Subject: Shorewood Board of Review Meeting
Mr. Rogers,
The Shorewood City Council, sitting as the Board of Review, received your written appeal at its
meeting last night. It took no action, other than to refer the appeal to the County assessing staff.
The Board will meet again at 6:00 p.m. Monday, April 26, at Shorewood City Hall, and expects
to conclude its business that evening.
If you and Tom Kunik are in agreement with the value he assigns your property after meeting
with you this week, he will report that to the Board, and thus you may choose not to appear at the
Board meeting.
If you are in disagreement, then you most likely would want to appear at the Board meeting if
your schedule permits. If you are unable to come, the Board would appreciate something in
writing from you in which you would relate your concerns.

price of $995.000. In reviewing the file for this property it appears that the interior has not been
inspected. I tried contacting the selling agent but was unsuccessful. Assuming that this property was
in similar condition as the subiect I recommend lowering the value to reflect our most recent sale.

The 2004 Shorewood Local Board of Review has been scheduled for Monday, April 19TH.
As preparation for the upcoming Local Board of Review, please find the enclosed data to help
you. A summary of duties and responsibilities, a chart listing the amount of assessment
growth for Lake Minnetonka communities, an assessment fact sheet, and a book of sales with
photos and characteristics from a sample of sales throughout the city.
Summary of the 2004 Assessment
Each year estimated market values are analyzed along with data from the market.
Adjustments, as appropriate for each type of property are made. The results of those
adjustments for the 2004 assessment are as fellows:
· Residential Lakeshore + 5.2%
· Residential OfILake + 6.9%
There are 2,980 taxable parcels in the city with a total market value of approximately
$1,284,952,000. This value includes $14,924,000 in new construction improvements. The
overall value increase for the City of Shore wood is 6.2%.

LOCAL BOARD OF APPEAL AND EQUALIZATION
SUMMARY OF DUTIES AND RESPONSffiILITIES
Most of the responsibilities listed under the Local Board of Appeal and Equalization are
statutory, primarily found in Minnesota Statutes 274.01.
. The first responsibility is attendance. The Local Board of Appeal and Equalization is
an official public meeting similar to a City Council meeting and can not convene
without a quorum. In addition to the local assessor, the county assessor, or one of
his/her assistants is required to attend.
. The valuation notices shall be in writing and be sent by ordinary mail at least ten
calendar days before the meeting of the board. The valuation notice will include the
dates, places and times set for the meetings of the Local Board of Appeal and
Equalization as well as the Hennepin County Board of Appeal and Equalization.
. The meetings must be held between April 1 and May 31 each year. The County
Assessor shall fix a day and time when the Local Board of Appeal and Equalization
shall meet. The board must complete its work and adjourn within 20 days from the
time of convening stated in the notice of the clerk, i.e., calendar days -- original night
is day one.
. The clerk shall give published and posted notice ofthe meeting at least ten days
e before the date of the meeting.
. Local Boards of Appeal and Equalization must see that all taxable property is
properly assessed, valued, and classified for all current assessments. The board may
consider both real and personal property.
. If any property has been omitted, the board must correct the assessment by adding it
to the list of assessments along with its market value.
. The board may not increase or decrease by percentage all assessments in a district of
a given class of property. Changes in the aggregate assessment by class are made by
the county board of equalization.
. Although the Local Board of Appeal and Equalization has the authority to increase or
decrease individual assessments, the total of such adjustments must not reduce the
aggregate assessment by more than one percent. If the total reductions would lower
the aggregate assessments by more that one percent, none of the adjustments may be
made. The assessor shall correct any clerical errors or double assessments discovered
by the board without regard to the one percent limitation.
. The local board does not have the authority to reopen former assessments on which
taxes are due and payable. The board only considers assessments in the current year.

· The board may find instances of undervalued properties. The board must notify the
owner of the property that the value is going to be raised. The property owner may
then appear before the board if they so wish.
· It is the primary duty of each local board to examine the assessment record to see that
all taxable property in the assessment district has been properly placed upon the list
and valued by the assessor. The local boards do not have the authority to address
exemption issues. Only the county assessor has the authority to exempt property.
· A taxpayer may appear in person, by council, or written communication to present his
or her objection to the board. The focus of the appeal should be centered on the
factors influencing the estimated market value or classification placed on the property
by the assessor.
· All changes will be entered into the assessment books by the county assessor's office.
· Before adjourning, the local board should prepare an official list ofthe changes. The
law requires that the changes be listed on a separate form. All assessments that have
been increased or decreased should be shown as prescribed on the form along with
their market values. The record must be signed and dated by the members of the
Local Board of Appeal and Equalization.
· The Hennepin County Board of Appeal and Equalization begins meeting on:

_The purpose of this local board meeting is to review the Estimated Market Value and Classification for the 2004
"Assessment, which will be reflected in taxes payable for 2005.
Any questions regarding the taxes payable in 2004 cannot be addressed at this meeting because they are based on the
assessment made in 2003. This Board has no authority to act on the 2004 taxes as per MN statute, Sec. 274.01.
While we realize the MN Property Tax system is rather complicated and, at times, difficult to understand, it is hoped that
the following information will help you when trying to communicate your questions and concerns with regard to your
property's market value.
State law requires that the value and classification of real estate be established as of January 2nd each year. Market values
are based on sales of properties within your market area. The Minnesota Department of Revenue requires the overall level
of assessment to be between 90% and 105% of market value. If the overall level of assessment is not at least 90%, the state
may impose an aggregate increase on all properties within a city or classification. If sales indicate the market values have
changed, the assessor must follow the trend indicated, whether it is to increase or decrease property values.
Mass appraisal is the method used by assessors to estimate the market value of properties. Each property is physically
viewed every four years. In addition, all new construction, alterations, or improvements will be appraised annually.
COMMONLY ASKED QUESTIONS AT BOARD OF APPEAL MEETINGS
1. IS IT ILLEGAL FOR THE ASSESSOR TO INCREASE MY VALUE SO MUCH IN ONE YEAR?
e
No. The assessor must value property at market value each year. Property values change continuously with
changing economic conditions. There is no limit as to the amount of increase or decrease in property values in a
gtven year.
2. WHEN WILL THE VALUE INCREASES STOP?
This is impossible to predict. Our values are dictated by the market. If sale prices are increasing, our
estimated market values will increase. If sale prices are falling, then our estimated market values must follow
that trend.
3. WHAT DOES THE ASSESSOR LOOK AT TO DETERMINE A PROPERTY'S MARKET VALUE?
Each property is viewed to gather information on all characteristics that affect its market value such as location,
size, age, quality of construction, amenities (i.e. walkout basements, fireplaces, and extra baths), and site
characteristics.
4. AS A HOMESTEADING RESIDENT, WILL I BE TAXED OFF MY PROPERTY, ESPECIALLY IF I AM
ON A LIMITED INCOME?
Homesteading residents are eligible for property tax breaks in Minnesota through the use of the Homestead
Classification. This decreases the property taxes on most residences. In addition to the Homestead Classification,
residents of Minnesota are eligible to apply for the Regular Property Tax Refund or the Special Property Tax
Refund. Both of these must be applied for using the M - IPR form issued by the State of Minnesota. The Regular
Refund is based on income, so check the requirements stated on the form. You may qualify for the Special Refund
if your property taxes increased by more than 12% from 2003 to 2004 and the increase was $100 or more. There

Dear Clerk/Administrator,
This letter is to inform you of legislative changes made by the 2003 Legislature that effect
the Local Boards of Appeal and Equalization. These changes provide that by no later than
January 1, 2006, and each year thereafter, there must be at least one member at each local
board meeting who has attended an appeals and equalization course developed or
approved by the Commissioner of Revenue. The required course work must have been
completed by the designated local board member(s)within the last four years of each
annual local board meeting(s).
A handbook will be developed by the Commissioner of Revenue, no later than January 1,
2005 and is to detail local board procedures, responsibilities, and requirements. A review of
the handbook must be included in the local board course. Details of the course and
handbook will be promulgated by the Department of Revenue at a later date.

In addition, the new legislation also requires that the local boards provide proof of
compliance with the course attendance, as well as, provide verification that a quorum was
present at each of the local board meetings fn the prior year. This legislation provides that
any city or town that does not provide proof of compliance to the county assessor by
December 1, 2006, and each year thereafter, is deemed to have transferred its board of
appeal powers to the county for the following assessment. This transference of duties to the
county is an "altemate review process" (M.S. 274.13 subd. 1c.) and shall take place in April
or May with "open book" meetings. The open book meetings are where the county
assessor shall make available a procedure for reviewing the assessments with the
taxpayers. A copy of this 2003 legislation has been attached.
In light of these legislative changes, I wanted to remind you that M.S. 274.01 subd.3
currently provides for the transference of duties from the local boards to the county
assessor. This statute is only available to those cities whose assessment services are
performed by the county assessor.
'The town board of any town or the governing body of any home rule charter or statutory city
may transfer its powers and duties under subdivision 1 to the county board, and no longer

perform the function of a local board. Before the town board or the governing body of a city
transfers the powers and duties to the county board, the town board or city's governing body
shall give public notice of the meeting at which the proposal for transfer is to be considered.
The public notice shall follow the procedure contained in section 13D.04, subdivision 2.
A transfer of duties as permitted under this subdivision must be communicated to the county
assessor, in writing, before December 1 of any year to be effective for the following year's
assessment. This transfer of duties to the county may either be permanent or for a specified
number of years, provided that the transfer cannot be for less than three years. Its length
must be stated in writing. A town or city may renew its option to transfer. The option to
transfer duties under this subdivision is only available to a town or city whose
assessment is done by the county".
The Commissioner of Revenue will be providing detailed instructions in the near future.

know the options that are available to your City Council/Board of Appeal and Equalization.
