suburban Drive and to apply for variances for accessory buildings on
the property. After meeting with staff, she has decided not to apply for variances, but

asks for additional time to bring the accessory building into compliance. Staff
recommends that she be given an additional 30 days to comply.
Agenda Item #5A: Former Park Commissioner Judy Farniok will be present this evening to
receive recognition for her two years of service to the Shorewood Park Commission.
Agenda Item #8A: The Planning Commission has recommended unanimously to approve a
revised conditional use permit for the Cemetery of the Resurrection (St. John's Church).
The Church proposes to relocate a maintenance building from the north end of the looped
driveway to the south end. The new location results in considerably less site alteration
and is well screened from nearby residents. Staff should be directed to prepare a findings
of fact for the next meeting of the City Council.
Agenda Item #8B-F: For the past several months the Planning Commission has worked on
updating the commercial zoning districts found in the Shorewood Zoning Code. Items B-
F are the culmination of that work. The proposed amendments revise the R-C district to
allow self-storage facilities by conditional use; rezone the westerly Shurgard facility on
Highway 7 and the city-owned property at Christmas Lake Road and Highway 7 to R-C
and R-1A/S, respectively; eliminates the C-l zoning district and completely updates the
C-3 zoning district. Finally, the C-3 and C-4 zoning districts will be redesignated to C-1
and C-2, respectively. Public hearings have been held on all of the amendments and the
Planning Commission has unanimously recommended approval.
Agenda Item #9A: Earlier this evening Council interviewed one candidate for consideration
of appointment to the Park Commission. The appointment would begin immediately and
run through February 28, 2007 (to fill the term recently vacated by Steve Loheit).
Appointments are made with approval of the resolution.
Agenda Item #10A: Staff recommends awarding the contract for the Wedgewood Drive, Teal
Circle, and Mallard Lane Improvement and Appurtenant Work Project to the low bidder,
Northwest Asphalt, Inc. in the amount of$1,053,041.82. This compares favorably to the
engineer's estimate of$1,049,853.50.
Agenda Item #10B: As requested, staff is providing information on recent traffic counts that
have been done by the city in 2002 and 2006. A comparison of the two counts indicates
that there is actually a reduction in traffic volume for all three of these roads.
Agenda Item #10C: Staff is recommends approval of the plans, specifications, and engineer's
estimate and authorizes advertisement of bids for the Chanhassen /W oodhaven Well
Interconnection Project. A resolution is included for your consideration.

Ed Hasek, 24315 Y ellow~tQtielraimn~pressed conc~tn about the of traffic on Yellowstone Trail.
He stated at the time.+?:1Ime CUB F??i9S development project, he had met with the developer and City
Staff with regard to the p~?~tt~le incrrttse in traffic on)j'rHowstone Trail and the possibility of removing
the road from the Municipalll~~fte 1ml~~~m~: At that.i~iine there was also discussion of the stoplight at

stop~}~tlUm~s supposed toqfYlrbeen in~~ffJFld. He stated he wanted the traffic reduced to local traffic

Market Road{1w~ich was also a:Municipal State Aid road); more stop signs installed; and enforcement of
stopping for tht)I$~wp signs.
Margaret Henke, 243iI3:$!IYelloWstone Trail, stated it was dangerous to live on Yellowstone Trail because
of the increase in trafflRIlV6lume and traffic speed. She explained she was almost hit by a vehicle
traveling on Country CI};lO Road while she was trimming her grass; and it was too dangerous to walk her
grandson to the park. She stated it was difficult to pick up her mail from her mailbox on the other side of
the road. She went on to state the traffic speed frequently exceeds the 30 miles-per-hour posted speed
limit. Ms. Henke then stated rubbish had been dropped off on her property numerous times. She also
stated she did not keep her windows open because of the traffic noise. She stated the neighborhood
residents were assured the traffic on Country Club Road and Yellowstone Trail would be reduced as a
result of the County Road 19 project, but it had actually tripled; and the problem would only get worse if
additional businesses were to open on Lake Linden Drive or in the Shorewood Village Shopping Center.
She commented residents located at the intersection of Yellowstone Trail and Lake Linden Drive were

relocating because of the increased traffic volume and speed. She stated she did not think a no-turn-on-
red sign on County Road 19 would reduce the problem; and she suggested access to Lake Linden Drive
on Country Club Road be restricted to local traffic to reduce the volume of traffic. She noted the heaviest
traffic occurred between 3:00 P.M. and 6:00 P.M.
Rebecca Stratman, 24275 Yellowstone Trail, stated it was at times difficult for her to pull into her
driveway; and her automobile had been rear ended while doing so. She then stated if the traffic laws
(e.g. no through traffic, the no-turn-on-red sign out of the CUB Foods parking lot, and the 30 miles-per-
hour speed limit) were enforced, some of the traffic-related problems woulqni~reduced. She went on to
state her daughter had written a letter to the City regarding the traffic prpplbm, and her daughter had not
heard back from the City for a number of months.
Victoria Blaylock-Schmitt, 24295 Yellowstone Trail, stated she also hadcOl1cerns about the traffic
situation. She stated a sidewalk would be of little value if p<;,,:op.l~ continued t6:q~ir.~ over the residents'
lawns. She explained there had been an incident wher~dl;1er husband was slowl)(J~<p(llowing her son's
friend home (the boy was on his bike and it was dark),;mhen anoth~r motorist became:~~se.t,because of

In response to a comment from Councilmember Turgeon regarding a planned no-turn-on-red sign for the
County Road 19 intersection, Director Brown explained the delay in having the sign installed was a result
of staff changes at Hennepin County. He stated the Operations Staff at Hennepin County had resisted
installing the sign; and the city Staff had been rigorously pursuing the installation of the sign.
In response to a question from Councilmember Wellens, Mayor Love stated Council could request
additional traffic monitoring of the area. He noted that would be a short-tem partial solution to the traffic

problem, and it should be considered as part of a larger effort. He also noted traffic problems were the
most frequent concern residents had.
Administrator Dawson explained there were two options available when requesting additional SLMPD
monitoring of the area: 1) request more attention by the SLMPD for a shorter period of time; and 2)
request guaranteed directed control by the SLMPD which would result in overtime expenses the City
would have to fund. There was Council consensus to start with option 1.

because of concern about the amount of signage.

Mr. Vlaming stated there would be one trail kiosk in the City, and directional signs would be located

of the road being crossed was normally found beneath the stop sign. He explained once the trail rules
were listed on the trail kiosks, the existing signs displaying the trail rules signs could be removed.
In response to a question from Councilmember Lizee, Mr. Vlaming explained the trail kiosk's concrete
pad would begin at the edge of the trail's compact crushed limestone, and it would go back

Director Nielsen stated Council had approved a resolution for a subdivision and combination of real
property for Anne Jack Carter, 5705 / 5725 Smithtown Way, as part of the consent agenda. The
properties had existin drainage and utility easements from previous subdivisions. The rearrangement of
the lot. lines required new drainage and utility easements to be issued. He explained the simplest way to
accomplish the task was to. vacate the existing easements and then issue the new easements. He then
reviewed a map displaying the existing easements and the proposed easements. He noted the easements
would be ten feet around the entire lot line.
Nielsen stated Staff recommended vacating the easements with the stipulation the applicant apply for

Dawson stated there additional reports of smoke in the air over the last two-week period, and
the SLMPD had to the complaints. The SLMPD did not find any violation of the City's code
with regard to public nuisance.
Director Nielsen stated Administrator Dawson and he had met with Mr. Quast, 24800 Smithtown Road,
to discuss the situation. Mr. Quast expressed regret that his wood-burning furnace had caused discomfort
to his neighbors. Mr. Quast had given considerable thought with regard to how he could make
improvements to try and mitigate his neighbors' concerns. Mr. Quast had been in contact with the
manufacturer of the wood-burning stove. Mr. Quast intended to: 1) heighten the existing chimney by two
or three sections (each section 4 - 5 feet in length) in order to get the smoke further into the air where

prevailing winds could better disperse of it; 2) trim tree branches above the stove that may serve as a
canopy, trapping smoke and preventing it from moving vertically; and 3) burn wood that was more
seasoned (drier) than that which was recommended by the manufacturer, hopefully resulting in less
smoke. Nielsen noted greener wood would burn slower than drier wood, but it would also emit more
smoke.
Nielsen stated Administrator Dawson and he thought Mr. Quast intended to make a good-faith effort to
try and resolve the problem. They had advised Mr. Quast that Staff would continue to monitor the
situation. The City had sent Mr. Quast one letter telling him of the problem,~n~another letter which was
a follow-up to the meeting with Mr. Quast. Staff informed Mr. Quast it was not qualified to determine

September 1, 2006. He noted if a simple majority of the councils approy~dthe budget the budget would

In response to a question from Councilmember Wellens, Administrator Dawson stated the increase in
firefighters' salaries was due to an anticipated increase in the number of firefighters. Mayor Love stated
although the draft budget did not reflect it, there had been discussions about ensuring the Relief
Association was adequately funded to support the addition of firefighters, and about ensuring adequate
funds were available for turnout gear.

It was noted there were approximately 28 firefighters five years ago, and there was a projected number of
close to 50 firefighters by 2006 year-end.
B. Approval of Compensation Plan
Administrator Dawson stated Staff had distributed to Council the average actual salaries of the market
positions the City's staff positions were being compared to, per Council's request at its last meeting. He
stated at that meeting there had been discussion as to whether the average maximum market wage or the
average actual market wage be used for comparison purposes. He then state.911twas important to consider
internal pay equity amongst the positions to ensure compliance with the ~~y Equity Act. He also stated at
that meeting Council had agreed to have the wage adjustments begiW9plJHly 1,2006, and for positions
requiring significant adjustments the second adjustment would ~mpbne\~my~tive January 1, 2007. He

Council member Lizee stated the Staff's perf'ormance was the impetus for the wage adjustments and new
compensation plan. She said Council had asked Staff to prepare a recommendation (which it did), and it
had hired a benefits consultant to conduct a study (which it did); therefore, it was appropriate for Council
to take action on this matter at the meeting. She stated the Staff exceeded expectations in performance of
their job responsibilities and they deserved to be fairly compensated.

C. Recruitment Services for City Engineer
Administrator Dawson stated earlier in 2006 Council had agreed to move forward with a search for an in-
house city engineer. The City had an arrangement with WSB & Associates~<.).~ave one of its engineers
work at City Hall on a four-days-a-week schedule, while the City pursu~9the hiring of a city engineer.
The labor market for city engineers remained extremely tight. Staff ha.~ tit~f~ conducted the conventional
recruitment process, to which a limited number of qualified applimrts res~Rn?ed. Each time a job offer
was extended to an applicant, and each time that applicant withdrew.~heir accep~f1.pce ofthe offer.

Councilmember Turgeon stated she had not been .convinced having an in-house city engineer would be

appreciated working with Acting City Engineer Gurney. She recommended retaining Mr. Gurney's
services for as long as the City could.

best value for thei99Uf1.r for cityiengineering services. He then stated to find the best available candidate
for the position requitijqi~he .f<.)cus and connections of a search firm.
In response to a questigTt from Councilmember Turgeon, Director Brown explained the City had used
every method available to try and attract qualified candidates.
Discussion ensued with regard to the benefits of contracting with a search firm.
Mayor Love complimented the job Mr. Gurney had been performing for the City. He then stated that
WSB was in the business of making money, and there was a significant mark-up for retaining Mr.
Gurney's services. He stated it was prudent to bring the services of a city engineer in-house. He noted the
department heads consistently exceeded a forty-hour work week.

Councilmember Wellens stated Council had committed to increasing the Staffs salaries, approving an
increase in funding for the EFD and the SLMPD, and there were drainage issues that needed to be
resolved. He had concerns with how to fund the increases.
Director Burton stated the goal was to manage the 2007 budget to a single-digit increase.
Mayor Love stated in the long run there would be a cost savings to bringing the city engineering services
in-house.

Discussion ensued with regard to the need to handle the planning and coordination of road closures and
rerouting of traffic during an emergency. The discussion came about because of a downed power line
forcing traffic to be rerouted from Highway 7 down Radisson Road (a narrow residential street).
Mayor Love questioned what the impact was of the increased water demands during the very dry spell.
Director Brown stated the City's water system was keeping up with the demand. He also stated the
Department of Natural Resources had become more anxious about the City implementing an odd-
day/even-day water restriction.

satisfy increased capacity requirements. Disaster recovery planning was more difficult because of the
server's somewhat outdated technology.
Director Burton stated the increases for SLMPD services, EFD services, and salary and benefits would
amount to approximately $225,000 or 5.4%. There would also be fuel cost increases. Staffs objective
was to draft an operating budget that would result in a single-digit levy over 2006. She then stated Staff
was working on a tax reduction strategy dealing with the General Fund Reserves. It could be possible to
transfer some of the General Fund Reserves to capital improvement funds. She explained the goal would

be to maintain a reserves level no less than 55%, and the current reserves level was 63%. Therefore, a
transfer of $80,000 - $100,000 could be done while continuing to maintain the desired reserves level.
Administrator Dawson stated the process to reduce the reserves would be a phased approach. Staff had
discussed maintaining the current level of taxation into the capital improvement funds, and the transfers
would be made to increase the funds.

Mayor Love stated the stormwater improvement assessment policy and the roadway improvement
assessment policy must be defined. Love also stated it was important to invest in the City's future.
Replacing the lights in the parks was an example of maintaining an existing and agreed upon
infrastructure. When an expansion of the infrastructure was considered it was important to distinguish the
difference between a maintenance effort and an effort that was an investment into the City's future.
Councilmember Lizee stated it was important to invest in the roadways, sewer system, and stormwater
management system infrastructures; those infrastructures significantly contributed to a property's value.

Mayor Love stated previous councils, as well as Staff, had paid a great deal of attention to the City's
future.
Administrator Dawson asked Council to forward any additional thoughts it may have with regard to the
budget to him over the next two weeks.
Mayor Love, on behalf of Council, stated the direction for Staff was to examine the idea of reducing the
General Fund Reserves thus reducing future levies. In parallel, Staff should. identify where the transfers
should be allocated to. Also, a strategy for assessment policies should be igy~tified by year-end.
3. REQUEST FOR CONSIDERATION OF PRIVATE USEi~;FH~LMPD FIRING RANGE
Administrator Dawson stated this item was a follow-up frOl~ amteviouslQ~~?)~il meeting when it had
received a request to allow the SLMPD firing range to beRFrffi for training ass;~~f~ted with certification
for concealed carry permits. In response to a request f~RmCouncil, he had cont~cmff Chief Litsey and

Mayor Love stated he had always supported the use of the range by other law enforcements agencies as a
means to off-set the cost of maintaining of the range.
Councilmember Lizee stated the building was not currently zoned for public use. A commercial-type
firing range would not be allowed in the residential zone in which the property was located. The
requestor (Mr. German) should approach the SLMPD Coordinating Committee with regard to this matter.

If Mr. German wanted to pursue a zoning change, he should approach the Shorewood Planning
Commission. It was not a matter the Council could take action on at this time.
Mayor Love stated he had previously informed Mr. German that he should approach the SLMPD
Coordinating Committee. He also stated he had great concern about opening the firing range to public
lIse. He then stated he had been very careful to describe to Mr. German his right to process. Love stated it
would be appropriate for him to receive guidance from Council. Should the Coordinating Committee

Accept Final Project and Authorize Final Payment
Crescent Beach Culvert Replacement
City Project No. 05-13
On November 14,2005, the City of Shorewood awarded the contract to Hulegaard Construction for the
Crescent Beach Culvert Replacement Project. It was originally anticipated that the project would be
completed last fall. However, the contract could not be executed fast enough to get work started prior
to the first snow fall. As a result, the project was delayed until this spring. The project has now been
completed.
During construction, a sink hole developed at the upstream culvert under Birch Bluff Road. The sink
hole was in the west-bound lane, creating a safety hazard. To correct the problem, staff directed the
contractor to replace this culvert as well. The cost for this additional work, $12,330, is reflected in
Change Order No.1, attached.
Staff is recommending that Change Order No.1 be accepted, the project be accepted, and final
payment for the project be issued.
Recommendation
Staff is recommending approval of the attached resolution that accepts Change Order No.1, accepts
the project, and authorizes final payment for the Crescent Beach Culvert Replacement.
A resolution is attached for your consideration.

Christmas Lake Road Culvert Replacement
City Project No. 05-12
On November 14,2005, the City of Shorewood awarded the contract to Hulegaard Construction for the
Christmas Lake Road Culvert Replacement Project. It was originally anticipated that the project
would be completed last fall. However, the contract could not be executed fast enough to get work
started prior to the first snow fall. As a result, the project was delayed until this spring. The project
has now been completed.
Staff is recommending that the project be accepted and final payment for the project be issued.
Recommendation
Staff is recommending approval of the attached resolution that accepts the project and authorizes final

RE: 2006 First and Second Quarter RepOli from Community Rec. Resources
Attached is the repOli of activities from Community Rec. Resources summarizing
activities and challenges in its role as Park Coordinator for the City of Shorewood for
the first two quarters of2006. Increased of Manor Park, extensive on-site monitoring
and communication between City Staff, CRR, and Sports Organizations provided the
highlights for these quarters. Consideration should continue to be given to fUliher
improvements to Badger Park in order to maximize usage for that park and alleviate
pressure on other city parks for spring seasonal usage. Should you have any further
questions or comments, please do not hesitate to contact Community Rec. Resources
principals, Kristi Anderson or Sally Keefe. As always, we appreciate the continued
support of City Staff and Council.

RE: 2006 First and Second Quarter Report from Community Rec. Resources
Community Rec. Resources (CRR) has strived to meet the challenges during the first
half of 2006 in its role as Park Coordinator for the City of Shorewood. Through
extensive on site monitoring of field usage, parking, on-going communication with
sports organization representatives, and a spring sp0l1s organization meeting which
resulted in a new schedule for sp0l1s users, CRR believes that they've been
successful in making substantial progress to date. Looking forward, CRR anticipates
full cooperation from all sports organizations for fall/winter seasonal use due to
increased communications with Minnetonka Youth Hockey Association
representati ves.
The spring season commenced with a positive response to the continued document
collection process. Community Rec. Resources staff followed the process initiated in
2005 by electronically mailing documents to all sports organization representatives
which netted savings in both time and money. Additional organizations, including
Minnetonka Lacrosse Association and Twin Cities' Adult Men's Baseball (TC Men's
Baseball), returned for a second season. Sp0l1s data sheets were returned by users
electronically allowing an accurate schedule to be drafted by mid-March, much closer
to the advent of the spring sp0l1ing season.
Participants were directed to attend the Spring Sports Information Meeting held on
March 9, with completed documents and full fee payment in hand. In return, each
representative was given the schedule for the spring sporting season, thus, completing
the reciprocal exchange of documents found in the new process. With few
exceptions, the collection process went smoothly.
Once again, CRR staff acknowledges that total documentation collection will most
likely never be fully realized due to the organizational affiliation of Southshore
Softball Association (SSSA) and TC Men's Baseball. Each of these organizations
must adhere to different time lines specified by their national organizations. Thus,
1
CRR Staff continues to build rapport with these organizations through continued
communications, and each organization submitted the maximum amount of
documentation possible by the requested dates for City submission.
With the advent of the 2006 season, CRR was faced with a new set of issues
surrounding the use of Freeman Park by 2 sports organizations vying for the time.
Due to poor drainage and the need to rest the field, as directed by Public Works staff,
Badger was omitted from the organized field use this spring/summer. This had a
"trickle down" effect in many ways. Lacrosse was moved to Freeman, and based on
the Park Priority Policy was given field time, which the Soccer organization felt
adversely impacted their use of the facilities. After much debate and negotiation
between the sports organizations, City staff, and CRR, Lacrosse agreed to relocate to
Manor Park as a temporary solution this season.
Ongoing intensified monitoring efforts have proven this to be a workable, yet
temporary solution. As both STLL and MGSA use the facilities at Manor Park, this
neighborhood park was not intended for this type of intensive use. While striping a
regulation size lacrosse field has been difficult, fortunately, the sports organizations
at Manor have been cooperative and attentive to the other's needs. If the youth
playing on the ball fields were any older, this scenario would have been impossible.
It would be CRR's recommendation that serious attention be given to improvements
at Badger Park in order to make this field available for both spring and fall use. The
facility is ideal with regard to field size and parking space, should be available to
users, and would alleviate the problems faced this year, once attention to the drainage
and lighting issues have been addressed.
Most organizations will complete their park usage by mid-July with the exception of
SSSA and TC Men's Baseball that conclude their seasons August 18 and 21
respectively.
CRR is also pleased to report that a soccer tournament was held in Freeman Park in
June without reported concerns. Once the document process and adherence to the
tournament application was reviewed with representatives of TUSA due to recent
personnel changes, onsite monitoring confirmed that a successful event was enjoyed
by all. It was also observed that parking for tournament use continued to flow
throughout the course of the tournament without issue.
Passive use has remained stable at Freeman Park, though numerous calls by outside
non-organized users requesting space will continue to place additional pressure on all
Shorewood facilities. As mentioned above, other parks have also demonstrated
increased activity of their regular seasonal use. Continued communication between
the Southshore Community Center, CRR, sports organizations, and other park users
regarding events have provided balance to recunent parking issues in that area.
CRR Staff looks forward to providing continued Park Coordinator services in the
remaining quarters of the year. While the immediate focus will be preparation for the
2006 Fall/Winter Sports Infom1ation Meeting scheduled for July 17 at City Hall,
2
CRR will continue monitoring and communication efforts for the remainder of the
spring season and beyond.
Thank you, once again, for the opportunity to provide Park Coordinator services to
the City. Please do not hesitate to contact Kristi Anderson or Sally Keefe with
further questions regarding the Park Coordinator position and its services.

Echols - Appeal for Additional Time to Correct Zoning Violations
FILE NO.
Property(4960 Suburban Drive)
Last month the Council granted Mary Echols an extension of time to clean up
nuisance violations on her property at 4960 Suburban Drive. In addition, Ms. Echols
was given time to apply for variances for accessory buildings located on her property.
After meeting with staff, Ms. Echols has decided not to request the variances, but she

cited.
The appellant has made considerable progress in complying with the City Code, and

RE:
Cemetery of the Resurrection - C.UP. Amendment
FILE NO.
405(06.11 )
BACKGROUND
In January 2003, St. John the Baptist Church received a conditional use permit approving
a master plan for the Cemetery of the Resurrection, located at 5425 Covington Road (see
Site Location map - Exhibit A, attached). The plan included the construction of two
mausoleum structures and a new maintenance building. Last year St. John's was granted
an amendment to their conditional use permit that included one mausoleum structure and
a new maintenance building. The mausoleum is currently under construction and church
representatives have applied for another amendment to their C.UP. relative to the
maintenance building.
The original maintenance building was to be located near the northwest corner of the
cemetery's looped driveway. The applicants now propose to locate the building on the
south end of the loop, as shown on Exhibit B. The revised plan shows a somewhat larger
building (30' x 30') than the original (24' x 24'). The building is described in the
applicant's letter (Exhibit C).
The property is zoned R -1 A, the southern half of which is subj ect to shoreland
management requirements, nothing of which affects their plans.
ANAL YSIS/RECOMMENDA TION
The 2005 staff report for the previously approved C.UP. characterized the maintenance
building as being basically a typical two-car garage. The revised plan is essentially an

ample two-and-a-half-car garage. Similar to the original plan, it is one story in height and
very residential in character. The proposed location is tucked into a leveled offlow area
that is very well screened from surrounding residential properties by both vegetation and
terrain. It is recommended that the revised conditional use permit be approved as
presented.

A Resolution Accepting Low Bid and Awarding
Contract to Successful Low Bidder
Attachment 1 is the Bid Tabulation for the Wedgewood Drive, Teal Circle, and Mallard
Lane Improvements and Appurtenant Work. Bids were opened and tabulated on July 19,
2006.
The low bidder is Northwest Asphalt, Inc. in the amount of$1,053,041.82, compared to
the engineer's estimate of$1,049,853.50.
As you may recall, the watermain portion of this project is being funded through a special
assessment. The items included in the assessment are identified as Schedule C on the Bid
Tabulation. Based on the low bid, the construction costs for watermain are $202,052.25.
This is $40,517.75 less than the estimated construction used to calculate the preliminary
assessment roll. Ifthere are no increased costs due to unforeseen circumstances, the
amount assessed to each property is projected to go down, although the final assessment
amount won't be determined until after final acceptance of the project. It is anticipated
that the bonds will be issued sometime in September.
Recommendation
Staff is recommending that the City Council approve the attached resolution that accepts
the bids and awards the contract to Northwest Asphalt, Inc. in the amount of
$1,055,041.82. A resolution is attached for your consideration.

RE:
Update on Traffic Counts for
Country Club Road, Lake Linden Drive, and Yellowstone Trail
This memo is meant to provide you with an update on traffic counts that have been performed for
Country Club Road, Lake Linden Drive, and Yellowstone Trail. Since these streets are designated as
Municipal State-Aid (MSA) roads, the City conducts traffic counts on these roads approximately every
three years. A comparison of the last two counts undertaken by the City indicate that there is actual a
reduction in traffic volume for all three of these roads.
2002 Count 2006 Count
Road Day 1 Day2 Dav 1 Day2 Change
Country Club Road 4725 5839 3601 3751 24% to 36% decrease
Lake Linden Drive 5280 5911 4282 4352 19% to 26% decrease
Yellowstone Trail 5162 4816 4186 4018 17% to 19% decrease
Traffic counts are performed using pneumatic counters (air tubes connected to a recording device) that
are placed at each location continuously for 48 hours. The counts are not done on Fridays since there
are potentially less cars on the road due to people taking an early weekend.
The 2002 counts were done May 29th - 30th and June 3rd - 4th, which was still during the school year
when there is typically more traffic volume.
The 2006 counts were done May 1 st - 4th, which was also during the school year. It should also be
noted that these counts were done after the majority of the work was complete at the intersection of
County Road 19 and Smithtown Road.
In addition to the intersection realignment, staff is continuing to work with Hennepin County to further
reduce the amount of traffic on Country Club Road (and, subsequently, the other roads) by prohibiting
right turns on red for southbound CSAH 19. Mr. Jim Grube of Hennepin County has assured us that
the sign will be installed. {fl,. PRINTED ON RECYCLED PAPER

RE:
Approve Plans, Specifications and Estimate and Authorize Advertisement of Bids
Chanhassen InterconnectionlW oodhaven Well Proj ect
Attachment 1 is excerpts of the plans, specifications, and engineers estimate for the Chanhassen
InterconnectionlW oodhaven Well Project.
This project is being initiated by the city for a number of reasons. The existing Woodhaven system is
served by the Woodhaven well. The well house and controls have reached the end of their service life.
Even if the existing system were completely reconstructed, it is not anticipated that the new system
would provide adequate fire flow protection. Extension of the system within the boundary of
Shorewood is not feasible due to the length of the project and costs associated with such a project.
An agreement has been reached that allows us to connect the W oodhaven system with the City of
Chanhassen's water system. This connection will provide adequate fire protection within the
W oodhaven system.
The interconnection will consist of approximately 425 feet of 8-inch watermain. A pressure reducing
vault will be located just inside the Shorewood/Chanhassen boundary. Shorewood will retain
ownership of the vault, and will be responsible for maintenance of the valves and fittings housed
inside.
Once the interconnect is operational, the eXlstmg well house can be demolished under separate
contract. We will coordinate with a certified testing firm to prepare a report evaluating the existing
building for the presence of hazardous materials, as required by MPCA. It is anticipated that the
demolition costs will be $20,000 to $40,000, depending on the materials present in the well house.
The estimated construction and demolition costs, $175,000, will be funded with Water Revenue
Bonds.
Recommendation
Staff is recommending approval of resolution that approves the plans, specifications, and engineer's
estimate and authorizes advertisement of bids. A resolution is included for your consideration.
