Dawson, City Administrator cb DATE: June 10, 2004 SUBJECT: Continued Participation in Livable Communities Act The City has been a participant in the Livable Communities Acf(LCA) for several years. As a participant, the City is eligible to compete for grants from the Metropolitan Council available in: · the Local Housing Incentives Account.(LHIA, for affordable and life-cycle housing); · the Demonstration Accourit (LCDA, for innovative mixed-use and transportation development); or · the Tax Base Revitalization Account (TBRA, for polluted land redevelopment). One of the on-going obligations for a participating city is fulfillment of its Affordable and Life-Cycle Housing Opportunities Amount (ALHOA). The formula and obligation is Ii bit arcane. Anyway, these are expenditures by the city to plan, attract, or maintain affordable and life-cycle housing. Such. things as costs to review plans of such housing proposals, or to inspect such existing housing stock, qualify as ALHOA expenses. A direct contribution by the City to he Hennepin County HRA or the Met Council's LHIA would also qualify as ALHOA expenses. Staff could not identify and report any ALHOA expenses for 2002, which would be required for the City to renew its participation in the LCA late in 2003. Late last year, the LCA director contacted me about what the City planned to do to remain eligible. I responded with a letter (attached) expressing several reservations and identifying issues of fairness. In a subsequent conversation, we noted it was quite likely the Legislature would revisit and amend the ALHOA component of the LCA in 2004; however, no one knew if there would be a retroactive feature to the legislation. Consequently, we decided to wait until the end of the legislative session to see if there would be any changes that might be to Shorewood's advantage. The Legislature did make revisions to the LCA, but without any retroactive features. Going forward, the City's ALHOAwould be decreased. But for 2002, the City would need to identify expenditures and/or make contributions totaling $68,738. Continuation in Livable Communities Act June 14,2004, City Council Work Session Page Two Assuming the City cannot identify expenses of at least $68,738, the LCA director has suggested three options: 1) Distribute funds to the Hennepin County Housing and Redevelopment Authority 2) Distribute funds to the Metropolitan Council for the LCA Local Housing Incentives Account 3) Withdraw from the LCA from the LCA by resolution of the City Council until future participation is possible. 3a) The Met Council is requesting a response by July 1,2004. If the City Council has not adopted a resolution by that time, the Met Council will consider the City's participation ended at this time. I have my doubts that the Council is willing to do Options 1 and/or 2. Under Options 3 and 3a, the Council may overtly or silently withdraw from the LCA. I would suggest that Council direct staff to prepare a resolution to state the reasons for withdraVV\~ from the LCA at this time, and draw from the points in my January 6, 2004, letter to the Met Co~;. The City Council can make it very clear that although it is withdrawing from the LCA, the City .. , Council supports the Livable Communities programs. The session is over and the Governor has signed into law changes to the LCA ALHOA provision that reduce the ALHOA requirement for the vast majority of cities. These changes are retroactive beginning with the 2002 ALHOA (expenditures and contribution amounts applicable in 2003). The concern we have is with regard to fulfillment ofthe 2001 ALHOA (expenditures and contributions required in 2002), which you indicated on two occasions in 2003 had not been fulfilled by the city of Shore wood in 2002. Given that the statute has been changed, but the change does not affect the 2001 ALHOA, I ask once again, if Shorewood can verify that it had expenditures and contributions in the amount of at least $68,738, representing 85 percent of ALHOA, as required by the law, during calendar year 2002. If the city is able to verify that it expended at least $68,738 on affordable or life-cycle housing production or preservation in 2002, this requirement will be considered to have been met. If not, the city has three options. To remain an LCA participant, it can distribute this amount to the Hennepin County HRA, or to the LCA Local Housing Incentives Account. The third option may be, unfortunately, withdrawal from the LCA by city council resolution until such time as future city participation is possible. I ask that you provide information to resolve this issue no later than July 1, 2004. As Guy Peterson and I discussed in the fall, Shorewood could not come close to this figure for affordable or life- cyCle housing activities in 2003. I believe that that is how we resolved the issue. As I have mentionedto Guy and others at the Metropolitan Council, and to AMM staff, the ALHOA requirement in the LCA is not appropriate or productive. I am pleased that there may he an initiative forwarded to the Legislature. I would like to point out some oithe policy issues with the current ALHOA requirement. . As you point out, if a city is unable to meet the ALHOA requirement, one of the options is to withdraw from the LCA. If a city withdraws, or 4ecides not to participate in the first place due to the requirement, then the city may be viewed as not supporting the concepts behind the LCA. The City of Shorewood is very supportive of the intent and programs of the LCA. Our non- participation would be viewed mistakenly as eroding support for this very successful piece of legislation. · In times of financial constraints such as we currently face, it is not prudent to spend our residents' and businesses' funds on activities for which there is no demand or opportunity in Shorewood. The other options you identified-contributing the ALHOA-required amount to the Hennepin County HRA or the LCALocal Housing Initiatives Account~would not be prudent. It is appropriate to acknowledge activities on which a city has already expended resources. _ It is not appropriate, nor would there likely be City Council support, to make a separate cash contribution. Anyway, there was nothing in the City's 2003 budget and nothing in the City's 2004 budget in terms of a cash contribution for the ~CA. . The cities around Lake Minnetonka are small. As demonstrated in a housing report done in the very late 1990s, the cities in the collective subregion have housing affordability characteristics that .. are similar to the metropolitan area's. -- It is difficult on a city-by-city basis in this subregion, given their limited capacities and geographic restraints, to. achieve LCA requirements individually. The cities are supportive of each other's efforts, and understand their interdependent roles to provide life-cycle housing opportunities for residents who want to continue living in the Lake Minnetonka area. #. ~J PRINTED ON RECYCLED PAPER Elizabeth Ryan Re: City of Shorewood 2003 ALHOA Expenses January 6, 2004 Page Two . Shorewood is 90 to 95 percent developed, and most of the housing stock is relatively new. Consequently, there are no imminent redevelopment or rehabilitation opportunities. There are also few new development opportunities, and what exists are of an in-fill variety. What land is available is prohibitively expensive, and property value appreciation would likely not keep housing affordable for very long. . Shorewood City Councils have had long-standing policies not to interfere with market forces, and thus the City has not been active in development or redevelopment. The scope ofthe City's activity has been limited to comprehensive planning, zoning regulations, and acting on land use development applications made by private parties. The current City Council and Planning Commission have identified the need to evaluate life-cycle housing opportunities within Shorewood, and have begun work in this direction. . The City views LCA programs as a development tool. The City has been willing give its support to and to work with parties interested in developing life-cycle housing. One development proposal that is coming through the pipeline is for housing on what has been an auto salvage business property for several decades. We believed that it was a prime candidate for an LCA program, and were willing to work with the developer. The developer, however, decided to plan quite expensive twinhomes on the property. As we knew it would not qualify for an LCA program, the City gave its support to the developer for a remediation program available through Hennepin County. The regional goal should be to find ways to realize life-cycle housing wherever opportunities may arise. As I understand it, the City of Shorewood would be weighted more favorably on an LCA affordable housing application because the City does it poorly on the LCA's score of affordable housing within the City limits. If this is an appropriate carrot, there is a disproportionately large stick of spending $70,000 annually (and increasing it every year) to be eligible. It is a disincentive. Yet the City supports the LCA. At this time, the City's position would be to await action that may result from the 2004 Legislature. It will not serve the residents and businesses of Shorewood, or the larger metropolitan public, to attempt creative accounting or to deplete the City's reserves to remain eligible under the current LCA rules. It will serve the larger public for the Metropolitan Council, AMM, and other interested parties to address situations like Shorewood's while considering changes in legislation. Whither City Hall? -- June 14 Council Work Session Earlier this year Council received the City Hall assessment report performed by Boarman Kroos Vogel (BKV) Group. While Council wished to examine all alternatives presented at a later time, the Council indicated that expansion of existing City Hall, or construction of a new City Hall, seemed sensible for focusing discussion. BKVGroup identified water as a significant structural issue, and agreed with staff that evaluation of an associated matter-mold-should be performed. Results could indicate the level of immediacy to make changes in the facility, and what directions those changes could take. The City commissioned Institute for Environmental Assessment, Inc., (lEA) to determinean<i evaluate the "fungal contamination" in City Hall. lEA took samples on April 1, 2004, and, after taking the time necessary for maturation of the fungi to be measured, issued its report on May 20, 2004. A copy of the lEA report is attached. Summary of Maior Findings: lEA's findings and recommendations are summarized on the first page of its transmittal. It found no fungal contamination in levels that would cause health concerns on the main level, and recommended that the carpet be "HEP A vacuumed to remove excess fungal spores." lEA did find elevated levels of fungi on the lower level that could be mitigated. · Some sheetrock on the north wall of the east storage room had fungal contamination. It "should be removed under 'controlled conditions'." · "Efflorescence on the exterior block walls of the west storage room should be cleaned and . sanitized. These remediation actions should be conducted on a regular basis to ensure the growth does not occur in the future." These conditions do not indicate immediate environmental health threats in the building. To assure the health of City employees and visitors, they should be addressed in the near future. Staff will need to do some research to estimate the expense of performing lEA's recommendations. The City should have sufficient funds in the Public Facilities fund or in the balance in the General Fund to perform this work. ft ~., PRINTED ON R~CYCLED PAPER #j Discussion re: City Hall June 14,2004, City Council Work Session Page Two Other Immediate Concerns: The BKV Group report noted several parts or systems of City Hall which were deteriorating significantly. Two systems urgently need attention regarding the viability of City Hall. . The roof must be replaced. Without replacement, the integrity and safety of the entire building and its contents are at increased risk. The cost estimate for the roof replacement is $20,000. It is more of a cost of doing business, rather than a capital investment in the building. . The siding on City Hall is failing. There are many signs of rot or other deterioration. Water intrusion in failed siding will weaken the structural integrity of the exterior stud walls and destroy insulation. While the siding is less critical compared to the roof, it does need to be addressed. If a short-term perspective is taken, some siding should be replaced and the rest treated. The long-term approach would be to replace the siding entirely. This latter approach could point toward expansion of City Hall using the existing structure. Scenarios: Council may recall the four concepts discussed by BKV Group. The costs mentioned below were very rough and meant to be illustrative for orders of magnitude. 1) Short-term Maintenance The minimum improvements that need to be made - including new roof, siding, and windows; addressing water infiltration (short-term fixes); making HV AC changes; ADA accessible restrooms and entry - were estimated to be $215,000. These improvements would need to be done ifno further changes were to be made for City Hall. Not all of the short-term maintenance items would be necessary if it were decided that more substantial changes for the building would be made in the near- to mid-term. 2) Bridge Concept This is a stop-gap solution to renovate the existing space while planning to expand or replace City Hall. The guideline cost estimate is $730,000 (in 2004 dollars). This estimate would include the items addressed in "short-term maintenance". In its earlier discussion, councilmembers made several comments that this approach would not be a very prudent use of funds. 3) Addition Concept This concept would add approximately 2,400 square feet of space and involved substantial interior renovation, although there would still be space shortages given current industry standards. The total project cost was estimated to be $1.3 million. 4) New Building The space study indicated a need for approximately 12,000 square feet of space. The total project cost estimate of$3.2 million assumed construction on the existing City Hall property. There are opportunities to add land to the existing site or locating at a different site, but their additional costs were not analyzed by BKV. Discussion re: City Hall June 14,2004, City Council Work Session Page Three An issue with either an addition or a new building is the disruption or relocation of City Hall operations and staff during construction. In the case of an addition, it will likely be more cost-. effective and result in greater buildin inte i to demolish the u r level of Ci Hall and buil eve g new. th.1S way, it also may be easier to excavate around the building for mitigation of water issues. An addition made in this way would be better termed an "enlargement" of City Hall. Staffhas not begun research regarding the duration and cost of temporary space. Timing: Council should have discussion about the optimal timing to make a commitment on any of the four concepts offered by BKV. Immediate needs may be addressed this year. Short-term maintenance could be included in the 2005 budget, but may not be prudent if it is decided that the enlargement or replacement of City Hall should happen within a few years. Another issue with timing concerns the type of process the Council may wish to conduct in arriving at a decision. a) The process about the concept to pursue could be largely an internal one, involving Council and staff, either as a whole or through a committee. b) Recommendations from the process in (a) could be forwarded to a review committee, whose members may include Council, staff, advisory commissioners, and residents. c) Alternatively, the Council may wish to create a task force to study the issue and develop recommendations. d) However recommendations may come to Council for action, if a decision is made to enlarge or replace (and possibly relocate) City Hall, the Council may wish to have a task force regarding architectural design, cost, and, if necessary, changes to Badger Park. It would make sense to have engaged the architect, and perhaps a soils and/or structural engineer, for the project before this task force begins its work. These processes will take several months to complete. There are fewer than three months available before the Council sets its not-to-exceed 2005 tax levy, and about two months after that for preparation of the Council's fmal2005 tax levy. Financing preferences: The Council should decide if it wishes to have a referendum to finance an enlargement or replacement of City Hall. With legislation enacted last year, there is no longer a statutory requirement for referendum for long-term (greater than five years) fmancing of municipal buildings. Financing for land that would take more than five years to payoff, however, is not exempt from the referendum requirement (although land purchase through the EDA may qualify as a referendum-exempt option). The lack of referendum removes the need to use the EDA to issue annual-appropriation (aka lease-revenue) fmancing, and the City would see the better interest rate it would have with any other general-obligation bonds. If the Council wants to have a referendum, it is questionable whether sufficient information and costs can be developed to forward the ballot question to Hennepin County this fall. The purpose of this investigation was to detennine and document the extent of fungal contamination in the lower level of the building, and also to determine whether any fungal contamination has migrated to the main floor. Executive Summary On April 1, 2004, lEA conducted a site assessment and fungal sampling at Shorewood City Hall. lEA performed a visual evaluation and collected fungal air, dust, bulk, and bulk dust samples. IEA's findings and recommendations are summarized below: . The airborne fungal sample collected on the main level indicated low fungal counts compared to the outdoor comparison. . The airborne fungal samples collected in the lower level indicated elevated fungal counts compared to the outdoor comparison sample. . The microvac samples indicated elevated fungal counts near the stairway to the lower level. However, the highest ranking fungal organisms identified of the sample were outdoor type organisms. Recommendation: The fungal contaminated sheetrock on the north wall of the east storage room should be removed under controlled conditions. Recommendation: The efflorescence on the exterior block walls of the west storage room should be cleaned and sanitized. These remediation actions should be conducted on a regular basis to ensure the growth does not occur in the future. Recommendation: The carpeting on the main level should be HEP A vacuumed to remove excess fungal spores. 1.0 Introduction lEA was requested by the City of Shorewood to perform an evaluation at Shorewood City Hall. The evaluation" was requested in response to concerns of migration of fungal spores from the lower level to the occupied main level. The lower level of the building is not occupied and is used currently for storage items. 2.0 Observations . The east storage room is constructed of sheetrock over the block wall on the north, east, and south walls. Visible fungal growth was observed on the front surface of the sheetrock in the east storage room of the lower level. Extensive efflorescence on the block wall was observed throughout the west storage room. It was reported to IEA that the building was built near the water table and there have been times where water has penetrated through the cracks in the concrete flooring, creating puddles. . The furnaces serving the city hall are located in the west storage room. . The east storage room has a sump pump that operates quite frequently. 3.0 Results & Discussion Complete guidelines for interpreting laboratory results are available in Appendix I. Laboratory analysis reports can be found in Appendix n. 3.1 Airborne Fungal Samples Fungal air samples were collected on the main level, west and east storage rooms in the lower lever. Quick Reference Guideline: Fungal organisms isolated in the indoor air sample are evaluated in comparison to the outdoor sample in terms of type and concentration. Indoor concentrations should be lower than outdoor concentrations in mechanically- ventilated buildings with adequate filtration. Types of organisms found indoors should be similar to those found outdoors. . Discussion of Air Sample Results The sample result for the main floor indicated low levels of fungal counts compared to the outdoor comparison sample. Cladosporium was identified as the dominant fungal organism, as it was on the outdoor sample. Wallemia sebi was the other organism identified, and was not found outdoors though only two spores were detected indoors. The result is indicative of normal conditions. Penicillium was identified as the dominant fungal organism and is commonly found on water damaged building materials. The result is indicative of an interior growth source. The sample result for the West Storage room also indicated elevated levels of fungal counts. Aspergillus candidus and Penicillium were the two highest ranking fungal organisms identified on the sample and are commonly associated with growth on moisture-impacted materials. The result is indicative of an interior growth source. 3.2 Microvac Bulk Dust Samples Microvac bulk dust samples were collected from the top surface of the carpet near the top of the stairway and also away from the stairwell. However, Aspergillus versicolor and Penicillium were identified at concentrations on the sample that is suggestive of an interior source. The sample result collected away from the stairway in the east section of city hall indicated low levels offungal counts (spores) in the carpet dust. Other organisms that are suggestive of migration from the outdoors include Alternaria, yeasts, and Epicoccum nigrum. Fungal organisms associated with growth on moisture impacted building materials include Aspergillus, Penicillium, Chaetomium, Acremonium and Trichoderma. Since the overall concentration of fungal spores on a hard surface such as a shelfis typically impacted by how often the surface is cleaned, which should reduce the concentration, the rank order of the organisms detected is more important in evaluating the sample result. If the dominant or upper-ranked fungal organisms are associated with growth on moisture-impacted building materials, the result is typically indicative of an interior source. . Discussion of Bulk Surface Dust Sample Results The sample collected from the top surfaces of the block wall in the west storage room indicated low levels of fungal counts. Though the levels were low, several fungal organisms were identified on the sample that are associated with growth on moisture impacted building materials. Aspergillus ochraceus was the dominant fungal organism on the microvac sample from the block wall and was also identified on the air sample in the west storage room 3.4 Bulk Dilution Fungal Sample The fungal bulk sample of sheetrock was collected in the northwest comer of the east storage room in the lower level. Discussion of Bulk Sample Results The result for the sheetrock sample collected from the northwest corner of the east storage room indicated heavy levels of fungal counts. Cladosporium, Stachybotrys chartarum, and Penicillium were the three highest ranking fungal organisms identified on both analysis mediums. Although Cladosporium is typically considered an outdoor type fungus it will grow indoors under the right conditions. Stachybotrys chartarum is commonly found on drywall subjected to chronic or massive moisture issues. Penicillium is also typically found on moisture impacted building materials. 4.0 Conclusions and Recommendations Observations and sample results confirmed that fungal growth has occurred along the north wall of the east storage room Based on the fungal samples collected and site observations in the lower level of the building the following is recommended by IEA: O:\Client Files\C\City ofShorewood\Projects\#R04 -7447-1301 City of Shore wood-Final Rpt.doc City of Shorewood Shorewood City Hall- Fungal Evaluation lEA Project No. 7447-1301 Pa2e 6 East Stora2:e Room It is recommended, at a minimum, the sheetrock on the north wall be removed under controlled conditions. Controlled conditions include containment with HEP A-filtered air, respiratory protection, critical barriers, engineering controls, and proper sanitizing of remaining substrate following abatement (i.e. metal studs, bottom plates,. etc.) to prevent the possibility of cross-contamination to other areas of the building. If the water intrusion is not repaired, porous building materials, such as fiberglass insulation and sheetrock should not be re- installed along this area of the wall. West StOr&2:e Room The water staining and efflorescence on the exterior block wall should be cleaned, scrubbed and sanitized to remove any excess fungal spores and water staining. Cleaning of the block walls should be conducted periodically to limit the staining and potential for fungal growth. Storage items along the exterior block wall should not be placed in contact with the wall. Several boxes were observed on the shelves that were in contact with the wall and had water staining on them These items could potentially be a source of fungal growth. Moisture Issues Ifpossible, installation of an interior drain tile system should be considered to direct the water that is seeping through the block walls and/or floor. Application of an interior waterproofing coating to the block wall should also be considered. However, consulting with a building engineer experienced with envelope moisture intrusion issues should be . considered to determine what action(s) would be most appropriate to correct or minimize the moisture issues. Main Level The air sample collected from the main level identified a low concentration of Wallemia Sebi, which was also found at a higher concentration in the West Storage Room This suggests that a small amount of migration of fungal spores might have OCCUlTed from the basement. However, several other organisms were identified in the Storage Rooms that were not identified on the upstairs air sample. In addition, the carpet dust sample collected away from the stairway appears normal. The dust sample collected near the top of the stairway identified a much higher concentration of spores than what was found away from the stairs. Cladosporium was identified as the dominant organism, which is typically associated with migration of spores from the outdoors. However, Cladosporium growth was also identified on the sheetrock in the East Storage Room The detected concentration of Cladosporium spores in the carpet dust is possible due to both migration from outdoors and from the basement. The presence of Aspergillus versicolor and Penicillium spores in the dust detected at the top of the stairs is suggestive that a low level of spores had migrated up from the basement to the top of the stairs. Overall, the air and dust samples on the main level indicate that a significant migration of fungal spores from the basement has not OCCUlTed. Based on the dust sample result from the top of the stairway, it is recommended that the carpeting on the main floor be vacuumed using a HEP A vacuum to reduce the spore levels in the dust. The sampler was cahbrated at 30 liters per minute, and was run for three minutes per sample for a total volume of 90 liters. The edge of each sample plate was sealed with masking tape to protect against cross- contamination. An outdoor reference sample was also collected. . Bulk samples of dust from carpet tops were collected by the Microvac sampling method. The samples were collected with three-piece, 37 mm 0.8 Ilm MCE filter cassettes. The filters were connected to a high flow-sampling pump with tygon tubing. The sampling pump was calibrated at approximately twenty liters per minute flow rate. A one square foot template was placed onto the carpet top. The samples were collected open-faced, and were pressed against the top surface of the carpet. The cassette was moved back and forth over the square foot twice in one orientation. The orientation was then switched ninety degrees, and then the process was repeated. Additional square feet were sampled until an adequate visible dust loading was present ~n the sample cassette. The bulk dust (Microvac) samples were then prepared by serial dilution, which entails diluting a known mass of the sample (dust) in a measured amount of sterile water. The water solution in a range of dilution concentrations was then spread onto an analysis medium, which in this case were DG-18 and MEA agars. A fungal concentration is then determined by the amount of growth, the dilution factor used and the mass of the sample. Several fungal species are known to be allergenic, toxigenic and/or pathogenic if present at elevated levels. However, the most common type of response is allergic in nature and is manifested by irritation to the respiratory system and eyes, sneezing, sinus congestion and rhinitis. The presence of fungi on building materials as identified by a visual assessment or by bulk/surface sampling results does not necessitate that people will be exposed or exhibit health effects. In order for human to be exposed indoors, fungal spores, fragment, or metabolites must be released into the air and inhaled, physically contacted (dermal exposure), or ingested. Whether or not symptoms develop in people exposed to fungi depends on the nature of the fungal matter (e.g., allergenic, toxic, or infectious), the amount of exposure, and the susceptibility of the exposed persons. Susceptibility varies with the genetic predisposition (e.g., allergic reactions do not always occur in all individuals), age, state of health, and concurrent exposures. For these reasons, and because measurements of exposure are not standardized and biological markers of exgosure to fungi are largely unknown, it is not possible to determine "safe" or ''unsafe'' levels of exposure in general. 1) However, the following industry guidelines are helpful in determining if fungal growth/contamination may be a concern in a building: 1. Mycologists (microbiologists who specialize in the study of fungi) and IAQ practitioners generally agree that the health risks associated with exposure to and inhalation of common phylloplane (leaf-associated) fungi, such as species of Cladosporium or Alternaria, is less than that associated with exposure to potentially toxigenic or pathogenic fungi such as the genera Stachybotrys, Aspergillus or Penicillium. 2. In mechanically ventilated buildings with adequate filtration, the American Conference of Governmental Industrial Hygienists (ACGIH) has indicated that indoor bioaerosollevels should be less than the outdoor levels and the predominant species to be similar. (2) The publication also recommends the interpretation ofbioaerosol data based on a combination of the following: . indoor/outdoor concentration ratios, . a comparison of species composition indoors and outdoors, and . the presence of "indicator species" (those that indicate excessive moisture or a specific health hazard) isolated from the indoor environment. 3. For Microvac bulk dust samples from carpet tops analyzed by a dilution method, the following numbers are rough roles of thumb used to assess the level of culturable fungal counts (spores). The following guidelines are utilized in helping evaluate whether the level and composition of culturable fungal counts is suggestive of interior growth, or of the migration of spores into a building from outdoors, especially of fungi that are commonly found outdoors such as Cladosporium.
